12/20/7 i <br />ORDINANCE NO. 811-A20 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE (NO. <br />811) TO RESTRICT ONE DWELLING TO A LOT OR PLOT <br />THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: <br />Section 1. Sec. 12 (Administration) of Ordinance No. 811 is hereby <br />amended by renumbering paragraphs 5, 6, 7, 8 and 9 to numbers 6, 7, 8, 9 and 10, respectively. 6.1 <br />Sec. 2. Sec. 12 (Administration) of Ordinance No. 811 is hereby <br />"5. One Dwelling per Lot or Plot. Not more than one dwelling shall <br />(a) a variance has been granted pursuant to paragraph 6, Sec. 12 <br />of Ordinance No. 811, to allow more than one dwelling; or <br />(b) the lot or plot is divided, without platting pursuant to <br />Ordinance No. 801, and each part thereof is at least five acres <br />in area, is not less than 300 feet in width, and otherwise <br />complies, in all respects, with the requirements of this ordin- <br />ance; or <br />the lot or plot is platted into two or more lots, pursuant to <br />Ordinance No. 80 1. Mr. Luce said that he had anticipated that <br />traffic studies and detailed landscaping studies would be covered under this <br />ordinance and that the Village did not have personnel to handle kbch Studies". <br />Following considerable discussion, Councilman Courtney's motion that the <br />Mr. Erickson presented a Zoning Ordinance amend-. <br />ordinance be returned to the Village Attorney for revision was seconded by <br />Councilman Johnson and carried. <br />N.ANAGER'S DECISION CONFIRMED RELATIVE TO RETENTION OF BRAUER & ASSOCIATES, INC. <br />BY GEORGE ABLAH. Mr. Hyde recalled that the Village had retained Brauer & <br />Associates to conduct the Southeast Edina Plan Study, cost of which was <br />recovered in part from some of the land owners involved. Mr. Hyde advised <br />thgt he had told Mr. Brauer that, while he had complete confidence in Mr. <br />Brauer's integrity, he felt that a conflict of interest was involved and that <br />Mr. Brauer should not, therefore, act as a consultant to Mr. Ablah relative to <br />the Glacier Sand & Gravel property. Following considerable discussion, Codncil- <br />man Courtney's motion that Council confirm Mr. Hyde's decision was sec6nded by <br />Councilman Johnson and carried. Councilman Johnson then suggested that a resolu- <br />tion be drafted for future consideration which would <br />that once the Village of Edina has hired or retained a professional consultant <br />for any matter, cause or thing, that consultant cannot thereafter be retained <br />by another party with respect to the same matter cause or thing. <br />I' <br />reflect Council's feeling <br />PRESTIGE SECOND ADDITION GRANTED PRELIMINARY PLAT APPROVAL SUBJECT TO CERTAIN <br />CONDITIONS. Affidavits of Notice were presented by Clerk, approved as to form <br />and ordered placed on file. <br />preliminary plat approval, noting that this plat is located East of County <br />Road 18 just North of the Penney's warehouse and recommended preliminary <br />approval subject to the following provisions: <br />Mr. Luce presented Prestige 2nd Addition for <br />1. That 100 fee't on bQth sides of Nine Mile Creek be dedicated to the Village <br />of Edina for parkland and open space; <br />2. That a minor realignment of Lincoln Drive is made to conform with the <br />remainder of Lincoln Drive to the South; <br />3. That the appropriate sewer, water, street and drainage easements are pro- <br />vided and agreed upon by the Engineering Department. <br />Councilman Johnson thereupon offered the following resolution and moved its <br />adoption : <br />RESOLUTION GRANTING PRELIMINARY APPROVAL TO <br />PRESTIGE 2ND ADDITION <br />BE IT RESOLVED by the Village Council of the'village of Edina, Minnesota, that <br />that'certain plat entitled Prestige 2nd Addition, presented 2t$ the meeting of <br />the Edina Village Council of December 20, 1972, and platted by Prestige Devel- <br />opment Corporation ,
