and over a portion of the land above described owned by party of the
second part which area for the desired easement is described as follows:
A strip of land ten (10) feet in width over and 'across
Lots 12 and 13, Block 4, "Brookline let Addition" Edina,
Minnesota, according to the map or plat thereof on file or of
record in the office of the Registrar of Titles in and for the
County of Hennepin and State of Minnesota, together with
that portion of the vacated alley adjacent to said lots,
the center line of which is described as follows:
Beginning at a point seven (7) feet South of-the point
of intersection of the North line of Lot 12 extended
, t with the center line of said vacated alley; thence
in a Southwesterly direction to a point sixteen and
fifty -two hundredths (16.52) feet South of the North
line of Lot 12, and twenty-eight (28) feet West of the
center line of said vacated alley; thence West parallel
with the North line of Lot 12 a distance of seventy (70)
feet; thence in a Northwesterly direction to a point on
the West line of Lot 13, '..:wo (2) feet North of the South-
west corner of said Lot 13, and there terminating.
which area is hereinafter referred to as "easement area, "; and
WAS, party of the second part is the purchaser of
the land above described of party of the first part pursuant to
a Contract for need dated July 2, 1962, and filed as Document No. 709739
in the office of the Registrar of Titles, Hennepin County, Minnesota; and
WHEREAS, there now exists on the above described easement
area, a storm sewer; and
WHEREAS, the party of the first part and the party of the
second part do desire to grant to the party of the third part a.
permanent easement for the maintenance of said storm sewer,
NOW, THEREFORE, in consideration of One Dollar and other
valuable considerations, the party of the first part, and the party
of the second part do hereby grant to the party of the third part a
perpetual easement for the construction, reconstruction, maintenance and
repair of a storm sewer over the above described easement area.
