GRANT OF PERMANENT EASEMENT
Christopher B. McClain and Carolyn McClain, husband and wife, "Grantor's", in
consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant unto the CITY OF EDINA, a
Minnesota municipal corporation, the Grantee, hereinafter referred to as the "City", its
successors and assigns, a permanent easement for an 8 inch sanitary sewer line over, on, across,
under and through the land situated in the County of Hennepin, State of Minnesota, and legally
described on the attached Exhibit "A".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the permanent easement premises at all reasonable times to construct, reconstruct, inspect,
repair, and maintain said 8 inch sanitary sewer line over, across, on, under, and through the
permanent easement premises, together with the right to grade, level, fill, drain, and excavate the
permanent easement premises, and the further right to remove trees, bushes, undergrowth, and
other obstructions interfering with the location, construction, and maintenance of said 8 inch
sanitary sewer line easement. Grantee agrees to pay for removal of any improvements within the
easement area such as trees, landscaping and fencing and will restore the grade of the lands to its
current condition.

The above named Grantor, for itself, its successors and assigns, does covenant with the
City, its successors and assigns, that it is well seized in fee title of the above described easement
premises; that it has the sole right to grant and convey the easement to the City; that there are no
unrecorded interests in the easement premises; and that it will indemnify and hold the City
harmless for any breach of the foregoing covenants.

All that part of Lot 51, 52, 53 and 54, Auditor's Subdivision No. 161, Hennepin County,
Minnesota, lying between the Southwesterly line of Lot 50, said Subdivision extended and a line
51 feet Northerly of said Southwesterly line of said Lot 50 and parallel thereto, also extended,
and;
The Westerly or Southwesterly 51 feet of Lot 50, Auditor's Subdivision No. 161, Hennepin
County, Minnesota. Said easement is described as follows:
The Northeasterly 5.00 feet of the following described property:
The Southwesterly 51.00 feet of said Lot 50 and that part of said Lots 52, 53 and 54, lying
between the Southwesterly line of said Lot 50 extended Southeasterly and a line parallel with
and 51.00 feet Northeasterly from said Southwesterly line of said Lot 50 extended

I am returning to you an original recorded Grant of Permanent Easement
which we received from Hennepin County yesterday. Please note that the Grant of
Permanent Easement is from Christopher and Carolyn McClain to the City and was
recorded April 30, 2013, as Document No. T05071134.
Our office did not draft this document (even though the "Drafted By" clause
indicates that we did), nor did we send it to the County for recording. Would you
please forward this to the appropriate department in the City.
