-.- 12 <br />MINUTES <br />OF THE REGULAR MEETING OF THE <br />EDINA CITY COUNCIL HELD AT CITY HALL <br />OCTOBER 15, 1984 <br />Answering rollcall were Members Bredesen, Schmidt, Turner, and'Mayor Courtney. <br />PROCLAMATION READ FOR THE EDINA LEAGUE OF 'NOMEN VOTERS. <br />declaring the week of October 22 through October 29 as League of Women Voters of Edina <br />Week. Betty Sailor, President of the League, accepted the Proclamation. <br />EMPLOYEE RECOGNIZED. Ken Rosland introduced Dr. Pat Lilja, who has worked with Edina' <br />Public Safety Department in starting the Paramedic Program and has served as the City's <br />Medical Director. <br />accepted for Dr. Lilja last spring at the Volunteer Awards Banquet. <br />M9yor Courtney read a proclamation <br />Bob Buresh awarded Dr. Lilja the Humanitarian Award which he had <br />PLAN AMENDMENT APPROVED FOR VERNON HILLS CONDOMINIUMS, JOHNSON BUILDING COEIPANY. <br />Affidavits of Notice were presented by the Acting City Clerk, approved as to form and <br />ordered placed on file. Mr. Hughes presented the Staff report from the September <br />26, 1984, Community Development and Planning Commission pertaining to 2-83-7, Johnson <br />Building Company; S-83-12, Vernon Hills Condominiums; and PRD-4, Plan Amendment. The <br />particular location is the Biltmore Site, west of Vernon Avenue and south of West 52nd <br />Street. Staff believes that every effort should be taken to redevelop this site for <br />residential purposes; unfortunately, the original proposal did not meet the test of fhe <br />marketplace. Theref ore, the proposed amendment represents a reasonable alternative <br />to the original project: increasing the number of units, decreasing the size of the <br />units, decreasing the enclosed parking ratio, replacing the soloria with screened <br />porches, replacing the flat roof with a hip roof, and replacing the brick and stucco <br />exterior with wood shingle siding. <br />containing the following items: <br />such that the first phase could stand alone; A demolition permit must be issued for <br />the motel building prior to the issuance of a building permit Phase 1; No final in- <br />spection of the condominium building shall be undertaken until the motel is completely <br />demolished; Only one curb cut on Vernon Avenue will be allowed for both phases. <br />Commission and Council should also approve the setback variance for the screened <br />porches. Member Turner questioned the depth of the porches, and the builder, Mr. <br />Johnson, explained that the porches would extend three feet from the building. <br />Member Schmidt asked if neighbors would in any way be affected with this construction,, <br />and Mr. Johnson said that there would be no hindrance to any neighbors. <br />concern was based on the trees near the lot line and if they would be affected by <br />the construction. Mr. <br />Affidavits of Notice were presented <br />- <br />Hoffman explained the petition received regarding vacating a portion of right-of-way <br />of West 50th Street, which involves a trade of seven feet for three feet on France <br />Avenue. Mr. - Erickson felt that the three feet acquired by the City in this instance <br />is appropriate. Member Bredesen introduced the following resolution and moved its <br />adoption: <br />RESOLUTION VACATING PORTION OF RIGHT-OF-VAY <br />OF WEST 50TH STREET <br />WHEREAS, a resolution of the City Council, adopted the 10th day of September, 1984, <br />fixed a date for a public hearing on a proposed vacation of portion of right-of-way <br />of West 50th Street; and <br />WHEREAS,,two week's published and posted notice of said hearing was given and the <br />hearing was held on the 15th day of October, 1984, at which time all persons desiring <br />to be heard were given an opportunity to be heard thereon; and <br />WHEREAS, the Council deems it to be in the best interest of the City and of the public <br />that said street vacation-be made; and <br />WHEREAS, the Council has considered the extent to which the vacation affects existing <br />the authority of any person, corporation, or municipality owning or controlling electric <br />or telephone poles and lines, gas and sewer lines, or water pipes, mains, and hydrants <br />on or under the area of the proposed vacatibn, to contiKue maintaining the same, or to <br />enter upon such street or portion thereof vacated to maintain, repair, replace, remove, <br />or otherwise attend thereto. <br />NOW, THEREFORE, BE IT =SOLVED by the City Council of the City of Edina, Hennepin <br />County, Minnesota, that the following described portion of West 50th Street be and <br />is hereby vacated effective as of October 30, 1984. <br />That portion of West 50th Street described as follows: <br />"The West 97 feet of the East 130 feet of the South 7 feet of the North 40 feet <br />of the Southeast Quarter of Section 18, Township 28, Range 24." <br />easements within the area of the vacation and the extent to which the vacation affects i
