KNOW ALL MEN BY THESE PRESENTS: That Nine Mile Village, A Limited Partner-
ship, Leonard L. Gasparre and Harold B. Dokmo, .Jr., General Partners, owners
and proprietors, and The First National Bank of St. Paul, duly organized and
existing under the laws of the United States of America, mortgagee of the
following described property lying and being in the County of Hennepin, State
of Minnesota, to wit:
That part of Government Lot 1, Section 5, Township 116, Range 21 described
as commencing at a point on the East line of said Government Lot 1 distant
33 feet South from the Northeast corner of said Government Lot 1; thence
West parallel with the North line of said Govern:r.ent Lot 1, a distance of
140.33 feet to the actual point of beginning; thence West parallel with said
North line, a distance of 124.17 feet; thence Southwesterly along a tatigen-
tial curve to the left, having a radius of 200 feet and a central angle of
73 degrees 04 minutes 24 seconds, a distance of 255.07 feet; thence South-
westerly tangent to said curve, a distance of 28 feet; thence Southwesterly
along a tangential curve to the right having a radius of 539.86 feet and a
central angle of 45 degrees 15 minutes a distance of 426.36 feet; thence
Southwesterly tangent to the last described curve, a distance of 406 feet;
thence Westerly along a tangential curve to the right having a radius of
254.81 feet to the West line of said Government Lot 1; thence South along
said West line to the Northerly right-of-way line of County Road Number 62,
said Northerly right-of-way line being a line bearing North 78 degrees 48
minutes 33 seconds West (assuming the East line of the Northwest Quarter of
said Section 5 as bearing North and South) from a point on the East line of
the Northwest Quarter of said Section 5 distant 1427.34 feet South from the
Northeast corner of said Northwest Quarter.; thence Easterly along said
Northerly right-of-way line to its intersection with a line drawn South par-
allel with the East line of said Government Lot 1 from the actual point of
beginning; thence North along the last described parallel line to the actual
point of beginning, according to the Government Survey thereof. Have caused
t -ie same to be surveyed and platted as NINE MILE VILLAGE and do here=by donate
and deducate to the public for public use forever an easement for utility
purposes, overhead utilities are not included, under and across all of the
following lots as shown on the plat: Lot 5 of Block 1, Lot 6 of Block 2, Lot
5 of Block 3, Lot 7 of Block 4, Lot 7 of Block 5, Lot 5 of Block 6, Lot 5 of
Block 7, Lot 7 of Block 8, Lot 7 of Block 9, Lot 5 of Block 10, Lot 4 of
Block 11, Lot 4 of Block 12, Lot 5 of Block 13, Lot 6 of Block 14, Lot 6 of
Block 15, Lot 5 of Block 16, Lot 6 of Block 17, Lot 5 of Block 18, Lot 5 of
Block 19, Lot 8 of Block 20, Lot 5 of Block 21, and Lot 1 of Block 23 as
shown on the plat.
