WITNESSETH:
That the said parties of the first part, in consideration of
the sum of One Dollar ($1.00) and other good and valuable consideration,
to them in hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged., do hereby Grant, Bargain, quitclaim and
;onvey unto the said party of the second part, its successors and assign
a perpetual easement for the purpose of installing and constructing a
grater main over, across and under that certain Tract of land lying and
being in the County of Hennepin and State of Minnesota, described as fol
logs, to -wit
he South Fifteen feet (151) of the North One Hundred
fifty -one and twenty -nine hundredths feet (151.291) of
Lot Fifty -two (52), Auditor's Subdivision No, 176, j`
according to the map or plat thereof on file and 6f
record in the office of the Register of Deeds in and
for said Hennepin County, Minnesota,
said easement to be of the necessary depth for the construction, instal',
tion, operation, maintenance and repair of a water main in, under and u]
the above,deporibed Fifteen foot (151) strip, together with a right to
reasonable access over and across said premises to inspect said water a
and to repair maintain or reconstruct the same.

T is conveyance is given subject to the condition that the
mainder of the property owned by the grantors herein in Lot Fifty -taro
Auditor's Subdivision No. 1761 shall not be assessed for the water main
- -a 4-u- iia-ra3M ahall gave the right to make
above, part of the cost of constructing the -rater main may be collected
from the grantors as a connection charge.
TO HAVE AND TO HOLD THE SAME, Together with all the hereditar-
ments and appurtenanoes thereunto belonging or in anywise appertaining to
the said party of the second part, its successors and assigns, Forever.

of Edina, a municipal corporation of the Count of Hennepin and State

necessary depth for the construction, installation, operation,
maintenance and repair of a sewer, in, under, over and upon the

Commencing at a point on the East line of Lot 52 Auditcra Sub
Division Number 176, which is distant 512,3/10 ft .North 'or the
Southeast corner of said lot; thence West parallel with the-South line
of said Lot ' 52 a distance of 110 feet, more or less, to the Easterly
rie,ht of way line of State Highway No. 169
It is understood that the said sewer will, be constructed - and thereafter
maintained as nearly as may be in the location upon ' said = pre mises
established or to be established by the engineer in charge of -the
co ns tructi cn of said sewer,

THIS INSTRUVENT, dated this 4th day of June' ; ; , 1943:0
WITNESSETH:
THAT WHEREAS* It the undersigned, Yarie Scott, have
heretofore granted to the Village of Edina, an easement and right
of way to construct a sanitary sewer over and across my property
hereinafter described in the Village of Edina, and the Village of-
Edina, in connection therewith, undertook to restore my said property
to its usual and ordinary condition after the installation of said
sewer but was unable wholly to restore the same;
NOW, THEREFORE, in consideration of the sum of Two -
hundred Dollars ($200.00), in hand paid to me by the Village of
Edina, Hennepin County, Minnesota, I, the undersigned, Marie
Scott, release, acquit and forever discharge the said Village of
Edina from all claims, demands, liabilities or causes of action
of every kind and nature whatsoever now existing in my favor or
hereafter to accrue and against the said Village of Edina, and
including specifically, but not exclusively, all claims, demands
and liabilities for damages to my property hereinafter described,
in any way growing out of or connected with the facts hereinabove
referred to. My property hereinbefore referred to is - Lot 52,
Auditors Sub- division 176, County of Hennpin and S a of Minnesota.
