1 <br />MINUTES OF THE REGULAR MEETING OF THE <br />EDINA CITY COUNCIL HELD AT CITY HALL ON <br />MONDAY, DECEIBER 2, 1974. <br />Answering rollcall were members Courtney, Johnson, Schmidt and Mayor Van <br />Valkenburg . <br />MINUTES of October 21 and November 4, 1974, were approved by mot2on of Council- <br />man Courtney, seconded by Councilman Johnson and carried. <br />RICHARD C, JOHNSON COMMENDED FOR SERVICE ON COUNCIL. <br />presented the first City of Edina Commendation Award ever issued and read the <br />following comendation to Councilman Johnson: <br />COMMENDATION <br />RICHARD C. JOHNSON ' <br />Mayor Van Valkenburg <br />ON BEHALF OF THE CITY OF EDINA, we commend you for your nine years of service <br />on the Edina City Council. <br />You were important and instrumental in the organization of the Human Relations <br />Commission, the Environmental Quality Commission, the Governmental Commission <br />and the Transit Commission. <br />You have shown a dedication to principle, a willingness to work diligently for <br />Edina and have been an articulate spokesman for Edina. <br />17e thank you, we congratulate you and we wish you the best. <br />ORDINANCE NO. 811-A60 ADOPTED. <br />approved as to form and ordered placed on file. <br />Ordinance No. 811-A60 for First Reading as had been discussed at the meeting <br />of October 21, 1974. Councilman Johnson thereupon dfered Ordinance No. 811-A60 <br />for First Reading, with waiver of Second Reading, and moved its adoption as <br />folloF?s : <br />Affidavits of Notice were presented by Clerk, <br />Mayor Van Valkenburg presented <br />ORDINANCE NO. 811-A60 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE (NO. 811) <br />BY ADDING TEMPORARY RETAIL SALES AS A PERMITTED USE I IN THE PLANNED INDUSTRIAL DISTRICT <br />THE: CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS: <br />.* <br />, Section 1. Paragraph 3 of Section 10 (Planned Industrial District) of \ Ordinance No. 811 is hereby amended by adding a new subparagraph (c), as fol~ovls: <br />(c) Temporary Retail Sales. <br />1. <br />1 (1) A permit may be granted by the City Manager, or his delegate, <br />upon application of lessees or owners of premises' within a Planned Industrial. <br />District for temporary and limited retail and public sales of products ware- <br />housed or manufactured on said premises. <br />Not more than two permits may be issued to any one person, firm, <br />affiliate, or subsidiary in a calendar year, and there must be at least sixty <br />\ (2) <br />. (60) days between permit sale dates. <br />(3) <br />(4) <br />No permit shall be for a period of more than three (3) days. <br />Bn application must be filed with the CiCy Clerk not less than c <br />forty-five (45) days prior to the first sale date for which the permit is <br />requested,myst be joined in by the owner if made by a lessee, and shall be <br />accompanied by a fee of $300, which shall not be refundable if such permit is <br />refused. <br />$200 per permit. <br />Factors to be considered by the City Manager, or his delegate, <br />before granting such a permit shall be as follows: <br />a. Effect on normal automobile and truck traffic in the District; <br />b. Whether an abnormal demand will be created for off-street <br />parking ; <br />c. Whether the premises have adequate fire protection and <br />access and egress for the public during such sale; <br />d. Other pending or issued permits for the specific time <br />requested. <br />e. Methods of handling traffic, safety and litter; <br />f. Prior sales conducted by said applicant and methods proposed <br />to alleviate problems created during said prior sale, if any; <br />g. Percentage of space occupied that will be used for said sale; <br />h, Methods of advertising and area appealed to, to the end that <br />large numbers of people will not be expected; <br />i. Reports, of Police and Fire Departments as to suitability of <br />premises and the need €or public safety personnel. <br />The fee for subsequent permits, after an original approval, shall be <br />(5) <br />, <br />- (6) No goods may be shipped to the premises especially for said sale. <br />It is the intention to permit persons qualifying as above to have limited sales <br />without the expense of reshipping to another selling point, but not to create <br />general retail sales in this District.
