HomeMy WebLinkAbout19956 11-16 Zoning Board of Appeals Meeting Minutes RegularMINUTES OF THE REGULAR MEETING OF THE EDINA ZONING BOARD OF APPEALS HELD ON THURSDAY, NOVEMBER 16, 1996 5:30 P.M., MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Chair, Gordon Johnson, Don Patton, Mike Lewis, Geof Workinger, Helen McClelland I. APPROVAL OF THE MINUTES: Mr. Lewis moved approval of the September 16, 1995 meeting minutes. Mr. Workinger seconded the motion. All voted aye; motion carried. II. NEW BUSINESS: B-95-54 James and Vicki Nelson 5614 Dalrymple Road Lot 11, Block 2, Golf Terrace Heights Ist Addn Request: A two foot sideyard setback variance for an attached garage Ms. Aaker informed the Board the subject property is located on the west side of Dalrymple Road just south of Lakeview Drive and consists of a one story single dwelling unit with an attached garage. The homeowners are hoping to add four feet onto the north of their garage to increase the width to allow for a double garage. Ms. Aaker concluded the proposal is an improvement to allow for a double garage that is a requirement for all single dwelling units. The proposal would have limited impact on surrounding properties and would still provide adequate spacing between structures. Staff supports the request subject to the use of matching materials with those used on the existing structure. The proponent, Mr. Nelson was present. Mr. Johnson asked Ms. Aaker if staff has received any comments or correspondence from the neighbors to the north. Mr. Nelson interjected the neighbor to the north has indicated they do not have a problem with the proposal. 1 Mr. Nelson informed the Board the survey indicates a setback of nine feet from the addition, and he measured the distance, and found that it is 15 feet. Ms. McClelland suggested if the survey is wrong that it be corrected to reflect the exact number. Mr. Patton said in reviewing the plans his concern is with the possibility of drainage problems. Ms. Aaker interjected the Engineering Department reviews all building permits, and if there is a potential drainage problem, it must be resolved before a permit is issued, and construction begins. Mr. Patton said he supports the request, but reiterated he is concerned with the possibility of drainage problems, especially as it relates to the north neighbor. Mr. Lewis asked Mr. Nelson if he could obtain a letter of support from the north neighbor for the file. Mr. Nelson said he would contact the neighbor, and have him draft a letter for the file. Ms. McClelland moved variance approval subject to the plans presented, subject to a letter from the neighbor to the north, subject to the use of matching materials, subject to drainage review by the Engineering Department, and subject to the condition that the survey be recalculated to reflect 15 feet. Mr. Workinger interjected he would like to see added as a condition of approval the addition of a window or windows on the north elevation. Ms. McClelland said she does not have a problem with amending her motion to add as a condition of approval that a window (or) windows be placed in the north elevation to break up the building mass.
