GRANT OF PERMANENT EASEMENT
THEODORE STUTSMAN, TRUSTEE OF THE E. M. STUTSMAN TRUST UNDER
AGREEMENT DATED DECEMBER 5, 2006, AS AMENDED, hereinafter referred to as
"Grantor", in consideration of One Dollar ($1.00) and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, does hereby grant unto the CITY OF
EDINA, a municipal corporation organized under the laws of the State of Minnesota, the Grantee,
hereinafter referred to as the "City", its successors and assigns, forever, a permanent easement for
public street and water main purposes over, across, on, under, and through land situated within the
County of Hennepin, State of Minnesota, as described on the attached Exhibit "A" and depicted on
the attached Exhibit "B".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
} upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public street and water main systems over, across, on, under, and through the
easement premises, together with the right to grade, level, fill, drain and excavate the easement
premises, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, construction, and maintenance of said public street and water main
systems.
The above named Grantor, for himself, his successors and assigns, does covenant with the
City, its successors and assigns, that he is well seized in fee title of the above described easement
premises, subject to existing mortgages(s); that he has the sole right to grant and convey the
easement to the City; that are no unrecorded interests in the easement premises.

AFFIDAVIT OF TRUSTEE

Theodore Stutsman, being first duly sworn on oath, says that:
1. Affiant is the Trustee named in that certain Certificate of Trust to which this Affidavit is
attached ("Trust Instrument"), which Certificate of Trust was executed by Affiant and
which relates to real property in Hennepin County, Minnesota, legally described as
follows:
An undivided one-fourth interest in: Lot 10, Auditor's Subdivision No. 319,
Hennepin County, Minnesota.
2. The name and address of each Trustee empowered to act under the Trust Instrument at
the time of the execution of this Affidavit is:

3. The Trustee who has executed that certain instrument relating to the real property
described above, between Theodore Stutsman, Trustee of the E. M. Stutsman Trust under

(a) is empowered by the Trust Instrument to sell, convey, pledge, mortgage, lease, or
transfer title to any interest in real property held in trust; and

(b) is the only Trustee required by the Trust Instrument to execute and deliver such an
instrument.
4. The Trust has not terminated and the Trust Instrument has not been revoked.
5. There has been no amendment to the Trust Instrument which limits the power of the
Trustee to execute and deliver the instrument described in paragraph 3.
6. The Trust is not supervised by any Court.
7. Affiant does not have actual knowledge of any facts indicating the Trust is invalid.
