6 /2 2/59 <br />P4INUTES OF THE REGULAR MEETING OF THE EDINA <br />VILLAGE COUNCIL, HELD MONDAY, JUNE 22, 1959, <br />AT 7:OO P.M., AT THE EDINA VILLAGE HALL <br />Members answering Rollcall were Beim, Kohler and Bredesen. <br />MINUTES of the Regular Meeting of June 8, 1959, were approved as eubmitted, by <br />motion Beim, seconded by Bredesen and carried. <br />PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS: Affidavits of Publication in Edina- <br />Morningside Courier, and of mailing to owners of affected properties, of "Notice <br />of Public Hearings" was presented, approved as to form, and ordered placed on <br />file. Pursuant to said Notice, the following public hearings were conducted, and <br />action taken: <br />2. PUBLIC HEARING ON PROPOSED CURB AND GUTTER IN UPPER TERRACE FROM SOUTH- <br />CREST DRIVE TO ERITTANY ROAD. <br />$3,074.40, for $2.82 per Assessable Foot. Written objection of Mr. L.S.Clark, <br />Estimate of Cost for this project was given as <br />6720 Southcrest-Drive; was read. There were no other-written objections, and- <br />no objections were had from the floor. Mr. Clark had asked that the project <br />be limited to those lots requesting it, and Council had some discussion about <br />the utility and aesthetic value of the curb and gutter in only part of a block, <br />it being generally decided that this installation is to be avoided wherever <br />possible. Beim offered the following Resolution and moved its adoption: <br />RESOLUTION DETERMINING ADEQUACY OF IMPROVEMENT <br />PETITION FOR, AND ORDERING STREET IMPROVEMENT <br />NO. B-63 <br />WHEREAS, this Council has duly examined the petition for Concrete Curb and <br />Gutter in Upper Terrace from Southcrest Drive to Brittaoy Road, filed with this <br />Council June 8, 1959, and said examination has proven that said petition has <br />been signed by owners of more than 35 percent in frontage of the real property <br />abutting on the street named in the petition as the location of the improvement: <br />Edina that the petition hereinbefore named has been signed by the required <br />percentage of owners of property affected thereby, under Chapter 429 Minnesota <br />Statutes. <br />BE IT FURTHER RESOLVED that this Council heretofore caused notice of hearing <br />to be duly published on the proposed improvement consisting of construction of <br />CONCRETE CURB AND GUTTER IN UPPER TERRACE FROM SOUTHCREST DRIVE TO BRITTANY ROAD, <br />and at the hearing held at the time and place specified in said notice the Council <br />has duly considered the views of all persons interested, and being fully advised <br />of the pertinent facts does hereby determine to proceed with the construction of <br />said improvement; that said improvement is hereby designated and shall be referred <br />to in all subsequent proceedings as STREET IMPROVEMENT NO.
