EDINA CITY HALL MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Chair, Rose Mary Utne, Ann Swenson, Johnson, Nan Faust MEMBERS ABSENT: Len Olson STAFF PRESENT: Kris Aaker, Jackie Hoogenakker I. NEW BUSINESS: B-93-40 Request: Gregory Duke Benson 6120 Wilryan Avenue South Lot 11, Block 2, M. Kulay's Addition Lee A 2.5 foot sideyard setback variance for a garage expansion Ms. Aaker informed the board the subject property is located on the west side of Wilryan Avenue, just north of West 62nd Street. The home is a split level walk out with a tuck -under two stall garage. The homeowners are hoping to add a third garage stall to the existing garage to include additional depth to provide for storage. The proponents have planned a 14 foot wide by 38 foot deep (532 sq. ft.) garage addition with a setback of 2.5 feet from the side property boundary. Ms. Aaker explained staff has identified a number of conditions present with regard to the site that include the existing insufficient height of the garage opening, and the center beam height that reduces clearance for vehicles. It should also be noted that the south side lot line is not parallel so encroachment into setback is greater in the front corner of the garage than the rear. Given the conditions present and acknowledging the need for additional storage, staff sympathizes with the request for a garage addition, however, would recommend that any approval allow an addition no closer than 3 feet to the side lot line. A minimum variance of .5 feet would allow for a standard 12 foot garage width. The proponent, Mr. Benson was present. 1 planning a 12 X 12 foot two story addition in the northwest corner of the home. The addition will include the expansion of the kitchen in the lower level, the addition of a bedroom to the upper level and a master bathroom above the garage. All aspects of the design conform to ordinance requirements with the exception of setback from the north property boundary. The homeowners are proposing to continue the north building wall at a setback ft. 8.44 feet and match the existing height of 19.25 feet. Ordinance requires a minimum 10 foot sideyard setback plus 6" for each foot average building height exceeds 25 feet. Ms. Aaker concluded staff acknowledges the difficulty with which an addition can be accomplished on the site given the placement of the home, garage, and driveway access. Staff supports the request with the following recommendations: 1. Any variance be tied to the plans submitted. 2. Compatible materials with the existing home are used. Mr. Miller, proponent was present. Mrs. Swenson noted in observing the plans for this house it is very important to maintain the existing roof lines, and the addition be constructed with consistent materials. Mrs. Swenson moved approval subject to the condition that the addition be tied to plans submitted and that compatible materials are used for the addition and the roof lines of the addition be consistent with existing roof lines. Mrs. Faust seconded the motion. All voted aye; motion carried. B-93-43 Jeffrey and Ann Nevin 5114 Arden Avenue Request: A 4 foot sideyard setback variance and a 3 foot frontyard setback variance Ms. Aaker told the board the homeowners have recently purchased the property and hope to add onto the house in a similar fashion as planned by a previous homeowner. A request for variance by the previous homeowner had been submitted and approved by the board of appeals on September 10, 1992. The proponents design is similar in scope and scale to the approved plan and will not located any living area below the flood plain elevation of 867 feet. Ms. Aaker concluded staff supports the sideyard setback variance given that it is nearly identical to the previous request approved on September 10, 1992. Staff recommends approval be 3 subject to the following conditions: 1. All finish materials of the new addition match the existing structure. 2. Approval be tied to the plans submitted. 3. The porch area remain unenclosed. The proponent, Mr. Nevin was present. Mr. Nevin told the board he believes what he is proposing will improve the existing house and not have a negative impact on the neighborhood. He pointed out all new windows will be matching. Mrs. Swenson moved approval of the variance request subject to plans presented, the addition be constructed with matching materials and the proposed porch area remain unenclosed. Mrs. Faust seconded the motion. All voted aye; motion carried. B-93-44 Steven M. Rakes 6201 Mildred Avenue Lot 7, Block 9, James A. Roberts Estate Request: A 1.66 foot frontyard setback variance Ms. Aaker informed the board the subject property is a single family story and one half home located on the east side of Mildred Avenue between Maddox Lane and West 62nd Street. The homeowners are planning to replace an existing front window with a bay window that will extend approximately 20 inches into the minimum 30 foot frontyard setback area. Ms. Aaker concluded staff recommends approval based on the following findings: 1. The bay window is a logical addition to the front of the home and could only be adjusted to remove all of the desired floor area. 2. The bay window would have little if any perceivable impact on adjoining properties. 3. The proposed variance will not be materially detrimental to properties in the vicinity. The proponent, Mr. Rakes was present. Mrs. Swenson asked Mr. Rakes the type of material he proposes to use for the roof of the bay window 4 Mr. Rakes stated he proposes to use a copper metal for the roof. Mr. Rakes asked the board for flexibility in setback if the window that was ordered is an inch or two larger that indicated. Mrs. faust moved approval subject to staff conditions and allowing a 2"-3" flexibility in setback due to window size. Mrs. Swenson seconded the motion. All voted aye; motion carried. II.
