APPROVAL OF THE MINUTES The minutes of the October 16, 1998, meeting were filed as submitted II. NEW BUSINESS: B-98-63 Tom A Ries 6600 Sally Lane Lot 13, Block 2, Indian Hills Arrowhead Addition Zoning: R-1 Request: A 2.66 foot rearyard setback variance Ms. Aaker informed the Board the subject property is located at the north end of Sally Lane cul-de-sac, consisting of a one story rambler. The homeowners are planning to add a master bedroom addition to the back of their home. The property in question is a pie shaped lot with the rear lot line angled to a point. The homeowners would like to extend the east side wall north by 14 feet. The addition would overlap in the eastern corner, into the minimum 25 foot rearyard setback by 2.66 feet. Ms. Aaker explained the subject home is setback on the lot farther from the street frontage than the homes on either side, subsequently the home sets farther back into the lot and is located closer to the rear lot line than neighboring homes. The rear lot lines of the subject lot are angled so that rearyard area is greatest towards the middle of the lot. The addition to the home is unfortunately an extension of the east side wall which is in an area that gets closer to the rear lot line. Ms. Aaker pointed out it should be noted that the proponent is a co-owner of the vacant lot located behind the subject property. The homeowner of 6601 Pawnee Road co- owns the vacant lot fronting Indian Hills Road with the applicant and is in full support of the variance. Ms. Aaker concluded the addition will compliment the architecture of the home and will have limited impact on adjacent properties. Original house placement and angled rear lot lines are hardships unique to the property. Staff recommends approval of the request. The proponent, Mr. Reis was present to respond to questions. Ms. McClelland asked Ms. Aaker if the lot to the rear is considered buildable. Ms. Aaker confirmed the lot is buildable. She clarified the lot to the rear of the subject property is co -owned with an adjoining neighbor located at 6601 Pawnee Road. The lot has a depth of 131 feet. Mr. Lewis said in his opinion, after visiting the site, and reviewing the application materials, that this is a very difficult lot to work with because of its irregular shape. Ms. Aaker agreed. She said the irregular angled rear lot line poses a hardship. Mr. Reis told the Board he spoke with the majority of his neighbors, and they indicated their support. Mr. Reis explained when they hired an architect to design the addition they really did not know where the lot line ended because of the angle of the rear property line. Mr. Reis said he was surprised a variance was required. Mrs. Bergman noted the rearyard is heavily wooded, along with the adjoining rear lot, adding any impact from the addition would be minimal. Mr. Reis interjected the vegetation in the rear is very dense. Mr. Lewis moved variance approval subject to the plans presented, and the use of like materials. Mr. Lewis noted the irregular shape and topography of the lot are a hardship. Mrs. Bergman seconded the motion. All voted aye; motion carried. III. ADJOURNMENT: The meeting adjourned at 5:45 p.m.
