This property is for the most part unusable because it lies under Indianhead Lake, the waters of which are, by law, controlled by the State of Minnesota. A corner of this property, however, is above the normal high water mark of Indianhead Lake and abuts the lot lines of: Lot 1, Block 2, Overholt Hills, Sally Addition owned by Henrik J. and Marrigje M. Oskam; and Lot 5, Block 1, Overholt Hills, James Addition owned by James R. and Beth D. Otto. There is no public access to that part of this property that lies above the normal high water mark. Over the last 20 or so years the abutting property owners have maintained this property as their own by filling part of it in when one residence was built; by seeding and landscaping part of said property to prevent erosion; by planting shrubbery and trees in keeping with the character of the neighborhood; by cutting down dead branches and dead trees; and by cutting down overgrown shrubs to minimize the hazard of fire in dry years. The undersigned owners of the abutting property would like to purchase the Northwesterly part of this property that lies above the high water mark of Indianhead Lake or in the alternative all of this property, the sale of either, to be subject to an easement in favor of the City of Edina for storm water 8 2A?ke y— storage purposes or for any other purpose useful to the City of Edina or its Park Department. Such a sale would benefit the residents of the City by returning this property to the tax rolls; by eliminating any legal liability of the City flowing from this property;' and by.eliminating the use of the City's assets and manpower in the maintenance of property not readily useable by its residents.
