MINUTES OF THE REGULAR <br />EDINA VI-E COUNCIL HELD <br />MEETIhG OF THE <br />AT VILJAGE'HALL ON <br />MObAY , DECEMBER 20, 1971 <br />Members answering rollcall were Councilmen Courtney, Johnson, Shaw, VanValken- <br />burg and Mayor Bredesen. <br />.A <br />STREET IMPROVEMENT NO. BA7189 APPROVED. <br />by Clerk, approved as to form and ordered placed on file. <br />Affidavits of Notice were presented <br />Eursuant to due __ <br />notice given, public hearing was conducted and action taken as hereinafter <br />set forth. <br />CONSTRUCTION OF PERMANENT STREET SURFACING AND CONCRETE -CURB AND GUTTER IN THE <br />Indian Pond Circle . <br />Nr. Hyde presented total estimated construction cost at $5,550.98, proposed <br />to be assessed against 240.68 feet at an estimated cost of $23.06 per assess- <br />able foot. Mr. John Haverly of Haverly Construction Company was assured that <br />the improvement would not be assessed until 1973, with payments to commence in <br />1974. Councilmen Johnson and Shaw stated for the record that the lots should <br />be assessed on a per lot basis, rather than on' a per foot basis as proposed.. <br />Councilman Johnson thereupon offered the following resolution and moved its <br />adoption : <br />I -. BA-189 <br />BE IT RESOLVED by the Council of the Village of Edina, Minnesota, that this <br />Council heretofore caused- notice of hearing to be duly published- and mailed to <br />owners of- each parcel within the area proposed to be assessed on the following <br />proposed improvement : <br />PER"ENT STREET SURFACING AND CONCRETE CURB AND GUTTER IMPROVEMENT BA-189 <br />in 'Indian Pond Circle; <br />and at the hearing held at the time and place specified in said notice, the <br />Council has duly considered the views of all persons interested, and being . <br />' fully' advised of the pertinent facts does hereby determine to proceed with the <br />construction of said improvement, with the understanding that the record show <br />that a per lot assessment is recommended, including all proceedings which may <br />be necessary in eminent domain for the acquisition of necessary easements and <br />rights for construction and maintenance of such improvement; that said improve- <br />ment is hereby designated and shall be referred to in all subsequent proceed- <br />ings as PERMANENT STREET SURFACING AND CONCRETE CURB AND GUTTER IMPROVEMENT NO. <br />BA-189; and the area proposed to be specially assessed therefor shall include <br />Lots 1, 2 and 3, Block 1, Cherokee Hills 7th Addition. <br />Motion for adoption of the resolution was seconded by Councilman Shaw and 0.n <br />rollcall there were five ayes and no nays and the resolution was adopted. <br />I <br />ORDINANCE NO. 811-Al9 GRANTED FIRST:READlNG. Mr. Erfck- <br />son-presented Ordinance No. 811-Al9 which amerds the Zoning Ordinance to change <br />the procedure for determining density in tk Planned Residential District, where- <br />upon Councilman Johnson offered Ordinance No. 811-A19 for First Reading as <br />foiiows : <br />ORDINANCE NO. 811-Al9 <br />AN O~DINANCE AMENDING THE ZONING ORDINANCE <br />(NO. 811) TO CHANGE THE PROCEDURE FOR DETER- <br />MINING DENSITY IN PLANNED RESIDENTIAL DISTRICTS <br />THE VIUAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA. ORDAINS: <br />Section 1.
