THIS INSTRUMENT, Made this 8th day of February , 19 63 , by
and between ROBERT E. OSTM AN AND GLADYS F. OSTMAN, HUSBAND AND WIFE
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, ,yell, Convey and Warrant to said party of the second part "an Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit:
Commencing on the East line of the SW I of the NW a of Section 31, Township 117,
Range 21, a distance of one thousand five hundred thirty -one and forty -six
hundredths (1531.46) feet South from the NE corner of the NW I of the NW I of
said Section 31; thence Westerly a distance of five hundred (500) feet to a
point on a line which if extended Westerly would intersect the West line of
said SW of the NW Al a distance of one thousand five hundred forty -seven and
fifty -one hundredths (1547,51) feet South of the NW corner of the NW 4 of the
NFJ of said Section 31; said point being the point of beginning of the center
line of a twenty (20) foot sanitary sewer easement; thence Southeasterly to a
point on a line which if extended Westerly would intersect the West line of
Section 31 a distance of one thousand eight hundred forty -seven and two hundredths
(1847.02) feet South of the NW corner thereof, and if extended Easterly would
intersect the East line of the SW 1 of the NW I of said Section 31 a distance
of one thousand eight hundred thirty and ninety -seven hundredths (1830.97) feet
South of the NE corner of the N9 l of the NW I of said Section 31, said point
being four hundred eighty (480) feet West of the East line of the said SW g of
the NW 1, and there terminating.
Together with temporary construction easements, twenty (20) feet in width on
both sides of and parallel to the above described twenty (20) foot sanitary
sewer ease_uent, said temporary easements shall cease and terminate on January
1, 1964-
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
