NOTICE IS HEREBY GIVEN that the City Council of Edina, Hennepin County, Minnesota, on December 18, 2012, adopted

GRANTING THE VACATION OF
PUBLIC UTILITY EASEMENTS FOR
6500 FRANCE AVENUE SOUTH AND 4005 65TH STREET WEST
WHEREAS, a petition was received on November 6, 2012, from the developer of 6500 France Avenue
South and 4005 65th Street requesting the vacation of existing public easements; and
WHEREAS, two weeks published and posted notice was given and the hearing was held on December
18, 2012, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and
WHEREAS, the City Council deems it to be in the best interest of the City and of the public that said
vacation be made; and
WHEREAS, the vacation of the easement are subject to developer relocating the 12 -inch diameter
watermain, dedicating easements over proposed watermain, rededicating a sanitary sewer easement over
existing sanitary sewer main located along southeasterly corner of 6500 France Avenue South, and relocating
any private utilities that might be located within existing easements; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin
County, Minnesota, that the following described easements are hereby vacated:

Deb and Bonnie,
The existing 5' easement along the southern line of the Edina Medical Plaza project will remain intact as the easement
vacation request does not include that easement. The vacation request only includes the sanitary and watermain
easements within the project and thus the 5' lot line easement will remain (the sanitary easement does overlap a
portion of the 5 lot line easement in lot 4 but as shown on the attached exhibit the 5' easement will remain from east to
west along the property line. I will also note that the gopher one field locate and survey indicated that existing electric
lines actually exists south of the lot line anyway (see attached survey).
I believe this info should address Xcel's questions, please let me know if you need any further info.

I recommend that you detail what you need retained to accommodate your facilities. If I am understanding it correctly

NOTICE IS HEREBY GIVEN that the City Council of the City of Edina, Minnesota will meet on December
18, 2012 at 7:00 P.M. in the Council Chambersat 4801 West 50th Street for a scenic and open space
easement to be vacated:
PROPOSED LEGAL DESCRIPTION OF utility easements TO BE VACATED:
That part of the easement for sanitary sewer and water main purposes in favor of the City of Edina, as
dedicated on the recorded plat of SOUTHDALE OFFICE PARK SECOND ADDITION, filed Nov. 24, 1959 per
Document No. 612617 and SOUTHDALE OFFICE PARK, filed July 30;1958 per Document No. 564707 lying
within the following described property:
All of Lot 4 and the Easterly 56.44 feet of Lot 3, Block 2, SOUTHDALE OFFICE PARK SECOND
ADDITION, Hennepin County, Minnesota.
And,
Lot 3, Block 2, except the Easterly 56,44 feet thereof, SOUTHDALE OFFICE PARK SECOND ADDITION,

said easement being described as follows:
An easement 18 feet in width over and across part of Lot 3, Block 2, SOUTHDALE OFFICE PARK
SECOND ADDITION, the centerline of said easement being described as follows:
Beginning at a point in the West line of said Lot 3 distant 30 feet South from the centerline of the
existing 18 foot Water Main Easement as recorded by Document No. 514203 and as shown on the
recorded plat of said SOUTHDALE OFFICE PARK SECOND ADDITION, thence running East parallel with
said existing Water Main Easement a distance of 104 feet and there terminating.
All of the easement for sanitary sewer system purposes in favor of the City of Edina as created and filed
June 26, 1974 per Document No. 1112031, lying within Lot 4 and the Easterly 56.44 feet of Lot 3, Block
2, SOUTHDALE OFFICE PARK SECOND ADDITION, Hennepin County, Minnesota, being described as
follows:
That part of Lot 4 and the East 56.44 feet of Lot 3, Block 2, SOUTHDALE OFFICE PARK SECOND
ADDITION lying South of the South line of the sanitary sewereasement as shown on the recorded
plat of SOUTHDALE OFFICE PARK SECOND ADDITION.
All of the easement for sanitary sewer purposes in favor of the City of Edina as created and filed per
Document No. 1112375 filed July 1, 1974, lying within Lot 3, Block 2, SOUTHDALE OFFICE PARK SECOND
ADDITION, Hennepin County, Minnesota, being described as follows:
The East 15 feet of that part of Lot 3, Block 2, SOUTHDALE OFFICE PARK SECOND ADDITION, lying
West of the East 56.44 feet thereof and lying South of the South line of the sanitary sewer easement
as shown on the recorded plat of SOUTHDALE OFFICE PARK SECOND ADDITION.
All persons who desire to be heard with respect to the question of whether or not the above proposed
street right of way and utility and drainage vacation is in the public interest and should be made shall be
heard at said time and place. The Council shall consider the extent to which such proposed street
vacation affects existing easements within the area of the proposed vacation and the extent to which
the vacation affects the authority of any person, corporation, or municipality owning or controlling
electric, telephone or cable television poles and lines, gas and sewer lines, or water pipes, mains, and
hydrants on or under the area of the proposed vacation, to continue maintaining the same or to enter
upon such easement area or portion thereof vacated to maintain, repair, replace, remove, or otherwise
attend thereto, for the purpose of specifying, in any such vacation resolution, the extent to which any or
all of such easement, and such authority to maintain, and to enter upon the area of the proposed
vacation, shall continue.
