Mr. Hughes <br />presented Lot 10, Block 7, Braemar Hills 9th Addition for division along the <br />party wall of the existing building, but noted the problem in which one of the <br />dwelling units will have a very small rear yard area after the lot division be- <br />cause of the location of the swimming pool. <br />has agreed to relocate the division line to abut the most Northwesterly edge <br />of the pool inasmuch as he does not wish to subdivide the pool itself. Mr. <br />Hughes advised that the proponent has agreed to place cross easements and <br />maintenance agreements of record which will allow joint use of the rear yard by <br />both tenants. No objections being heard, Member Bredesen offered the following <br />resolution and moved its adoption, subject to the condition that cross easements <br />and the maintenance agreement be placed of record and be subject to Council <br />approval prior to their future modification or release. <br />RESOLUTION <br />WHEREAS, the following described property is at present a single tract of land: <br />IJHEKEAS, the owners have requested the subdivision of said tract into separate <br />parcels (herein called "Parcels") described as follows : <br />The Mayor offered his congra- <br />He advised that the proponent <br />Lot 10, Block 7, Braemar Hills 9th Addition; and <br />That part of Lot 10, Block 7, Braemar I-Iills 9th Addition, according to <br />che recorded plat thereof, Hennepin County, Minnesota, which lies <br />Northerly and Northwesterly of the following described line: Commenc- <br />ling at tire most Northerly corner of said Lot 10; thence South 20 degrees <br />43 minutes 12 seconds West, on an assumed bearing along the <br />Northwesterly line of said Lot 10, a distance of 93.46 feet to the point <br />of beginning of the line to be described; thence South 71 degrees 35 <br />minutes 11 seconds East, a distance of 36.51 feet; thence North 55 <br />' degrees 41 minutes 26 seconds East, a distance of 6.00 feet; thence North <br />18 degrees 24 minutes 49 seconds East a distance of 30.00 feet; thence <br />North 62 degrees 57 minutes 49 seconds East, a distance of 52.23 feet to <br />a point on the Northeasterly line of said Lot 10, distant 76.84 feet <br />Southeasterly of (as measured along said Northeasterly line) the most <br />Northerly comer of said Lot 10, and there terminating; and <br />That part of Lot 10, Block 7, Braemar Hills 9th Addition, according <br />to the recorded plat thereof, Hennepin County, Minnesota, which lies <br />Southerly and Southeasterly of the'following described line: <br />Commencing at the most Northerly corner of said Lot 10; thence South 20 <br />degrees 43 minutes 12 seconds FJest, on an assumed bearing <br />along the Northwesterly line of said Lot 10, a distance of 93.46 feet to <br />the point of beginning of thg line to be described; thence South 71 <br />degrees 35 minutes 11 seconds East, a distance of 36.51 feet; thence <br />North 55 degrees 41 minutes 26 seconds East a distance of 6.00 feet; <br />thence North 18 degrees 24 minutes 49 seconds East, a distance of <br />30.00 feet; thence North 62 degrees 57 minutes 49 seconds East a distance <br />of 52.23 feet to a point on the Northeasterly line of said Lot 10, <br />distant 76.84 feet Southeasterly of (as measured along said Northeasterly <br />line) the most Northerly comer of said Lot 10 and there terminating; and <br />WHEREAS, the requested subdivision is authorized under Ordinance No. 801 and <br />it has been determined that compliance with the Subdivision and Zoning Regu- <br />lations of the City of Edina will create an unnecessary hardship and said <br />Parcels as separate tracts of land do not interfere with the purpose of the <br />Subdivision and Zoning Regulations as contained in the City of Edina Ordi- <br />nance Nos. 801 and 811; <br />NOW, THEREFORE, BE 'IT RESOLVED by the City Council of the City of Edina that <br />the conveyance and ownership of .the second above described Parcels as separate <br />tracts of land is hereby approved and the requirements and provisions of <br />Ordinance Nos. 801 and 811 are hereby waived to allow said division and con- <br />veyance thereof as separate tracts of land, but only to the extent permitted <br />under Ordinance No. 801 and Ordinance No. 811 and subject to the limitations <br />set out in Ordinance No. 811 and said Ordinances are not waived for any other <br />-1.
