GRANT OF PERMANENT EASEMENT
INDEPENDENT SCHOOL DISTRICT NO. 273, an independent school district created
and existing under the laws of the State of Minnesota hereinafter referred to as "Grantor", in
consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant unto the CITY OF EDINA, a
Minnesota municipal corporation, the Grantee, hereinafter referred to as the "City", its successors and
assigns, forever, permanent easements for public watermain and storm sewer purposes over, across,
on, under, and through land situated within the County of Hennepin, State of Minnesota, as described
on the attached Exhibit "A" and depicted on the attached Exhibit `B".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter upon
the easement premises during non -peak traffic periods (the peak traffic periods are defined below),
after providing reasonable notice to Grantor to construct, reconstruct, inspect, repair, and maintain
said public watermain and storm sewer systems over, across, on, under, and through the easement
premises, together with the right to grade, level, fill, drain and excavate the easement premises, and
the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the
location, construction, and maintenance of said public watermain and storm sewer systems. The peak
traffic periods for bus and car traffic to and from the Grantor property during which the City shall not
enter the Easement, except in the event of an emergency, are the following time periods that occur
Monday through Friday during the months of January, February, March, April, May, June 1 through
June 15, and the months of September, October, November and December of each calendar year
during the term of this Easement:
a. 6:30 a.m. — 7:30 a.m.
b. 9:00 a.m. —10:00 a.m.

C. 2:00 p.m. — 3:00 p.m.
d. 4:00 p.m. — 5:00 p.m.
The above named Grantor, for itself, its successors and assigns, does covenant with the City,
its successors and assigns, that it is well seized in fee title of the above described easement premises;
that it has the sole right to grant and convey the easements to the City; that there are no unrecorded
interests in the easement premises.

TO
GRANT OF PERMANENT EASEMENT
A 20.00 foot permanent easement for watermain purposes over, under and across part of Lots 3, 4,
5, 10 and 11, Block 7, Edina Interchange Center, according to the recorded plat thereof, Hennepin
County, Minnesota. The center line of said easement is described as commencing at the southwest
corner of said Lot 10; thence South 89 degrees 31 minutes 01 second West on an assumed bearing
along the south line of said Lots 10 and 11 a distance of 215.26 feet to the point of beginning of the
center line to be described; thence on a bearing of North 124.90 feet to a point hereinafter known
as Point A; thence on a bearing of West 117.93 feet; thence North 45 degrees 14 minutes 30
seconds West 34.30 feet; thence North 0 degrees 28 minutes 59 seconds West 100.25 feet to a
point hereinafter known as Point B; thence continuing North 0 degrees 28 minutes 59 seconds
West 415.71 feet to a point hereinafter known as Point C; thence continuing North 0 degrees 28
minutes 59 seconds West 43.78 feet; thence North 46 degrees 14 minutes 41 seconds East 48.22

Together with a 20.00 foot permanent easement for watermain purposes over, under and across
that part of said Lot 3, the center line of said easement is described as beginning at said Point C;
thence South 89 degrees 31 minutes 01 second West 69.24 feet and said center line there
terminating.
A 20.00 foot permanent easement for storm sewer purposes over, under and across part of Lots 3, 4
and 5, Block 7, Edina Interchange Center, according to the recorded plat thereof, Hennepin
County, Minnesota. The center line of said easement is described as commencing at the northwest
corner of said Lot 3; thence South 0 degrees 28 minutes 59 seconds East on an assumed bearing
along the west line of said Lot 3 a distance of 99.53 feet to the point of beginning of the center line
to be described; thence on a bearing of East 16.61 feet; thence North 0 degrees 28 minutes 59
seconds West 89.67 feet to a line 10.00 feet south of and parallel with the north line of said Lots 3,
4 and 5; thence North 89 degrees 31 minutes 01 second East along said parallel line 430.61 feet
and said center line there terminating.
