OF THE ZONING BOARD OF APPEALS
HELD ON THURSDAY, NOVEMBER 5, 1993, 5:30 P.M.
EDINA CITY HALL MANAGER'S CONFERENCE ROOM

I. NEW BUSINESS:

Lot 7, Block 1, Cherokee Hills
Request: A 3 foot frontyard setback variance
Ms. Aaker presented her staff report noting the subject
property consists of a single family home located south east of
Navaho Trail. The lot slopes with the Navaho Trail right-of-way at
a lower elevation than the home. The current front yard setback is
36.08 feet. Established average front yard setback along the block
is 35 feet. The proponent's are hoping to extend a new open front
entrance roof structure to encroach three feet into the required 35
foot frontyard setback area.
Ms. Aaker concluded staff supports the request and recommends
approval based on the following finds:
1. The current situation is claimed to be a hazardous
situation in the winter time.
2. The request is minimal and would have no negative visual
impact.
3. The homeowners are limited in terms of accomplishing a
conforming solution.
4. The variance will not adversely impact the neighborhood
The proponent, Mr. Truckenmiller was present.
Mr. Olson commented that he viewed the site and believes that
the addition will add to the overall appearance of the house.
Mr. Hale said he agrees that as a result of the proposal the
facade of the house will be improved. Mr. Hale cautioned that he
wants the proponent to be aware that the new front entry must
remain unenclosed. Mr. Hale asked if in similar requests could
staff draft standard language that front entries must remain
unenclosed.
Ms. Aaker explained that could be drafted, but each case is
individual, and with variances being unique to each property
standard language may not work in every situation.
Mrs. Utne pointed out that the overhang ties in very nicely
with the lines of the existing house.
Mr. Hale moved approval subject to the stoop remaining
unenclosed. Mr. Olson seconded the motion. All voted aye; motion
carried.

Lot 2, Block 41 Normandale 2nd Addition
Request: A 1.87 foot frontyard setback variance to allow the
installation of a bay window with footings
Ms. Aaker informed the board the subject property is a single
family one story rambler located on the east side of Rolf Avenue.
The proponent is planning to replace an existing front window with
a bay window that is to extend 22 1/2" into the front yard setback
area. The bay window is proposed to extend to the floor with
footings. The Edina city ordinance states that all additions to
the front of a home must maintain the established average front
yard setback. The ordinance includes a number of exceptions to
setback requirements including overhanging eaves and bay windows
not supported by posts or pillars which do not extend to the floor,
and which do not project more than three feet into the required
setback area.
Ms. Aaker stated staff recommend approval based on the
following findings:
1. The proposed bay window is a logical addition to the front of
the home and could not be reasonably adjusted to conform
without removing all floor area.
2. The bay window would have little if any perceivable impact on
the adjoining properties.
3. The proposed variance will not be materially detrimental to
the public welfare or other property in the vicinity.
The proponent, Mr. Salisbury was present.
Mr. Hale questioned why footings are required. Mr. Salisbury
stated that footings are required because the bay will extend to
the floor. Continuing, Mr. Salisbury explained that the bottom of
the bay will be hidden by evergreens.
Mr. Olson moved approval. Mr. Hale seconded the motion. All
voted aye; motion carried.
II. AWOURNMENT:
The meeting was adjourned at 5:50 p.m.
