IUNUTES <br />OF SPECIAL COUNCIL MEETING <br />OF EDINA CITY COUNCIL HELD AT CITY HALL <br />DECEMBER 29, 1980 <br />4:OO P.M. t <br />Pursuant to due notice given, the Edina City Council met in special session in <br />the Edina City Hall Conference Room-on December 29, 1980, at 4:OO p.m. <br />Members answering rollcall were Bredesen , Courtney , Schmidt and Van Valkenburg, <br />with Richards arriving at 4:20 p.m., following the Cable TV Hearing. <br />dig) 0 <br />a a <br />MINUTES of December 15, 1980, were approved as submitted bu motion of Councilman <br />Courtney, seconded by Councilwoman Schmidt. <br />Ayes: Bredesen, Courtney, Schmidt, Van Valkenburg <br />Nays: None <br />Motion carried. <br />CABLE TV ORDINANCE NO. 1120 GRANTED SECOND READING. Councilman Court- <br />ney further moved that the Mayor and Manager be authorized, for and on behalf of <br />the City, to sign and deliver the franchise, and all other documents to be . <br />signed and delivered by the City in connection with the Franchise. <br />8nce being as follows: <br />Mr. James Erickson of Northern Cablevision recalled <br />Mr. Gandreau also spoke of Minnesota Cablesystems' ability <br />Mr. Rosland pointed out that City Attorney Erickson <br />He added that the City Engineers have <br />Said ordin- <br />ORDINANCE NO. 1120 <br />AN ORDINANCE, INCLUDING ADDENDUM WITH EXHIBITS, GRAHTING ' <br />MINNESOTA LIMITED PARTNERSHIP, TO OPEUTE AND YAINTAIN A CABLE <br />A FRANCHISE TO MINNESOTA CABLESYSTEMS-SOUTHST , A <br />COMMUNICATION SYSTEM IN THE CITY; SETTING FORTH CONDITIONS <br />REGULATION, AND USE OF THE SYSTEM; AND PRESCRIBING PENALTIES <br />ACCOXPANYING TH3 GRANT OF FRANCHISE; PROVIDING FOR <br />FOR THE VIOLATION OF ITS PRO'JISIONS <br />The City Council of the City of Edina ordains: <br />STATEMENT OF INTENT AND PJJRPOSE <br />The City intends, by the adoption of this Franchise, to bring about the' <br />development of a System, and the continued operation of it. Such a developmeot <br />can contribute significantly to the communication needs and desires of many. <br />Further, the City may achieve better utilization and improvement of public servi- <br />ces with the development and operation of a Cable Communications System. <br />Past studies, participated in by City, have led the way for organizing a <br />means of procuring and securing a Cable Communications System deemed best suited <br />to the City, in the judgment of the Council. This has resulted in the preparation <br />and adoption of this Franchise. <br />FINDINGS <br />In the review of Grantee's proposal and application an6 as a result of public <br />hearings, the City Council makes the following findings: <br />A. The Grantee's technical ability, financial condition, legal qualifications, <br />and character were considered and approved in a full public proceeding after <br />due notice and reas6nable opportunity to be heard; <br />B. Grantee's plans for constructing and operating the System- were 'considered and <br />found adequate and feasible Tn a full public proceeding after due notice znd <br />reasonable opportuni.ty to be heard;
