7/13/59 <br />MINUTES OF THE REGULAR MEETING OF THE EDINA VILLAGE <br />COUNCfL, HELD NONDAY, JULY 13, 1959, AT 7:OO F.M. <br />AT THE EDINA VILLAGE HALL <br />Members answering Rollcall were Beim, Dickson, Kohler and Tupa. <br />presided in Mayor Bredesen's absence. <br />Mayor Pro Tem Dickson <br />MINUTES of the Regular Meeting of June 22, 1959, were approved as submitted, by motion <br />Beim, seconded by Tupa and carried. <br />PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS: Clerk presented Affidavit of Publication <br />in Edina-Morningside Courier July 2 and 9, 1959, of "Notice of Public Hearings on <br />Proposed Storm Sewer and Grading and Graveling, which affidavits were approved as <br />to form and ordered placed on file. <br />hearings were conducted, and action taken: <br />TERRACE. Otto is in favor of project. <br />Cooper, 5612 Tracy Avenue, protested to being assessed for his share of Lot 7, <br />Warden Acres, claiming that it is of no benefit to him; that the street has been <br />cut considerably, with a straight drop. He claimed that the street is some 14 <br />feet below the top of his abutting hill. hlr. Zikan told 1A.r. cooper that the level <br />of this street will be raised about a foot at Tracy Avenuey and Trustee kohler <br />inquired as to the safety of the intersection, asking that the Efigifieer make <br />sure that the grade is such that Tracy may be easily entered. Mr. Otto's rep- <br />resentative told Council that the developer will have excess material coming <br />out of excavations, which can be used by the Village on the Hawke's Lake streets <br />if the Village wishes it, and Engineer Zikan was authorized to consult with Mr. <br />Otto concerning this offer. <br />the proposed assessment for the E. 380 Ft. of the & of Lot 7, and it was <br />brought to Council's attention that, had it not been for a delay in platting <br />pending Highway Department's disposition of route of Highway No. 169, the <br />developer would have been required to grade and gravel at his own expense. <br />Kohler offered the following Resolution and moved its adoption: <br />Pul'suant to said Notice, the following public <br />1. C-78 <br />BE IT RESOLVED by the Council of the Villaqe of Edina, Minnesota, that this council <br />heretofore caused notices of hearing to be-duly published on the- proposed. improvement <br />of HAWKE'S DRIVE, HAWKE'S TERRACE, AND WARDEN AVETJUE FROM TRACY AVENUE TO 525 FEET <br />WEST by GRRBIG AND GRAVELING, and at the hearing held at the time and place speci- <br />fied in said notice the Council has duly considered the views of all persons <br />interested, and being fully advised of the pertinent facts does hereby determine to <br />proceed with the construction of said improvement; that said improvement is hereby <br />designated and shall be referred to in all subsequent proceedings as STREET IMPROVE- <br />MENT NO. C-78; and the area to be specially assessed therefor shall include all lots <br />and tracts of land within HAWKE'S LAKE ADDITIOH, and LOT 9, WARDEN ACRES, but shall <br />not include the E. 380 Ft. of h9 of Lot 7, WARDEN ACRES. <br />Motion for adoption of the Resolution was seconde <br />were four ayes and no nays, as follows: Beim, <br />Dickson, aye; and the Resolution was adopted. <br />im, and on Rollcall there <br />er, aye; Tupa, aye; and <br />2. Robert Cooper, 5612 Tracy Avenue, objected that there is no real need for <br />a storm sewer; but fdr.
