<br />Engineer Fran Hoffman recalled that the Council at its meeting of May 21, 1984,
<br />approved Improvement No. BA-262 for construction of permanent street surfacing,
<br />concrete curb and gutter and sidewalk on W. 44th Street from Brookside Avenue to
<br />T.H. 100 and bridge replacement over Minnehaha Creek, subject to receipt of all
<br />approvals necessary from the Minnesota aepartment of Transportation, Minnehaha
<br />Creek Watershed District and the Department of Natural Resources and Corps of
<br />subject to reconfirmation of the Council.

<br />BE IT RESOLVED by the Council of the City of Edina, Minnesota that this Council
<br />heretofore caused.notice of hearing to be duly published and mailed to owners of
<br />each parcel within the area proposed to be assessed on the following proposed
<br />1. CONSTRUCTION OF PERMANENT STJEET SURFACING WITH CONCRETE CURB AND GUTTER,
<br />SIDEWALK AND BRIDGE REPLACEMENT IMPROVEMENT NO. BA-262 IN THE FOLLOWING:

<br />RESOLUTION RECONFIRMING IMPROVEMENT NO. BA-262

<br />has duly considered the views of all persons interested, and being fully advised
<br />of the pertinent facts, does hereby determine to proceed with the construction of
<br />said improvement as described in the published notices of said hearing, including
<br />all proceedings which may be necessary in eminent domain for the acquisition of
<br />necessary easements and rights for construction and maintenance of such improve-
<br />ment; that said improvement is hereby designated and shall be referred to in all
<br />subsequent proceedings as PERMANENT STREET SURFACING WITH CONCRETE CURB AND GUTTER,
<br />SIDEWALK AND BRIDGE REPLACEMENT IMPROVEMENT NO. BA-262 and the area to be specially
<br />assessed for a portion of the cost of the proposed improvement shall include
<br />Lots 1 and 2, Block 3, Arden Park 3rd Add'n.; Lots 1, 2 and 3, Block 4, Arden
<br />Park 3rd Add'n.; Lots 7, 8 and 17, Aud. Sub'd. No. 176; and Lots 10 and 11,
<br />Thielen's Brookside Add'n.
