HomeMy WebLinkAbout1993 07-01 Zoning Board of Appeals Meeting Minutes RegularMINUTES OF THE REGULAR MEETING OF THE EDINA ZONING BOARD OF APPEALS HELD ON THURSDAY, JULY 1 1993 EDINA CITY HALL MANAGERS CONFERENCE ROOM MEMBERS PRESENT: Chair, David Runyan, Charles Ingwalson, Rose Mary Utne and Robert Hale MEMBERS ABSENT: Len Olson STAFF PRESENT: Kris Aaker, Jackie Hoogenakker I. NEW BUSINESS: B-93-22 Joey and Kimberly Kretzman 4107 West 45th Street Lot 20, Auditors Subdivision No. 161 Water 3 Request: A 1 foot frontyard setback variance Ms. Aaker informed the Board the subject property is located along the south side of West 45th Street which is just west of Grimes Avenue and north of Sunnyside Road. The homeowners are proposing to add a porch to the front of their home which would be six feet deep and run the length of the home wrapping around the east side building wall to match up with the side entrance door. Ms. Aaker explained the home was constructed in 1923 and has been expanded, and remodeled from a 652 square foot home with no garage to a three bedroom two story home with a detached two car garage. The most recent remodeling project initiated in September of 1992 included a change to the front door and windows. All of the windows were removed and replaced with a bay window and the front door was shifted east of it's original location. The applicants indicated that they wish to add curb appeal by adding a porch to the home. The applicants believe the porch as designed, will be functional and provide interest to the front of their home. Ms. Aaker concluded generally the Board has been very protective of maintaining a consistent streetscape. The method of calculating frontyard setback requirements in the ordinance reflect this desire. It would appear when reviewing the measurements and when conducting a site inspection there is a mixture of frontyard setbacks along the block. The purpose of the ordinance is to maintain a harmonious streetscape. Staff is of the opinion that the porch addition will not compromise the intent of the ordinance and will actually enhance the view along the street. Ms. Aaker added staff suggests the following conditions be imposed on a variance approval: 1. Any approval is tied to the plans submitted. 2. The porch remain unenclosed. 3. Consistent materials are used throughout the addition. The proponent, Mr. Kretzman was present. Mr. Hale noted that four of the neighbors on the block are closer to the street than the proponents. Ms. Aaker stated that is correct. Frontyard setbacks along this block are varied. Mr. Ingwalson asked the proponents if they realize after this proposal is completed that the lot will almost be at maximum lot coverage, therefore no other future additions could be constructed. Mr. Kretzman responded he understands the lot will be at capacity after the porch addition. Mr. Runyan pointed out that the proposed porch will not be used year round and the requested one foot will not visually be noticed from the street. Continuing, Mr. Runyan asked the proponents if they plan to screen in porch. Mr. Kretzman said in the future they may want to screen in the porch so it can be used in the late evening when the insects are out. Mrs. Utne moved approval of the proposed porch. Mr. Hale seconded the motion. All voted aye; motion carried. B-93-23 Craig and Pam Gagnon 4807 Sunnyside Road Lot 15, block 4, Country Club District Browndals Section Zoning: R-1 Purpose: A 4.5 foot sideyard setback variance request. Ms. Aaker informed the board the homeowners have submitted an application to the city for a 4.5 foot sideyard setback variance from the western property boundary to expand an existing porch and convert it to allow four seasons of enjoyment. The porch's location is a non -conforming six feet from the west property boundary. Current ordinance standards require 10 foot sideyard setbacks for living areas. The home backs up to Minnehaha Creek which is approximately 80 feet from the back of the home. The lot is a pie shaped lot with a width along the curb line of 90 feet and a rear lot line of 65 feet. The variance is to allow the addition of approximately 162 square feet to the existing porch. The expansion will extend the existing porch six feet while matching the established building lines. Ms. Aaker concluded that the encroachment will only increase an already non -conforming setback by only approximately six inches and staff supports the request. Approval should satisfy the following conditions: 1. Consistent materials are used on the exterior of the addition. 2. Amy approval shall be tied to the plans submitted. The proponents Mr. and Mrs. Gagnon were present. Mrs. Utne told board members she walked the area where the addition is proposed noting that the proposed addition would have minimal impact on neighbors. Continuing, Mrs. Utne stated the location of the addition makes sense. Mr. Hale moved variance approval subject to staff conditions, and that the addition be constructed at the existing non -conforming setback from the property line and extend out only six feet. Mrs. Utne seconded the motion. All voted aye; motion carried. II. ADJOURNMENT: The meeting was adjourned at 5:55 p.m. ,W_Qi-e Hoogeriakkei_
