7/3/72 <br />- RESOLUTION APPROVING PRELIMINARY <br />PLAT APPROVAL OF SCOTT BERG'S ADD'N <br />BE IT RESOLVED by the Village Council of the Village of Edina, Minnesota, that that <br />certain plat entitled "Scott Berg's Addition", platted by Don Berg, and presented at <br />the meeting of the Village Council on July 3, 1972, be and hereby is granted prelimi- <br />nary approval provided it is modified to meet Planning Commission conditions and that <br />the following improvements shall be installed therein: Sanitary Sewer, Watermain, <br />Grading and Graveling. Motion for adoption of the resolution was seconded by Council- <br />man Shaw and on roll call, there were three ayes and no nays and the resolution was <br />adopted. <br />LOTS 12-18, BLOCK 1, LA BUENA VISTA ADDITION LOT DIVISION APPROVED. Affidavits of <br />Notice were presented by Clerk, approved as to form and ordered placed on file. <br />Mr. Luce presented the proposal for the division of the parsonage from the Calvary <br />Lutheran Church. He explained that the reasons for the division were to allow the <br />sale of the parsonage for use as a single family home. <br />both the acreage required for a church and for the home site were in conformance <br />with Village's ordinances. Mr. Luce informed the Council that the Planning Com- <br />mission recommended approval of the lot division, providing the descriptions of <br />the lots were changed so as to be in conformance with the Edina codes. <br />I <br />Mr. Luce clarified that <br />Two neighbors questioned lot lines, drainage, buffer zone and upkeep of the <br />property. <br />appreciated the opportunity to hear the remarks and welcomes neighbors to get <br />together with he and the Board of the church. <br />ing resolution and moved its adoption: <br />RESOLUTION <br />WHEREAS, the following described property is at present a single tract of land: <br />Lots 12, 13, 14, 15, 16, 17, and 18, Block 1, La Buena Vista, according <br />to the plat thereof on file and of record in the office of the Registrar <br />of Titles in and for Hennepin County, Minnesot92; and <br />WHEREAS, the owner has requested the subdivision of said tract into separate <br />parcels (herein called "Parcels1') described as follows: <br />Lots 12, 13, 14, 15, 16, 17 and that part of Lot 18, Block I, La Buena <br />Vista bounded by a line described as follows: Beginning at a point on <br />the Northeasterly line of Lot 18, a distance of 72.0 feet Southeasterly <br />from the Northeast corner of Lot 18; thence Southwesterly 160,O feet at <br />an angle of 80 degrees 50 minutes 19 seconds with said Northeast line, <br />as measured from Southeast to Southwest; thence Southeasterly to the <br />most Southerly corner of Lot 18; thence Northwesterly along the South- <br />westerly line of Lot 18 to the most Southwesterly corner of Lot 18; thence <br />Northerly along the West line of Lot 18 to the Northwest corner of Lot 18; <br />thence East along the North line of Lot 18 to the Northeast corner of Lot <br />18, thence Southeasterly to the point of beginning; and <br />That part of Lot 18, Block 1, La Buena Vista bounded by a line described <br />as follows: Beginning at a point on the Northeasterly line of Lot 18, a <br />distance of 72.0 feet Southeasterly from the Northeast corner of Lot 18; <br />thence Southwesterly 160.0 feet at an angle of 80 degrees 50 minutes 19 <br />seconds with said Northeast line, as measured from Southeast to Southwest; <br />thence Southeasterly to the most Southerly corner of Lot 18; thence North- <br />easterly along the Southeasterly line of said Lot 18 to the most Easterly <br />corner of said Lot 18; thence Northwesterly to the point of beginning; and <br />WHEREAS, it has been determined that compliance with the Subdivision and Zoning <br />Regulations of the Village of Edina will create an unnecessary hardship and said <br />Parcels as separate tracts of land do not interfere with the purposes of the Sub- <br />division and Zoning Regulations as contabed in the Village of Edina Ordinance <br />Nos. 811 and 801; <br />NOW, TREREFORE, it is hereby resolved by the Village Council of the Village of <br />Edina that the conveyance and ownership of said Parcels as separate tracts of <br />land is hereby approved and the requirements and provisions of Ordinance No. 811 <br />and Ordinance No, 801 thereof as separate tracts of land but/are not waived for <br />any other purpose or as to any other provision thereof, and subject, however, to <br />the provision that no further subdivision be made of said Parcels unless made in <br />compliance with the pertinent brdinances of the Village of Edina or with the <br />prior approval of this Council as may be provided for by those ordinances, <br />Councilman'eourtney's motion for adoption of the resolution was seconded by <br />Councilman Shaw and on roll call, there were three ayes and no nays and the. <br />resolution was adopted. <br />Pastor Eisefe, Pastor of the Calvary Lutheran Church as of 6/16/72, <br />Mr. Courtney offered the follow- <br />. <br />PARNELL AVENUE OIL PETITION ACCEPTED.
