MINUTES <br />OF TBE CLOSED COUNCIL MeETMG <br />AUGUST 21, 1989 <br />1 HELD AT EDINA CITY <br />A closed Council Meeting was held on August 21, 1989 at 5:30 p.m. for the purpose <br />of discussing potential litigation concerning issuance of a building permit for <br />Lot 9, White Oaks Second Addition and Lot 1, White Oaks Third Addition. <br />In attendance were Member's Kelly, Paulus, Rice, Smith and Mayor Richards. Staff <br />members present were Manager Rosland, Assistant Manager Hughes, Engineer Hoffman, <br />Attorney Erickson and Clerk Daehn. <br />Attorney Erickson reported that he and Assistant Manager Hughes had met with <br />Connor Schmid and Ed Clausman of the White Oaks neighborhood and Richard Andron of <br />Andron, Inc. concerning the subject lots, at the request of Mr. Andron. They <br />discussed a proposal whereby the City would purchase the subject lots from <br />Mr. Andron with a cash payment and the acceptance by the City of a gift of value <br />of an additional amount. <br />Attorney Erickson explained the position of the City if this matter were to <br />resolved by the courts. <br />process involved and potential costs if the matter proceeded to litigation. <br />The Council Members discussed the proposal and also the <br />Motion was made by Member Smith directing Assistant Manager Hughes and Attorney <br />Erickson to continue to negotiate with Hr. Andron on purchase of the subject lots, <br />with the understanding that any cash payment for purchase of the subject lots <br />would be predicated upon the City receiving donations from the White Oaks <br />neighbors equal to one-half the amount of the cash payment by no later than <br />September 18, 1989. Motion was seconded by Member Paulus. <br />Ayes: Kelly, Paulus, Rice, Smith, Richards <br />Motion carried. <br />No other business was discussed by the Council Members. <br />6:OO p.m. <br />Meeting was adjourned at <br />13 <br />74d%.U . <br />City Clerk
