MINUTES OF THE REGULAR MEETING OF THE HUMAN RIGHTS & RELATIONS COMMISSION November 26, 2013 7:00 P.M. I. CALL TO ORDER Chair Bigbee called the meeting to order at 7:00 PM. II. ROLL CALL Answering roll call were Commissioners Arseneault, Bigbee, Cashmore, Davis, Haeg, Harrington, Lagerstrom, Seidman, Winnick, Staff Liaison Schaefer, and City Manager Fellow Coyle. III. APPROVAL OF MEETING AGENDA Motion was made by Commissioner Winnick to approve the meeting agenda of the November 26, 2013 meeting. The motion was seconded by Commissioner Davis. Motion carried. IV. ADOPTION OF MEETING MINUTES Commissioner Arseneault provided the following changes to VI section C: total budget was $84,600 and section VI F.iv: insert document after' hopes to have'. City Manager Fellow Coyle reported that additional changes and corrections were submitted before the meeting and passed out to each commissioner: VLA Agnes and Mehan were misspelled. Commissioner Seidman provided the following changes to section F.i.: A readers' theater play called 'Upstanders: Ten Who Dared'; a performance of resistance music from the Holocaust and the story of Sophie Scholl and the White Rose, a youth resistance movement in Nazi Germany will be performed at the Edina Senior Center. Ellen Kennedy is working with our commission to coordinate the interactive play, stories and music for the event. The entire event will last approximately 90 minutes. Motion was made by Commissioner Cashmore to approve the Regular Meeting Minutes of October 22, 2013; the motion was seconded by Commissioner Seidman. Motion carried. V. COMMUNITY COMMENT There were no community comments. VI. REPORTS/RECOMMENDATIONS A. Year in Review Presentation Chair Bigbee encouraged community participation and feedback on HRRC work. Commissioner Lagerstrom provided an update on the Edina Quasquicentennial. Commissioner Winnick provided an update on the 2014 Tom Oye Award. The deadline for applications is January 31St, 2014. Recognition happens at the Volunteer Recognition event. Nominees are on a two-year cycle. Commissioner Lagerstrom provided an update on the 2013 and 2014 Edina Reads events for the annual anti -bullying campaign. Commissioner Cashmore provided an update on the Bias/Hate Crime Response Plan. Commissioner Arseneault provided an update on HRRC support for marriage equality and immigration reform. Commissioner Davis provided an update on the HRRC Community Outreach and Engagement Working Group and the Religious Observance Policy. Commissioner Seidman provided an update on the 2013 and 2014 Days of Remembrance and Genocide Awareness events. Chair Bigbee provided an update on the conflict free materials, living streets advisory group, the positive impact of student commission members, and finally the new 2014 HRRC Special Needs Awareness Campaign. B. Review 2014 Work Plan Chair Bigbee called attention to the 2014 HRRC Work Plan included in the meeting packet. C. Appoint nominating committee Commissioner Winnick has agreed to serve as a nominating committee member for the 2014 nomination process. There are two officers for HRRC that serve one year terms: Chair and Vice Chair. Winnick will reach out to each member of the commission to determine if there is an interest to serve. The nominations will be presented at the January 2014 meeting and the election happens at the February 2014 meeting. VII. CORRESPONDENCE AND PETITIONS None. VIII. CHAIR AND COMMISSION MEMBER COMMENTS Commissioner Cashmore recalled that the Commission's very best projects were brought about by members of the community, such as Days of Remembrance and Domestic Partnerships. Community members with ideas can attend the Outreach Working Group, or get in contact with staff directly. IX. STAFF COMMENTS None. X. ADJOURNMENT There being no further business on the Commission Agenda, Commissioner Cashmore moved and Commissioner Seidman seconded that the meeting be adjourned. Motion carried. My name is Avery Kerr, and I'm a sophomore at Edina High School, in a small suburb located near Minneapolis in Minnesota. I wanted to email you so that I could tell you more about the misleading stereotypes about women in our community. The missing representation for women in leadership positions all around the world, in the workplace, government, etc is because of a false stereotype and this needs to change because women are just as capable as men. One of the main challenges facing women in our community is the misleading thought that they do not have the ability to be in a leadership position. This issue presents itself on wide spectrum ranging from with in a high school all the way up to leading a country. According to Sheryl Sandberg (2010) "Women are not making it to the top of any profession anywhere in the world. The numbers tell the story quite clearly. Of all the people in parliament in the world only 13% are women." Meaning that about 90% of the leaders in the world are men. This quote displays the stereotype of women not being able to lead by how unbalanced leadership in this world is. Women have the ability to lead as shown by Queens throughout history who have successfully led countries with out a husband; also by women who have risen up in their profession to become successful leaders of their companies. For example as shown by Money CNN (2013) Ginni Rometty has risen up to become the Chairmen, President and CEO of IBM, showing a real life example of a women overcoming this stereotype. These Women and in Miss Representation (2011) show that women do have the ability to lead. However because of this false stereotype women all over the world are not achieving their full potential. This causes an unbalanced work environment with men dominating the workplace. Although women have this unfair stereotype pinned on them there is a way to overcome it. As Sheryl Sandberg informs (2010) 1.Sit at the table 2.Make a partner a partner 3. Don't leave before you leave. These three crucial steps all incorporate the idea that women must not be afraid to sit at the table with the men, that women are just as able as any man is 20 and that they need to take control of their workplace. Many women have overcome this stereotype and are now successful leaders like Ginni Rometty or Sheryl Sandberg; still there needs to be more women in a leadership position, only 13% of parliament in the whole world are women which is causing this false stereotype that needs to be broken down. I feel that you are in a position to easily and effectively persuade people and inform them about this issue and I hope that you will consider doing something about this issue. My name is Chloe Lewis, and I would like to voice my opinion on the gender stereotypes in our society. Today, men and woman are included in social expectations to fit their gender, limiting their resources to strive for success. Specifically, I will be focusing on the stereotyping of women. To begin with, women don't believe they have the confidence to thrive in the work force. According to Sheryl Sandberg (2010), "Women systematically underestimate their own abilities, versus men". Clearly, Sandberg highlights the idea that women are not striving for their potential, because they are not assured that they will succeed. Later in life, this can affect their jobs, income and family statuses. Next, women are not considered to have strong leadership abilities. In most, if not all Minnesota leadership positions, women are not in high rank, states the University of Minnesota Hubert H. Humphrey School on Women and Public Policy (2012, p. 14). Women do not have the power to interpret their opinions to our society, and grow in their leadership strength, if they are not considered in the important leadership positions. To end with, women are misrepresented in the media. According to Carol Jenkins, only 3% of major media roles come from women, limiting the perspective to mostly male on major issues in our world (2011). In larger depth, women are not getting a chance to experience these media roles, limiting their opinions to be displayed in the media. To conclude, you, as the Mayor of Edina, are in power of our city, which includes individuals who may be currently struggling with their gender identity. Spreading the word of this information to the public will create awareness of this issue, and could shape and make a more powerful society! Gender stereotypes limit a person's potential from a very young age by adults placing boys and girls into boxes that are supposed to define them, which causes people to try to live up to inhumane expectations or be tossed into the "real world" unprepared. Gender stereotypes are propagated by some adults who attempt to place boys and girls beginning from a very young age into boxes that define who they are supposed to be because of their gender. According to Melissa Wardy (2011): These grown ups try to fit kids into little boxes that are labeled "Boy" or "Girl", and then they only let certain colors or ideas into each box ... Since boys and girls don't grow in boxes, you can see how really goofy this is. Consequently, there are many parents who do not question the negative affects of gender stereotypes, which is then ingrained into the minds of their children, causing them to lose their imaginations and attempt to live up to the inhumane guidelines of gender stereotypes. With a lack of education on the topic of gender stereotypes, people can be tossed into the "real world" unprepared for their harsh cruelty. In response to a viral web post written by Mrs. Hall, Kristen Howerton (2013) claims, "Trying to protect [children] from situations they will encounter in real life simply leaves them with under -developed self control and mentality" (p. 3). Evidently, a Q1 parent's duty is to teach their children to understand the unreality of gender stereotypes, in order for the child to enter the world prepared. Lastly, one of the cruelest, most inhumane affects of gender stereotypes is the limitation they set back on women. According to J.S. Newson (2011) in his film Miss Representation, 53% of 13 year old girls are unhappy with their bodies, which increases to 78% by age 17. Plus, 65% of American women and girls have disordered eating behavior. Finally, the number of cosmetic surgical procedures performed on youth 18 or younger more than tripled from 1997 and 2007.As a result of these unrealistic gender stereotypes, women have been taught that their sexuality is all that is important to them, which has caused lack of self- confidence in women and causing them to engage in unnatural methods of trying to fit gender stereotypes. In conclusion, I believe the City of Edina should begin an initiative by taking a stand against the inhumane gender stereotypes that have begun to define our world. The biggest misunderstanding about gender stereotypes is that no one fits them because they are unrealistic and everyone struggles with them. Therefore, the most efficient way to solve the gender stereotype crisis is by educating our children from a very young age in schools how to know that gender stereotypes should not influence their decisions, because they are unrealistic. The defacement included names of school officials, graffiti and two hateful words. Three students were identified within a week by the Police Department and School officials. They have been referred to the Hennepin County Attorney's Office. The HRRC and City officials believe that a survey of City Departments should be undertaken to determine if other events or actions of this type have occurred or hateful words used in or during interactions with the Public. Based on findings of these conversations, other initiatives may be taken by the City. Our goal is to gather information from City Department staff & officials having contact with the Public. This information may form the basis of recommendations designed to reduce or eliminate such hateful occurrences in the future. Members of the HRRC will interview selected staff of City Departments together with a review of reporting forms, procedures and notes which may show: (i) incidents of human rights intrusions, insensitive behavior patterns or violations of policies or law within City Departments (ii) whether City staff interacting with the Public have encountered hatefful actions or behavior in the course of performing their duties (iii) whether further information or action should be recommended to City staff and/or the Mayor and Council. Further information gathering may 29 include outreach to the School District for further cooperative programs with student and parent organizations. NOTE: the HRRC is in the process of its annual review of the City's Bias/Hate Crime Prevention Plan as a part of this Process. Internal Department Experience During this conversation, there was no recollection of any staff -to -staff complaints of a bias/hateful nature. The Department follows a policy of employees directed to access their supervisors director if there is an issue about which they are concerned. Most often, issues which do arise are dealt with between the supervisor and the employee or with the participation of the HR Director. This is established protocol for all City employees. Interactions With the Public In the Department, most interactions with the public occur in the office of the City Clerk and in the Edina City Liquor Stores. The City Clerks Office has not had any records indicating biased or hateful interactions between staff and the public. Mr. Grausam of the Liquor Store Operations noted that the mandatory ID checking of customers judged to be under 40 years of age can cause negative reactions from customers at times. If a customer who is judged to be under age 40 is asked for their ID and cannot produce it, they will not be able to make their purchase. If the customer is a member of a protected class (race, sexual orientation, ADA, etc.) they may on rare occasions allege that the reason for being denied a purchase is something other than their age. Mr. Grausam indicated that the most frequent problem at the Southdale store had been attempted thefts of alcohol. Since the store was remodeled in 2011 (with an effort to design 31 spaces and aisles easily visible to the staff) the incidence of attempted thefts has decreased dramatically, from 6/year in 2011 to 1/year in 2012. Recommendation We recommend a city wide departmental report form be used similar to that developed by the Parks and Recreation Department and that an annual tabulation of incidents be given to the City Manager for transmission to the HRRC, Mayor and City Council. 32 HRRC MEETING REPORT PARKS AND RECREATION DEPARTMENT Date: October 24, 2013 Attendees: Arnie Bigbee, Chair and Steve Winnick, Member, HRRC Ann Kattreh, Director and Kristin Aarsvold, Recreation Supervisor At the request of the Mayor and City Manager, this meeting was held for the purpose of determining whether hateful or otherwise inappropriate behavior has been observed or experienced within City Departments. Meetings with each Department head and key management personnel will focus on both staff to staff experiences and staff interaction with the public. These meetings are intended to provide the Mayor, City Council, City Manager and HRRC with current data on these issues from the City's perspective following the August 11 defacement of South View Middle School. Internal Department Experience No hateful or otherwise inappropriate experience was reported involving City employees' behavior toward one another. Interactions with Public Ms. Aarsvold began by stating that the Department employs approximately 50 part-time staff to work with various program, primarily in the summer. She described the training she and other staff provide for these part-time employees including: • City of Edina Park and Recreation Bullying Policy and bullying report form • Behavior Management and Reporting incident/accident log • Youth Sports Core Values and Community Strategy • Edina Youth Sports Code of Conduct brochure All of these policies/documents are communicated to youth and adult program participants, coaches and parents and sponsoring organizations, if any. The expectation is positive with staff being coached to model respect and fun in a game environment that is often competitive. The practice is to encourage mutual support to the extent that participants are discouraged from being "bystanders" (those who observe a person being bullied or otherwise mistreated but do nothing to intervene). Followup with parents is recommended in recurring cases. Ms. Aarsvold said there have been no reports of bullying since the policy was implemented. Youth sports organizations which reserve Park and Recreation facilities receive a copy of the Bullying Policy and Code of Conduct brochure. 33 Ms. Aarsvold also stated that there are two Edina sports facilities which are co -owned by the City and the Edina School District, both of which are in school buildings. Reservations and conditions of facility use are the responsibility of the School District. It is not know what information/guidance/expectations are provided to the user groups arranging use of those two facilities. The Amateur Athletic Union (AAU) is a major user of the facilities. Training of their coaches in bullying and behavior management, along with reporting, when using Edina Park and Recreation facilities, is not known. Ms. Kattreh noted that there have been incidences of abuse of Park and Recreation properties, but none that have risen to the level of being biased or hateful. Recommendation We recommend a city wide departmental report form be used similar to that developed by the Parks and Recreation Department and that an annual tabulation of incidents be given to the City Manager for transmission to the HRRC, Mayor and City Council. 34 City of Edina Park and Recreation Bullying Policy Definition of Bullying Bullying is behavior that is intentional, repetitive and hurtful resulting in an imbalance of power between the bully and the target (Braaten, 2010). Bullying can take many forms, such as hitting or punching (physical bullying); teasing or name-calling (verbal bullying); intimidation using gestures or social exclusion (non-verbal bullying or emotional bullying); and sending intimidating messages through technology (cyber bullying). Policy Statement Bullying is prohibited at all city parks and/or city facilities. This policy applies not only to a participant who directly engages in an act of bullying but also to participants who, by their indirect behavior, condone or support another participant's act of bullying. No city employee, volunteer, contractor, shall permit, condone, or tolerate bullying. A person who engages in bullying or tolerates bullying will be subject to discipline in accordance with city policies and procedures. The city may take into account the following factors: 1. The developmental and maturity levels of the parties involved; 2. The levels of harm, surrounding circumstances, and nature of the behavior; 3. Past incidences or past or continuing patterns of behavior; 4. The relationship between the parties involved; and 5. The context in which the alleged incidents occurred. Consequences for participant(s) who engaged in an act of bullying may range from behavioral interventions up to and including immediate removal from the program or facility. Immediate removal from program activity is warranted if the participant physically attempts to cause injury to him/her or others, or leaves the designated program area with the intent to run away or hide from staff. The city will act to investigate all complaints of bullying and will take appropriate action against any participant, city staff, volunteer, contractor who is found to have violated this policy. Reporting Procedure Any person who believes he or she has been the victim of bullying or any person with knowledge or belief of bullying will report the alleged acts to an appropriate City staff. The City encourages the reporting party to use the report form available from the City Park and Recreation office. The Recreation Supervisor is the person responsible for receiving reports of bullying in city parks and programs. Any person may report bullying directly to the Park and Recreation Director or City Manager. City Action When a complaint or report of bullying is received, the City will begin an investigation. Upon completion of the investigation, the city will take appropriate action on a case by case basis. City staff will notify the individual adult participant(s) or parent(s)/guardian(s) of youth participants involved in a bullying incident and action taken based on a confirmed report. Training and Education The City will provide information and training to city employees regarding this policy. Remind participants that the leaders reserve the right to make up rules on the spot whenever You see the need. Rules should start with "Do" for example "Do listen when the leaders are talking," "Do respect others" "Do Play Fair" Behavior Management Techniques: I. Reinforce positive behavior immediately and OFTEN!!! Create an environment of praise! 2. Run an action packed park, when kids have down time negative behaviors often occur. 3. Distraction: Sometimes the simplest way of correcting behaviors is to begin activity. Start a new activity or try a new approach to the activity. WATCH FOR signs of BOREDOM!! 4. Interference: A staff may interfere verbally by letting a child know that his/her behavior is It; the rules". 5. Redirect Tell your participants that there will be a break every time a rule is broken. Breaks take place on the sidelines of the game or wherever the leader decides. Once it starts it can end, so you decide when it starts and when it ends." The break lasts 30 seconds, thank participant and welcome back into the game. You deliver no judgment, no discussion, no energy to negativity. Kids can learn to take their own breaks when they are "wound up" and Leaders can take a break too!! • Never shame children. • Never resort to physical punishment. • Never lose control of yourself. BE FIRM about rules and consequences— broke a rule— take a break. Talk with your Site Leader- if you have been having issues with participants. For any unusual occurrence that happens such as damage to equipment, fighting, parent problems, etc, your supervisor should be notified immediately. Immediate removal from program activity is warranted if the participant physically attempts to cause injury to him/herself or others, or leaves the designated program area with the intent to run away or hide from staff. Document in writing in the Incident logs in your park binder, be objective. When we are having ongoing concerns with a participant these notes are needed to show a history of issues and can help us see a pattern of behavior and possibly what might be triggering that behavior. We can work to create a plan of action to ensure success. Communicate with Co-workers and Supervisors: Inform your co-workers of behavior issues at the end of the day, make sure you have talked through a plan for the next session. Don't let problems go unresolved; this includes any issues you may have with your co-workers. All behavior is communication. Children misbehave because they lack the communication skills and insight to tell us what is really happening. It is our job to look beyond the behavior. Triggers to behaviors often happen outside our program control (temperature, hungry, bad day at home, missed a play at the baseball garne, sensory input, lack of skills and embarrassment.) Internal Department Experience Lieutenant Nibbe indicated that he has forwarded a copy of the Bias/Hate Crimes Process to all officers of the Edina Police Force on October 28, 2013. This will ensure that each officer is up to date in their awareness of this process. He indicated that an informal inquiry of several individual officers indicated that they were aware of the current process. He indicated that, like the Fire Department staff, the force is primarily caucasian. He could not recall any incidents of staff -to -staff expressions of bias or hateful words or actions. He also referenced the current City of Edina Values training for all employees which emphasizes Integrity, Quality and Service (IQS). Interactions With the Public Having been with the department for over three decades, Lieutenant Nibbe said he could only recall one incidence of an individual claiming that their interaction with the department was biased because of race. This was over a decade ago and the claim was found to be without merit. He also noted that in 2010 there were two incidences of a swastika being placed in Edina, one "keyed" on the side of an automobile and the other being painted graffiti on public property. In this regard, an incident which includes swastikas (a well known symbol of hate against Jews, gays and people of color) was not just vandalism. An incident like this should have been reported immediately to invoke the Bias/Hate crimes process, engaging the HRRC and others in Edina for conversations, actions and resolution. 41 Recommendation We recommend a city wide departmental report form be used similar to that developed by the Parks and Recreation Department and that an annual tabulation of incidents be given to the City Manager for transmission to the HRRC, Mayor and City Council. NOTE: The August South View Middle School graffiti/vandalism incident was the focus of a recent Police Department internal communication reminding officers of City's Bias - Hate Crime Policy Plan and procedure. The Department determined that the "victim" of that incident was the School District and not the public generally. This finding should be reviewed whenever an incident under the Plan occurs. 42 HRRC — This is the email that was sent to the Sergeants to make sure their teams were up to speed on the Bias Crime reporting policy. We would usually due this during day time hours from the detective division unless the chief already had contact with City Administration. That being said, there was a concern after Southview Jr. High was spray painted that the HRRC was not informed in a timely manner. (We determined it wasn't a bias crime and the school district —victim - didn't want it classified as one.) I will be working on this to find out what is timely and where the lines get drawn. Meetings with each Department head and key management personnel focus on both staff to staff experiences and staff interaction with the public. These meetings are intended to provide the Mayor, City Council, City Manager and HRRC with current data on these issues from the City's perspective following the August 11, defacement of South View Middle School. Internal Department Experience No hateful or otherwise inappropriate experience was reported involving City employees' behavior toward one another. It was noted that the Department consists of all white males, with exception of one "on call" EMT, who is female. All full time Edina firefighters are certified Emergency Medical Technicians. Interactions with Public Because of the nature of the work of the Department, occasional inappropriate comments or angry outbursts are directed to Fire Department Emergency Medical personnel. With one exception, nothing "out of the ordinary" has been noted. No statistics are kept or reporting systems used to track this behavior. However all 44 complaints are logged into the Chief's computer. The majority of complaints received are for the cost of the EMT service, which is passed on to the patient or his/her insurer(including Medicare). Significant Behavior A customer service complaint was related that occurred a year or so earlier in which an EMT allegedly kicked or nudged a patient with his foot to determine if the patient was conscious. A lawsuit against the City ensued which was resolved and included the requirement of internal staff training and discipline to the EMT. At the request of the Mayor and City Manager, this meeting was held for the purpose of determining whether hateful or otherwise inappropriate behavior has been observed or experienced within City Departments. Meetings with each Department head and key management personnel focus on both staff to staff experiences and staff interaction with the public. These meetings are intended to provide the Mayor, City Council, City Manager and HRRC with current data on these issues from the City's perspective following the August 11 defacement of South View Middle School. Internal Department Experience No hateful or otherwise inappropriate experience was reported involving City employees' behavior toward one another. Interactions with Public Because of the nature of the work of the Department, occasional inappropriate comments or angry outbursts are directed to City staff. Nothing "out of the ordinary" has been noted. Very occasionally, frustrated citizens objecting to street closures, detours or temporary obstructions will express themselves inappropriately. Staff is prepared for this, according to Director Olson. He stated that "this goes with the job". No statistics are kept or reporting systems used to track this behavior. 46 Significant Behavior Director Olson noted that graffiti painted on Park buildings, benches and under bridges has increased to about "twelve or so" this year to date; from 8 in 2012 and 3 incidents in 2011. Total costs to the City for cleanup has been approximately $13,000 year to date. The words spray painted include: "NOS", "HERR", and "SPOOR". In past years the "N" and "F" words have been seen (no actual number of incidences are compiled). Photos of graffiti appearing this year are attached. The principal locations for spray painting are: the 50th and France area, under railroad and highway bridges, on railroad property and on public park and playground properties (for which the Public Works Department now has the responsibility of maintaining). I don't care which way he votes, but I do find him misguided if he thinks writing strong language against the editor is the best way to represent his belief. You wrote a ridiculous line in your letter: "Everyone in our community — Planet Earth — deserves to be accepted, respected and have full participation." I was basically writing the same thing. The people who voted yes should not project hate at those who voted no. By equal measure, those who voted no should not go out of their way to make sure every publication writes about how terrible they are for voting yes. It doesn't make any sense for either side to say, "because I love everyone, I'm going to hate 'that' group of people." It goes both ways and people need to remember that standing for something doesn't mean you need to focus your energy on hating it's opposition. And neither side should seek out conflict with the other at every chance they get. Both sides can have an opinion and it's okay for the Sun Current to just write an article that doesn't intentionally spark controversy. I thought it was very rude of Anthony to pick on the editor and make demands of what they choose to write. Then I read your letter today. I'm stunned that a group of adults made the decision to so carelessly throw my name into their letter. You wrote a lengthy reply about the unenlightened, and chose to call me out by name for my defense of the editor???? That seems highly misguided and down -right slanderous in my opinion. When you are writing about people and using them by name, take time to think. Consider what it was I wrote and whether it really needs a rebuttal. The issue is not Chick-fil-A, rather it is the lack of respect and acceptance for GLBT persons. First, both writers need to get some factual information about GLBT people. They are not choosing a "lifestyle," as Mr. Green implied. A visit to the public library or with staff at Outfront Minnesota or students at their community high schools who are members of the Gay -Straight Student Alliance are excellent learning resources. Second, when any person or group of persons among us is treated differently for being who they are, that is discrimination. It may begin with, "I don't agree with you" but often moves to "I don't want you here" and "you don't belong here." Then there is the bullying, both verbal and physical, and a cycle of behaviors that can have tragic consequences for the bullied and the bully. Third, and most important, we are all together on this planet and it works best when we lock arms together to deal with everyday things — good health, adequate nourishment, good education, a warm place to sleep and a job that enables us to support ourselves and our families.
