MINUTES \ OF THE REGULAR MEETING OF THE <br />EDINA CITY COUNCIL HELD AT CITY HALL <br />JANUARY 27, 1986 <br />73 <br />Answering rollcall were Members Kelly, Turner and Mayor Courtney, <br />MEMBER RICHARDS APPOINTED MAYOR PRO TEM. As recommended by Mayor Courtney, Member <br />Turner's motion was seconded by Member Kelly appointing Member Frederick S. <br />Richards as Mayor Pro Tem for the year 1986. . <br />Ayes: Kelly, Turner, Courtney <br />Motion carried. <br />RESOLUTION OF CONDOLENCE ADOPTED - DONALD L. KEARNS. <br />lution of condolence on the death of Donald L. Kearns which was unanimously adopted <br />by motion of Member Kelly, seconded by Member Turner: <br />RESOLUTION OF CONDOLENCE <br />WHEREAS, the life of Donald L. Kearns, a former Edina resident and public servant, <br />ended on January 19, 1986 after months of illness, and <br />WHEREAS, Donald L. Kearns held the position of Assessor for the City of Edina <br />from March 1, 1958 to March 31, 1970, and <br />WHEREAS, as Assessor he exemplified highest assessing procedures for the City, and <br />WHEREAS, Donald L. Kearns was instrumental in obtaining the property for Van <br />Valkenburg Park; <br />NOW, THEREFORE, BE IT RESOLVED that the Edina City Council hereby extends its <br />heartfelt sympathy to his wife Carol, and to his children and their families; <br />BE IT FURTHER RESOLVED that this Resolution be entered in the Minutes Book of the <br />Edina City Council and that a copy be presented to his family. <br />ADOPTED this 27th day of January, 1986. <br />Mayor Courtney read a reso- <br />MINUTES of the Regular Meeting of December 16, 1985 and January 6, 1986, and Year- <br />End Meeting of December 30, 1985 were approved as submitted by motion of Member <br />Kelly, seconded by Member Turner. <br />Ayes: Kelly, Turner, Courtney <br />Motion carried. <br />LOT DIVISION APPROVED FOR LOT 2, BLOCK 1, DECKAS ADDITION (6008-6012 BERNE CIRCLE). <br />Planner Craig Larsen informed the Council that the proponent, Roy Lauring, is <br />requesting a party wall division of an existing double bungalow. <br />connections are provided.and staff would recommend approval. No objections being <br />heard, Member Turner introduced the following resolution and moved its adoption: <br />WHEREAS, the following described property is at present a single tract of land: <br />WHEREAS, the owners have requested the subdivision of said tract into separate <br />parcels (herein called "Parcels") described as follows: <br />Separate utility <br />RESOLUTION <br />Lot 2, Block 1, DECKAS ADDITION; <br />That part of Lot 2, Block 1, DECKAS ADDITION, according to the recorded <br />plat thereof, Hennepin County, Minnesota lying easterly of a line <br />described as beginning at a point on the southerly line of said Lot 2, <br />Block 1 distant 53.39 feet westerly, along said southerly line, from <br />the Southeast corner of said Lot 2, Block 1; thence northerly to a <br />point on the northerly line of said Lot 2, Block 1, distant 62.64 feet <br />westerly, along said northerly line, from the Northeast corner of said <br />Lot 2, Block 1 and there terminating; and <br />That part of Lot 2, Block 1, DECKAS ADDITION, according to the recorded <br />plat thereof, Hennepin County, Minnesota lying westerly of a line <br />described as beginning at a point on the southerly line of said Lot 2, <br />Block 1 distant 53.39 feet westerly, along said southerly 1ine;from <br />the Southeast corner of said Lot 2, Block 1; thence northerly to a <br />point on the northerly line of said Lot 2, Block 1, distant 62.64 feet <br />westerly, along said northerly line, from the Northeast corner of said <br />Lot 2, Block 1 and there tg-nninating. <br />WHEREAS, it has been determined that compliance with the Subdivision and Zoning <br />Regulations of the City of Edina will create.an unnecessary hardship and said <br />Parcels as separate tracts of land do not interfere with the purposes of the <br />Subdivision and Zoning Regulations as contained in the City of Edina Ordinance <br />Nos. 801 and 825; <br />NOW, THEREFORE, it is hereby resolved by the City Council of the City of Edina <br />that the conveyance and ownership of said Parcels as separate tracts of land <br />is hereby approved and the requirements and provisions of Ordinance No. 801 <br />and Ordinance No. 825 are hereby waived to allow said division and conveyance <br />thereof as separate tracts of land but are not waived for any other purpose or <br />as to any other provision thereof, and subject, however, to the provisions that <br />no further subdivision be made of said Parcels unless made in compliance with <br />the pertinent ordinances of the City of Edina or with the prior approval of <br />this Council as may be provided for by those ordinances.
