in as nearly as possible the same condition as before such excavation.
The duration of this easement shall be perpetual.
The parties of the first part hereby covenant and warrant that they
have good title to said real estate and that. tt.ey will warrant and
defend the said easement and the enjoyment in use thereof to the party of
the second part, and the parties of the first part make that warranty for
themselves, their heirs and assigns forever.

by and between Carl G. Swendseen and Helen Swendseen, husband and wife;,
of the County of Hennepin and State of Minnesota, parties of the first
part., and the Village of Edina, a municipal corporation of the County
of Hennepin and State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consider-
ation of One and no /100 (1.00) Dollars, to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Great, Bargain, Sell, and Convey to said parties of the second part
�an Easement for th.e purposes hereinafter set forth, in and over the
following described property situated i`n the Village of Edina, County
of Hennepin and State of Itinnesota, to -wits
A. .The Southerly ten feet (101) front and rear of
of Lot 119 Block 14, Country Club District
Brown Section, according to plat thereof on
file and -of record in the (office of the
Register of Reeds in and for said Hennepin
County; the easement over which is to be for
the purpose of maintaining a storm sewer drain
therein.
B. That part of Lots 11 and 191, Block 14, Country
Club District Brown Section, according to plat
thereof. on file and of record in the office of
the Register of Deeds in and for said Hennepin
County, described as follows, to -wits A strip
of land ten feet (101) wide and extending five
feet (51) on either, side of a line commencing
at a point in the Northerly line of said Lot 19,
which point is one hundred twenty feet (120:)
Nest of the Northeast corner of said Lot 19;
thence running in a Southerly direction to a:
point in the South line of said Lot 11 which
point is one hundred twenty feet (12011 'hest Q %- - --
the Southeast earner of said Lot 11, measured
along said Southerl�r line; the easement over
which is to be for the purpose of maintaining
a. sanitary- sewer. therein.
It is the intention and agreement of the Parties hereto that in
the maintenance of said sewers as above described the partyr.-� of the
second part shall, in the maintenance and repair of said sewers,end
in case of excavation for such maintenance and repair, replace the
