OLNUX1 B-95-28 William S. Chen 4600 Golf Terrace That part of Lot 1, Block 3, lying east of West 42 feet thereof, Hansen & Parks' 1st Addition, Country Club District, all of St. Johns Avenue vacated lying North of Golf Terrace Request: A 3.25 foot sideyard setback variance Ms. Aaker informed the board the subject property is located on the north side of Golf Terrace and consists of a two story home built in 1941. The homeowner has applied for a building permit to convert the attic space above the existing garage into an office area. The garage is 7.5 feet from the west sideyard property boundary. The Zoning Ordinance requires a minimum ten foot sideyard setback. In addition, six inches must be added to the minimum sideyard setback for each twelve inches building height exceeds fifteen feet. The sidewall height of the garage is 16.5 feet which requires a 10.75 foot sideyard setback to allow living space above. Garage setback is a five foot minimum requirement. Ms. Aaker concluded given the limited impact on neighboring property and that the attic area is existing and will not increase in size with the project, staff supports the request. The proponent, Mr. Chen was present to respond to questions. Mr. Johnson observed from the street the appearance of the home will Change as a result of this request. Mr. Johnson said he can support the request. Mrs. Faust moved variance approval subject to the plans presented, pointing out further changes/additions in the dormer area would need to be discussed. Mrs. Swenson seconded the motion. All voted aye; motion carried. B-95-29 Thomas S. Denison/Mary Kay Jacobus 5600 Abbott Avenue South Lot 1, Block 1, Harriet Lawn, Henn. Co. Request: A 10.34 foot sidestreet setback variance Ms. Aaker told board members the subject property is located in the southwest corner of West 56th Street and Abbott Avenue and consists of a one story house with a tuck under single stall garage. The homeowners are hoping to add a two car tuck under garage with a porch area above. The existing (and proposed) garage load off of an alley adjacent to the west of the property. The Zoning Ordinance requires a 15 foot sidestreet setback. The proposed addition would be 4.66 feet from the sidestreet property boundary. Ms. Aaker concluded given the limited opportunity available for expansion staff supports the request, however, would suggest that any approval be subject to the use of matching materials The proponents, Mr. Denison and Ms. Jacobus were present. Mr. Denison informed board members he contacted 29 neighbors regarding this proposal, including the two neighbors most impacted by the addition and everyone contacted indicated they did not have a problem with the expansion. Mr. Johnson moved variance approval subject to the plans presented and the use of matching materials. Ms. Swenson seconded the motion. All voted aye; motion carried. B-95-30 Daniel and Mary Bernston 6728 Point Drive Lot 21, Block 1, Southdale 3rd Addition Request: A four foot sidestreet variance 2 Ms. Aaker informed the board the subject property is located in the northwest corner of Balfanz Road and Point Drive and consists of a one story single dwelling unit. The home faces Point Drive with the sidestreet of the property along Balfanz Road. The property owners are hoping to add a 14'-4"X 18' addition to the back of the home in the southwest corner. The existing home provides a 15 feet sidestreet setback. The proposed addition will reduce the setback to 11 feet. Ms. Aaker concluded given the curvature of the street with relation to the sidewall of the house staff supports the request subject to the use of matching materials. The proponents, Mr. and Mr. Bernston were present to respond to questions. Mrs. Bernston explained to board members neighbors have viewed the plans, and have indicated their support. Mr. Johnson moved variance approval subject to plans presented. Mr. Olson seconded the motion. All voted aye; motion carried. B-95-31 Howard and Louise Schneider 6421 Vernon Avenue Lot 1, Block 1, Gleason 5th Addition Request: A 21 foot setback variance from a pond to construct a deck Ms. Aaker informed board members the subject property is located along the south side of Vernon Avenue just west of Gleason Road and consists of a double bungalow backing up to a pond. The home was built in 1974 and was split into two separate properties shortly thereafter. Ms. Aaker explained the homeowners are hoping to replace and reduce in size an existing deck along the back side of the home with a new deck that will have a portion of the southeast corner extending farther into the rearyard area. Ms. Aaker concluded given that any alteration to the deck requires a variance staff can support a variance. Staff does have some concern regarding the impact of the extended portion of the deck on the adjacent twinhome. 0191 The proponents, Mr. and Mrs. Schneider were present. Mr. Bob Ohman, immediate neighbor, submitted to board members drawings indicating in his opinion the proposed addition would destroy his privacy, and mar his view. Continuing, Mr. Ohman told board members he believes an alternative can be reached that would not compromise his privacy or view. Mrs. Schneider explained the deck will not be enclosed so views should not be compromised. Mrs. Schneider added she believes the proposed deck has minimal impact, and achieves a goal by providing enough area to accommodate a table. She concluded pointing out the proposed deck is replacing an existing one. Mrs. Utne asked if anyone has any solutions to this proposal. Mr. Johnson said in his opinion the encroachment into the rear yard can be reduced, and the deck redesigned to afford more privacy, and better view for the neighbors. Mr. Olson said that while privacy is important, the deck enhances the property, concluding he can support the request. Mrs. Swenson said in her opinion if this is granted a precedent would be set, concluding she is opposed to the proposal as submitted. Mrs. Faust agreed. Mr. Johnson moved to grant the variance with a revision that the setback be reduced to 17 feet from the pond, and that the deck be angled to promote better site lines. Mr. Olson seconded the motion.
