1 <br />i <br />MINUTES OF THE: REGULAR MEETING OF THE <br />EDINA VILLAGE COUNCIL HELD AT VILLAGE, HALL ON <br />MONDAY, JANUARY 8, 1973 <br />Members 'answering rollcall were Councilmen Courtney, Johnson, Shaw, and Van . <br />Valkenburg who served as Mayor Pro Tem until the arrival of Mayor Bredesen as <br />indicated in the minutes. <br />OATH OF OFFICE was administered by the Clerk to Councilmen Courtney and Van <br />Valkenburg . <br />RESOLUTION OF CONDOLENCE FOR FAMILY OF EVALD C. BANK. Upon being advised of the <br />death of Nr. Evald C. Bank, Councilman Courtney offered the following resolution <br />and moved its adoption: <br />RESOLUTION . <br />TJHEREAS, the life of Evald C. Bank, a long time resident and public servant <br />of Edina, ended suddenly on December 21, 1972, at the age of sixty-eight; and <br />WHEREAS, during his twenty-seven years as a citizen of Edina, Evald C. Bank <br />did serve his fellow citizens well and productive13 being elected to the <br />office of Village Clerk for a two year term from January 1, 1953, Co January 1, <br />1955, and serving as Trustee on the Edina Village Council from August 13, <br />1956, to'January 1, 1959; and <br />WHEREAS, Evald C. Bank was active with the Rotary Club, serving.as President <br />of Minneapolis Rotary, as District Governor and on the Rotary International <br />Board; and <br />TJHEREAS, Evald C. Bank served as Aquatennial Commodore in 1951; <br />NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Edina <br />tihat, on behalf of all the citizens of Edina, deepest sympathy be expressed <br />to the family of EVALD C. BANK; and <br />BE IT FURTHER RESOLVED that this resolution be spread upon the pages of the <br />Minutes Book of the Edina Village Council and that appropriate copies of this <br />resolution be transmitted to Mrs. Bank, Kent M. Bank and Patricia Bank Bow. <br />Motion for adoption of the resolutiion t7as seconded by Councilman Shaw and on <br />rollcall there were four ayes and no nays and the resolution was adopted, <br />MAYOR PRO TEM APPOINTED. <br />man Shaw and carried appointing Councilman Van Valkenburg Mayor Pro Tem for <br />the year 1973, which action was confirmed after the Mayor's arrival. <br />LOT 9, BLOCK 1, SOUTH HARRIET PARK 2ND ADDITION LOT DIVISION #PROVED. Affida- <br />vits of Notice were presented by Clerk, approved as to form and ordered placed <br />on file. Mr. Luce presented the petition for division of Lot 9, Block 1, <br />South Harriet Park 2nd Addition to permit sale of a portion of the lot to Edina <br />Baptist Church for use as a parking lot. A gentleman who resided at 5213 <br />Halifax Ave., was told that there was no reason to believe that such a division <br />would have an adverse effect on the value of surrounding property. <br />advised that the parking lot would havebth ingress and egress from France Ave. <br />No further discussion being heard, Councilman Shaw offered the following resolu- <br />tion as recommended by the Planning Commission and moved its adoption: <br />RE SOLUTION <br />WHEREAS, the following described property is at present a single tract of <br />land : <br />WHEREAS, the owner has requested the subdivision of the said tract-into separate <br />parcels described as follows: . <br />Motion of Councilman Johnson was seconded by Council- <br />Mr. Luce <br />Lot 9, Block 1, South Harriet Park 2nd Addition; and <br />The Easterly 150 feet of Lot 9, Block 1, South Harriet Park 2nd Addition; , <br />and <br />Lot 9, Block 1, South Harriet Park 2nd Addition, except the Easterly 150 <br />feet of said lot; and <br />I.JHEREAS, it has been determined that compliance with the Subdivision and Zoning <br />Regulations of the Village of Edina will create an unnecessary hardship and <br />said Parcels as separate tracts of land do not interfere with the purposes of <br />the Subdivision and Zoning Regulations as contained in the Village of Edina <br />Ordinance Nos. 801 and 811; <br />NOV, THEREFORE, it is hereby resolved by the Village Council of the Village of <br />Edina that the conveyance and ownership of said Parcels as separate tracts of <br />land is hereby approved and the requirements and provisions of Ordinance No. 801 <br />and Ordinance No. 811 are hereby waived to allow said division and conveyance <br />thereof as separate tracts of land but are not waived for any other purpose or <br />as to any other provision thereof, and subject, however, to the provision that <br />no further subdivision be made of said garcels unless made in compliance with <br />the pertinent ordinances of the Village of Edina or with the prior approval <br />of this Council as may be provided for by those ordinances. <br />$lotion for adoption of the resolution was seconded by Councilman Courtney and
