APPROVAL OF THE MINUTES: The minutes of the September 3, 1998, meeting were filed as submitted. II. NEW BUSINESS: B-98-52 Robert Marquardt 5517 Brookview Lot 16, Block 14, South Harriet Park Request: A 3.25 foot sideyard setback variance for a 2nd story addition Ms. Aaker informed the Board the subject property consists of a one and one half story cape cod style home with an attached garage. The homeowners are planning a second story expansion over a flat roofed family and dining room area located on the backside of the home. Ms. Aaker noted on October 1, 1998, the contractors on behalf of the homeowners submitted a building permit application for the planned addition. During the review process it became evident that the building wall height would result in a non -conforming setback. The minimum sideyard setback required for a lot width of 60 feet is 5 feet, however, the setback must be increased 6 inches for each 12 inches the building wall height exceeds 15 feet. In this instance the average height of the new addition results in a minimum sideyard setback requirement of 8.25 feet. The home currently provides a 5 foot north sideyard setback, therefore a variance form north sideyard setback is needed. Ms. Aaker explained the homeowner has indicated that in 1990, the family room and dining room were added with the intention of adding the second floor above at a later date. The homeowners roughed in heating and air conditioning to allow for the future expansion. The home is currently a two bedroom - one full bath home. The expansion will allow the accommodation of the proponent's family of four. The flat roof of the 1990 addition was meant to be a temporary solution. The existing flat roof is not consistent with the design of the roof lines of other homes in the neighborhood. The final appearance of the addition with the pitched roof will enhance the 1990 addition and will be more in keeping with surrounding architecture. Ms. Aaker pointed out spacing between the subject home and house to the north will remain the same. The proposed addition will not alter the existing building footprint. Ms. Aaker concluded the addition will remain within the existing building footprint and will not reduce existing setback. Materials to be used on the addition will be consistent throughout. Staff believes the addition will be an improvement to the property. Mr. Ed Noonan, builder for the project was present representing the proponent, Mr. Marquardt. Mr. Ingwalson said in reviewing the report he wondered if the original Ist floor addition required a variance. Ms. Aaker said the Ist floor did not need a variance. The Ist floor addition met all setbacks. Mr. Ed Noonan representing Mr. Marquardt said in designing the 2"d floor addition it was very difficult to match the roof line, adding he believes the design they eventually decided upon best maintains the character of the existing house. Mrs. Utne stated she agrees. She added the new roof adds to the project, adding she can support the variance request as submitted. Mrs. Utne moved variance approval subject to the plans presented, and the use of matching materials. Mr. Ingwalson seconded the motion. All voted aye; motion carried. B-98-53 Bennett and Mary Porter 5120 Halifax Avenue South Lot 6, Block 2, Glenview Request: A 4.25 foot sideyard setback variance for a dormer expansion I! Ms. Aaker told the Board the subject property is located on the west side of Halifax Avenue consisting of a one and one half story home with an attached two car garage. Ms. Aaker explained the homeowners submitted permit application to raise the roof of the home to increase 2"d floor living space and to extend a dormer along the entire back side of the home. The expansion allows for larger bedroom and bath area on the 2nd story. The building footprint will not change from what is existing. Ms. Aaker pointed out the proposal will not alter the building footprint nor will it reduce the already existing non -conforming setback. The materials to be used on the exterior of the addition will be consistent with materials used on the remainder of the house. Ms. Aaker concluded the project will not drastically alter the character of the home, will not reduce an existing setback and should have minimal impact on neighboring property owners. The proponents, Mr. and Mrs. Porter were present. Mr. Ingwalson asked Ms. Aaker if she would explain the proposed roof line. Ms. Aaker explained the scenario presented is a two dormer system. Mr. Skallerud stated in reviewing the plans presented he can support the request. He noted in his opinion the renovation will improve the home, adding this is a beautiful area of Edina where the Board is seeing many variance requests for improving the properties. Mr. Ingwalson agreed, pointing out the footprint of the home remains unchanged. Mr. Skallerud moved variance approval subject to the plans presented, and the use of matching materials. Mrs. Utne seconded the motion. All voted aye; motion carried. B-98-54 Lisa and Greg Buck 6104 Wilryan Avenue Lot 14, Block 15, Block 2, Mikulay's Addition Request: A 12.2 foot sidestreet/frontyard setback variance for an attached garage addition Ms. Aaker addressed the Board informing them the subject property is a corner -lot located along Wilryan Avenue consisting of a two story home with a detached two car K garage. The home was built in 1912 and faces north on the lot. The proposed additions to the home include a new family room, eating area, rear entry hall, work room, mud room, bathroom, porch, and attached garage with attic trusses above. Ms. Aaker pointed out the property consists of two lots with a previous addition to the home accomplished in 1990 overlapping the interior lot line separating the two lots. It has always been the intention of the property owner to maintain the two lots as one buildable parcel. The proposed additions to the home and new garage extend farther into the lot to the west. Ms. Aaker concluded the subject home was constructed well before any of the other properties in the vicinity were developed. The orientation of the subject home as compared with the other homes surrounding it is at odd angles making a conforming solution and logical attachment of a garage more difficult. Spacing between the closest corner of the garage and most affected neighbor is 51 feet. The finishing materials will be consistent throughout the exterior of the building. Staff supports the request as submitted. The proponent, Ms. Buck was present to respond to questions. Mr. Runyan noted the re -configuration of the drive -way, and questioned if retaining walls will be required. Ms. Buck explained that area is flat, so no retaining walls are needed. Ms. Buck approached the Board and presented them with photo's of the property. She added the subject home is probably one of the oldest homes in the area. Mr. Runayn noted the existing vegetation, and questioned Ms. Buck if the street can be seen from the house. Ms. Buck explained in the summer the vegetation is very dense, and from the house one can not really see the road. Ms. Buck added with the addition they want to plant more vegetation along the road and highway to soften the noise from the cross-town. Mr. Ingwalson said in reviewing this plan this property suffers extreme hardships. He noted the age of the house, adding it appears the road was constructed around the house. Mr. Ingwalson added if after construction, if it is found to be needed, he wants the proposed garage to be further screened with vegetation. Ms. Aaker interjected that the area closest to the garage is City right-of-way, noting the proponents can look into planting on the right-of-way by requesting permission from the City Parks and Recreations Department. Mr. Ingwalson moved variance approval subject to the plans presented, the use of matching materials, and noting the extreme hardships that exists on this site. Mr. Skallerud seconded the motion. All voted aye; motion carried. B-98-55 Joe Green 4631 Bruce Avenue Lot 19, Block 10, Country Club District 12 Fairway Section Request: A 1.1 foot sideyard setback variance for a bay window extension for an eating area Ms. Aaker told the Board the subject property is located on the east side of Bruce Avenue consisting of an English cottage style home built in 1925. The homeowners are proposing to remove the existing attached side loading garage that is behind the house and replace it with a two story addition to include a new detached two car garage added in the southeast corner of the lot. Ms. Aaker explained the existing setback of the attached garage to be removed is 3.9 feet to the north sideyard instead of 5 feet which is required by Ordinance. The two story addition maintains the required setback including the added setback due to the increase in building height. The plan does, however, include the extension of a bay window eating area. The bay extension will, match the non -conforming 3.9 foot sideyard setback of the existing garage. No part of the addition will be closer to the side lot line than what exists currently. Ms. Aaker pointed out the design of the new addition will reflect the English cottage style of the original house, would provide greater spacing from the lot line for most of the structure, and improve the drainage currently being directed on the neighbor. Ms. Aaker concluded the proposed addition will improve and reduce the existing non -conforming setback and will compliment the architecture of the existing home. Staff supports the request as submitted. The proponent, Mr. Green was present to respond to questions. Mrs. Utne asked Mr. Green if he proposes to add a loft above the garage. Mr. Green said the area directly above the garage will be used only for storage. Mr. Green said the reason for the roof pitch is to match the existing roof lines. Mrs. Utne asked Mr. Green how he will gain access to the storage area in the garage. Mr. Green responded with a stairway. Mrs. Utne questioned if the garage will be erected with plumbing. Ms. Aaker stated the garage will not be plumbed. Mrs. Utne asked if drainage will be checked. Ms. Aaker responded drainage impact from additions is checked by the City's Engineering Department. Mr. Green explained his goal is to do the garage properly by constructing a structure that compliments the character of the existing house. 5 Mr. Runyan said he likes the look of the garage, and does not have any problems with the plan as presented. Mr. Ingwalson moved variance approval subject to the plans presented, and the use of matching materials. Mr. Skallerud seconded the motion. All voted aye; motion carried. III.
