Conditional Use Permit for Christian Family Church at 7375 Bush Lake Road, Edina, MN Staff Presentation Planner Teague informed the Commission that Christian Family Church is proposing to remodel the interior of the existing office building at 7375 Bush Lake Road into a Church. The church would hold services Sunday mornings and Wednesday evenings. They have 200 members in their congregation including children. There would be classrooms for children education within the building that would also take place primarily Sunday and Wednesday's. The proposed sanctuary would seat 360 people maximum, which would provide an opportunity for the congregation to grow in size. The required number of parking stalls for churches is one space per three seats in the largest place of assembly. Additional spaces may be required for other uses that take place at the same time. There are 170 parking stalls on the site today. There are no exterior alterations proposed to the building or the site. To accommodate the request, the following is requested: • Conditional Use Permit for the church. Churches are conditionally permitted uses in all zoning districts Planner Teague concluded that staff recommends that the City Council approve the Conditional Use Permit for Christian Family Church at 7375 Bush Lake Road. Approval is subject to the following findings: The proposal meets the conditional use permit criteria in Section 36-305 of the City Code as follows: a. Does not have an undue adverse impact on governmental facilities, utilities, services or existing or proposed improvements; b. Will generate traffic within the capacity of the streets serving the property; c. Does not have an undue adverse impact on the public health, safety or welfare; d. Will not impede the normal and orderly development and improvement of other property in the vicinity; e. Conforms to the applicable restrictions and special conditions of the district in which it is located, as imposed by this chapter; and f. Is consistent with the comprehensive plan. Final approval is subject to the following Conditions: I. Subject to staff approval, the site must be developed and maintained in substantial conformance with the following plans, unless modified by the conditions below: • Site & building plans date stamped June 17, 2016. • Building materials board as presented at the Planning Commission and City Council meeting. 2. Appearing for the Applicant Dr. Tim Peterson, applicant Discussion and Comments • A question was raised on how the City defines places of worship in the Code. Planner Teague responded that a number of the City's zoning districts allow religious institutions, including churches, etc. as a conditional use. He said religious institutions are conditionally permitted in all residential districts, adding language varies per district. • It was asked if hours of operation can be limited. Planner Teague responded that in the residential districts there can be limitations placed on hours of operation. • Planner Teague was asked if the City received any feedback from neighbors. Planner Teague responded he doesn't believe the City has received any comments on the request, adding residents were notified and a sign was posted. Applicant Presentation Dr. Peterson introduced himself and his wife, Shireen and explained he has been a pastor for 35 years and has a Church in Owatonna. He added what they would like is to find a permanent home in the metro area and hope that home is here. Dr. Peterson was asked if the entire building would be used as the church. Dr. Peterson responded in the affirmative. He said the building would be renovated; and used for church purposes (office, classrooms) and hopeful growth. Dr. Peterson was further asked if there would be overnight stays at the church. Dr. Peterson responded that he believes the children's group has an overnight once a quarter. Public Hearing Chair Platteter opened the public hearing. No one spoke to the issue. A Motion was made by Commissioner Thorsen to close the public hearing. The motion was seconded by Commissioner Strauss. All voted aye. The motion carried. Motion Motion was made by Commissioner Thorsen to recommend approval of the Conditional Use Permit for 7375 Bush Lake Road based on staff findings and subject to staff conditions. SUPPORTING INFORMATION Surrounding Land Uses Northerly: Office/light industrial building; zoned PID, Planned Industrial District and guided Industrial. Easterly: Office/light industrial building; zoned PID, Planned Industrial District and guided Industrial. Southerly: Office/light industrial building; zoned PID, Planned Industrial District and guided Industrial. Westerly: United States Post Office; zoned PID, Planned Industrial District and guided Industrial. Existing Site Features The subject property is 4.5 acres in size, contains the office building. There are large green spaces with mature trees and a wooded area in the northeast corner. Planning Guide Plan designation: I — Industrial Zoning: PID, Planned Industrial District Site Circulation & Traffic There are currently three curb cuts to the site; they would all remain as is. There are no changes proposed for site circulation. WSB conducted trip generation study to determine impacts to the roads. (See page Al2.) The study concludes that there would be less traffic during the week from the site, but more on the Sundays when the office/industrial park is generally closed. Therefore, there would be no impact to the existing road network. Parking The number of parking spaces required is based on the seating capacity of the largest place of assembly which is the sanctuary. The Code requirement is one stall per three seats. The capacity of the proposed sanctuary is 360 people; therefore, the required number of stalls is 120. There are 170 parking stalls on the site; therefore, any extra activities that are taking place at the same time as the church would be accommodated. If additional parking were ever needed, there is a lot of excess green space that could be converted to parking. It is not anticipated to be needed. Landscaping Based on the perimeter of the site, the applicant is required to have 46 over story trees over the entire site. The site currently contains 44 over story trees. Therefore, as a condition of any approval, an additional two (2) over-story trees should be planted to conform to the minimum requirement. (See page A9.) Building/Building Material No changes would be made to the exterior of the building. 2 Conditional Use Permit Per Section 36-305, a conditional use permit shall meet the following: 1. Does not have an undue adverse impact on governmental facilities, utilities, services or existing or proposed improvements; 2. Will generate traffic within the capacity of the streets serving the property; 3. Does not have an undue adverse impact on the public health, safety or welfare; 4. Will not impede the normal and orderly development and improvement of other property in the vicinity; 5. Conforms to the applicable restrictions and special conditions of the district in which it is located, as imposed by this chapter; and 6. Is consistent with the comprehensive plan. Staff believes that the above criteria are met. Churches are an allowed use in all zoning district in the City. The site would not have an adverse impact on governmental facilities, utilities or services. The existing roads do, and can support the site. There would be no modifications to the building or site; there would be no impact on adjacent property. All minimum zoning ordinance requirements would be met. The traffic generated to and from the site would take place at off peak times compared to the rest of the industrial park. Traffic would mostly occur in the evenings and on Sundays, when there is very little traffic in the area. Yes, the proposal would not negatively impact the industrial district. There are no changes to the existing building or site plan. The traffic generated would take place in off-peak time compared to the majority of the industrial park. Per the requirements of a conditional use permit it can be determined that the project: 1. Does not have an undue adverse impact on governmental facilities, utilities, services or existing or proposed improvements; 2. Will generate traffic within the capacity of the streets serving the property; 3. Does not have an undue adverse impact on the public health, safety or welfare; 4. Will not impede the normal and orderly development and improvement of other property in the vicinity; 5. Conforms to the applicable restrictions and special conditions of the district in which it is located, as imposed by this chapter; and 6. Is consistent with the comprehensive plan. Edina, MN as a church facility. CFC holds services each Sunday morning at 10:45 am and mid-week services on Wednesday nights at 7:00 pm. Presently the congregation consists of 200 members including children. The location of 7375 Bush Lake Road is excellent for both the neighborhood of Edina and for CFC. CFC's traffic flow and meeting times are "opposite" of the businesses in the area,with the exception of the Minnesota Made Hockey School. CFC's traffic flow will occur on weekends and week nights while the business traffic flow will occur during the days. Christian Family Church's headquarters is in Owatonna, Minnesota where it just celebrated it's 35th Anniversary. The Owatonna campus bought the former Heritage Halls Airplane Museum next to Cabela's on Interstate 35. I presently serve as Lead Pastor for both the Owatonna and Edina campuses. CFC also has 6 other churches in southern Minnesota and several hundred churches in Central America, Russia, India and the Philippines.
