HomeMy WebLinkAbout1993 01-03 Zoning Board of Appeals Meeting Minutes RegularREGULAR MEETING OF THE EDINA ZONING BOARD OF APPEALS HELD ON THURSDAY, JANUARY 21, 1993 5:30 P.M., EDINA CITY HALL MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Helen McClelland, Mike Lewis, Don Patton, Geof Workinger MEMBERS ABSENT: Gordon Johnson I. APPROVAL OF THE MINUTES: Mr. Workinger moved approval of the November 19, 1992, meeting minutes. Mr. Patton seconded the motion. All voted aye; motion carried. II. NEW BUSINESS: B-93-1 Ron E. Williamson 4300 Eton Place East 1271 of the North 50, of Lot 85, Morningside Request: A 13.5 foot sidestreet setback variance, regarding the non -conforming setback of an existing attached garage structure Ms. Aaker told the board the subject property is a corner lot located south of Morningside Road and west of Eton Place consisting of a single family home with attached garage. The home faces Eton Place with a sidestreet loading attached garage fronting Morningside Road. The proponents are hoping to excavate underneath the existing garage to construct a new two stall garage and convert the existing garage into a family room. The plan as proposed will not change the existing building footprint roof lines or change any of the existing setbacks. Ms. Aaker concluded given the restrictive nature of the subject corner lot staff recommends approval of the submitted request. Staff would condition approval on the following: 1. Approval be limited to the plan submitted. 2. That the homeowner acknowledge section 1045.02, regarding the permitted location of vehicles parked on the driveway . That automobiles are not to be parked within 15 feet of a street curb or five feet of a side lot line. The proponent, Mr. Williamson was present. Mrs. McClelland pointed out a large parked vehicle may overhang onto the sidewalk, and the city does not allow vehicle parking that close to the right-of-way. Continuing, Mrs. McClelland noted the slope of the driveway and garage elevation, along with the roof line may create drainage problems. Mr. Patton agreed with Mrs. McClelland's observation regarding potential drainage problems due to the driveway, garage elevation and roof line and requested that the proponent look into solving this problem. Mr. Williamson said the reason for the roof design is to remain consistent with the existing roof lines. Mr. Patton questioned Ms. Aaker if the proponent's could add a dormer to the roof which would help with water runoff from the roof. Mr. Williamson suggested that he install gutters that will direct water runoff from the driveway into the proper location. Mr. Patton suggested that Mr. Williamson look very carefully at the drainage issues brought up this evening and work at eliminating any drainage problems. A discussion ensued regarding the potential drainage problems that could occur on this site due to the elevation of the driveway and proposed garage and roof pitch. The board felt that this potential problem should be eliminated if at all possible. Suggestions were to add gutters, and elevate the driveway/garage, making it more level. Mr. Patton moved variance approval subject to staff conditions and the additional condition that the question of adequate drainage from water run-off be solved suggesting that the plan be reviewed by the city engineer. Mr. Lewis seconded the motion. All voted aye; motion carried. III. ADJOURNMENT: The meeting was adjourned at 5:50 a.m.
