MINUTES OF THE REGULAR MEETING OF THE <br />EDINA VILLAGE COUNCIL HELD AT VILLAGE .HALL ON <br />MONDAY, MAY 18,,1970 <br />Members answering rollcall were Councilmen Courtney, Johnson, Shaw, VanValkenburg <br />and Mayor Bredesen. <br />MINUTES of May 4, 1970, were approved as corrected,by motion-of Councilman Shaw, <br />seconded by Councilman Johnson,and carried. Councilman Shaw's correction was <br />that the old Library site property would be returned to rather than by the orig- <br />inal owners unless releases are received from property owners by June 1, 1970. <br />PUBLIC HEARING CONDUCTED ON GRADING AND GRAVELING IMPROVEMENT C -102. Mr. Dunn <br />recalled that Grading and Graveling Improvement P -C -102 had originally been <br />brought to hearing on May 19, 1969, and had been continued many times since that <br />date. Affidavits of Notice had been placed on file at,the meeting of May 19, <br />1969. Pursuant to due notice given, public hearing was conducted and action <br />taken as hereinafter recorded. <br />CONSTRUCTION OF.GRADING AND GRAVELING IMPROVEMENT NO. P -C -102 in the following: <br />West 76th Street from France Avenue to Xerxes Avenue <br />Mr. Dunn presented revised total estimated project cost at $59,325.00, proposed <br />to be assessed against 4,824.01 estimated feet at an estimated cost of $12.30 <br />per assessable foot. Mr. Dunn said that details had been worked out whereby <br />property owners would mine their own materials and that, while all agreements <br />00 have not been signed, they are now being considered by the owners. Mr. Ernest <br />2fJ Beckman, 7520 Xerxes Avenue, was told that his property is one of the lots that <br />is considered to be residential and would not, therefore be assessed for the <br />cost of the improvement. No objections being heard, Councilman VanValkenburg <br />offered the following resolution and moved its adoption: <br />RESOLUTION APPROVING GRADING AND GRAVELING IMPROVEMENT NO. C -102 <br />BE IT the Council of the Village of Edina, Minnesota, that this <br />Council heretofore caused notice of hearing to be duly published and mailed to <br />owners of each parcel within the area proposed to be assessed on the following <br />proposed improvement: <br />CONSTRUCTION OF GRADING AND GRAVELING IN THE FOLLOWING: <br />West 76th Street from France Avenue to Xerxes Avenue <br />and at the hearing held at the time and place specified in said notice, the Council <br />has duly considered the views of all persons interested, and being fully advised <br />of the pertinent facts does hereby determine to proceed with the construction of <br />said improvement including all proceedings which may be necessary in eminent <br />domain for the acquisition of necessary easements and rights for construction and <br />maintenance of such improvement; that said improvement is hereby designated and <br />shall be referred to in all subsequent proceedings as GRADING AND GRAVELING <br />IMPROVEMENT NO. C -102; and the area to be specially assessed therefor shall <br />include ' Parcel Nes. 2100, 2800, 3200, 3600,.4800,-5450, 6000, 6400, 6800, 7400, <br />8000, 8800 and 9200, all in Sec. 32, T..28, R. 24. <br />Motion for adoption of the resolution was seconded by Councilman Courtney and <br />on rollcall there were five ayes and no nays and the resolution was adopted. <br />ORDINANCE NO. 261 -201 GRANTED FIRST´┐ŻREADING. Affidavits of Notice were pre- <br />sented by Clerk, approved as to form and ordered placed on file. Pursuant to <br />due notice given,'public hearing was conducted and action taken as hereinafter <br />recorded. Mr. Hoisington recalled that in 1967 these lots were considered for <br />R -2 zoning along with other lots in the area. At that time Planning Commission <br />had recommended approval of R -2 zoning for all of the lots and included in the <br />recommendation that when the lots in between were platted, those also should be <br />double bungalow lots. Planning Commission and the staff have now recommended <br />approval of the rezoning of these lots on McCauley Circle and Mr. Hoisington <br />noted that this zoning would be in keeping with the established Western Edina <br />Plan and that the lots are all larger than required R -2 lots. Following some <br />discussion, Councilman VanValkenburg offered Ordinance No. 261- 201,for First <br />Reading asi'folloas: <br />ORDINANCE NO. 261 -201 <br />AN ORDINANCE AMENDING ORDINANCE NO. 261 <br />(ZONING ORDINANCE) OF THE VILLAGE OF EDINA <br />ESTABLISHING AN ADDITIONAL R -2 <br />MULTIPLE RESIDENCE DISTRICT <br />THE VILLAGE COUNCIL_OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: <br />Section'1. Paragraph.J.. Multiple Residence District Boundaries of Section <br />4 (Multiple Residence District) of Ordinance No. 261 of revised ordinances of <br />the Village of Edina is hereby amended by adding the following sub - paragraph: <br />District R -2: <br />"(52) Lots One (1), Two (2) and Three (3), Block One (1), <br />McCauley Heights;Third Addition <br />Section 2. This ordinance shall be in full force and effect from and <br />after its publication and passage according to law. <br />
