ROLLCALL was answered by Nembers MacMillan, Tupa, VanValkenburg, and Bredesen; <br />Rixe being absent. <br />MINUTES of the Regular Meetings of December 7 and 21, 1964, January 4, 1965, <br />and the Special Meeting of December 29, 1964, were approved, with the following <br />amendments, by VanValkenburg's motion, seconded'by Tupa and carried: <br />Claim for Boulevard Improvements, December 7, 1964, (page 7 of this <br />Minutes Book). Council was further advised by the VilLage Attorney that the <br />Village could not legally make payment on the claim, <br />Vacation of a Portion of Valley View Road, January 4, 1965, (page 20 <br />of this Minutes Book). VanValkenburg's motion that the vacation Resolution be <br />adopted was conditioned by the requirement that petitioner, Dayton Development <br />Company, reimburse the Village for the cost of the survey presented at the <br />Hearing. <br />this I.iinutes Book). FEBRUARY 1. <br />.Clerk presented Affidavits of Publication of Notice of Hearing in the Edina- <br />Morningside Courier on January 7 and 14, 1964, Affidavit of Posting of said <br />Notice on three Village bulletin boards on January 5, 1965, and Affidavit of <br />Mailing of said Notice to all properties within 500 feet on January 5, 1965. <br />Mr. Hite requested that the Hearing be continued to February 1, 1965, because <br />the Minnesota Department of Health and Hennepin County had not been advised <br />of the proposal, and that the preliminary consent of these offices would be <br />adviseable. No persons were present to be heard on thermatter. <br />moved the continuance of .the Hearing to February 3, 1965, at 7:OO P.M. <br />was seconded by Tupa and carried. <br />VanValkenburg <br />Motion <br />COUNCIL DENIES PETITIOLT-0 REZONE LOTS 10 E 11, BLOCK 1, BERTELSEN ADDITION <br />TO R-4. <br />in the Edina-Morningside Courier on January 7 and 14, 1965, Affidavit of Posting <br />of said notice on three bulletin boards on January 5, 1965, and Affidavit of <br />Mailing of said notice to all property owners within 500 feet on January 7, 1965. <br />Pursuant to-said Notice, public: hearing was held on Minneapolis Builders Supply <br />Company petition to rezone Lots 10 and 11, Block I, Bertelsen Addition, from <br />R-3 Multiple Residence District to R-4 Multiple Residence District. <br />presented a map of the petitioned property and the surrounding area, indicating <br />the zoning pattern established by the Planning Commission. <br />that the petitioned property has been recommended by the Planning Commission <br />to remain zoned R-3 and that the petitian be denied, <br />be heard on the matter. <br />denying the petition. <br />were four ayes and no nays, and the petition was denied. <br />Clerk presented Affidavits of Publication of Notice of Public Hearing - <br />Mr. Hite <br />Mr. Hite reported <br />No persons were present to <br />VanValkenburg moved that the present zoning be retained, <br />Motion was seconded by Madillan, and on Rollcall there <br />COUNCIL APPROVES PRELIJUNARY AND FINAL PLATS. <br />the following plats for approval, as indicated, relaying the favorable recommenda- <br />tions of the Planning Commission on each: <br />Preliminary and Final. Plat; Fjeldheim Addition, five lots, Final Plat; South <br />Office Park I Addition, two lots,*Final Plat; and Southdale Acres I1 Addition, <br />Final Plat. Tupa moved the plats be "approved as recommended by the Planning <br />Commission.
