APPROVAL OF THE MINUTES: The minutes for the March 16, 1995 meeting were filed as submitted. II. NEW BUSINESS: B-95-11 Raymond R. and Sarah M. Johnson 4620 West 63rd Street Lot 19, Block 2, Valley View Ridge Request: A 12 foot sidestreet setback variance for a deck Ms. Aaker informed the board the subject property is located in the north west corner of West 63rd Street and Ashcroft Avenue. The home consists of a one story rambler fronting west 63rd Street. The homeowners are hoping to construct a deck into the eastern sideyard area. They hope to construct the deck within three feet of the side street property boundary. Ms. Aaker concluded Given the unique lot shape, house location and adjacent lot orientations staff could support a variance from the 15 foot sidestreet requirement. Staff would suggest a five foot setback (10 foot variance), which would be consistent with an interior sideyard and rearyard setback minimum. The proponents, Mr. and Mrs. Johnson were present. Ms. McClelland asked Mr. Johnson if they are proposing to screen the deck. Mr. Johnson responded they want to screen the deck with a four foot fence with lattice on the top to protect the deck and kitchen area from vehicle headlights. Continuing, Mr. Johnson explained presently we have an existing patio, and now desire a more seamless approach. Mr. Johnson added the reason he would like the extra two feet from staff's recommended 10 feet is because they do not want space between the deck and the fence. The two foot strip would be hard to maintain and could create a safety consideration. Ms. McClelland asked Ms. Aaker what setback she would feel comfortable with. Ms. Aaker said she would like the deck to be five feet from the property boundary, not the proposed three feet. Mr. Ken Guetzke, 6221 Ashcroft Avenue, told board members he has no objection to the proposed deck, but wants some assurance that the deck remains unenclosed. Ms. Aaker said if the proponent were to desire to enclose the deck they would need to apply for another variance. Mr. Lewis said as he views the proposal he finds there is a hardship because of the curve of the street, and the unusual lot shape, and does not have a problem with it. Mr. Workinger said he is not comfortable with the setting of a precedent, and questioned Mr. Johnson how far the deck is off the ground. Mr. Johnson responded around two feet. Continuing, Mr. Workinger asked Mr. Johnson if he intends to replace the existing fencing. Mr. Johnson said the fencing will be replaced along Ashcroft Avenue. A brief discussion ensued. Mr. Lewis moved to recommend variance approval as submitted, subject to the plans presented, noting a hardship results from the unusual shape of the property, and its alignment to the street, with the additional condition that the chain link fence will be replaced with a four foot wood fence with two feet of lattice on top along Ashcroft Avenue, noting the approval is for a unenclosed deck, any other structure would need city approval.
