Re: Liability Insurance for Non -Profit Sports
Associations
Dear Mr. Kojetin:
The City of Edina has previously required non-profit
sports associations to maintain liability insurance for claims
made by injured sports participants. The City has been advised
that the sports associations can no longer obtain this liability
insurance at a reasonable cost, if at all. The sports
associations have asked the City to drop the requirement that
they maintain liability insurance. In connection with this
request, the City has asked that we review recent statutes to
determine the liability of the City if the sports associations
no longer maintain liability insurance. In the following
discussion, I have analyzed the two most relevant statutes on
this topic.
First, Minnesota Statutes, §604.08(1) provides that no
volunteer athletic coach of a non-profit organization and no
community-based, voluntary non-profit athletic association or
any volunteer of such an association, is liable for monetary
damage to a player or participant caused as a result of the
individual's acts or omissions in providing service or assist-
ance to a player or participant. This section by its terms
protects volunteer coaches and non-profit sports associations
from such liability. This section may also provide immunity

Second, pursuant to Minnesota Statutes, §466.02 the
City of Edina would not be liable for injuries sustained by a
sports participant that occurred on the property provided by the
City for recreational purposes. Section 466.02 states the
general rule that every municipality is subject to liability for
its torts and those of its officers, employees and agents acting
within the scope of their employment or duties. However,
Section 466.03(6e) provides an exception to this general rule of
municipality tort liability. Subdivision (6e) states an
exemption for any claim based upon the construction, operation,
or maintenance of any property owned or leased by the
municipality that is intended or permitted to be used as a park,
as an open area for recreational purposes, or for the provision
of recreational services, if the claim arises from a loss
incurred by a user of park and recreational property or
services. Additionally, this subdivision has been drafted
broadly enough to protect the City from liability even if the
City does not own the recreational property, it is sufficient if
the City is merely leasing property for use as a recreational
field.
Both statutes are relatively new and are untested.
Therefore, whether or not they would hold up in a court action
or how they may be limited or interpreted, is not yet known.

RE: Edina Park Board Policy on Drugs in Sports
DATE: December 11, 1985
At the December 10, 1985, Edina Park Board meeting, the Edina Park
Board unanimously passed the enclosed policy statement regarding the
use of alcohol, drugs and tobacco in Edina's youth sports programs.
This policy was established upon request of all athletic associations
in a meeting held earlier this year with all Edina athletic association
presidents and Edina Park and Recreation Department staff. The newly
established policy is for the most part a duplicate of the Edina Hockey
Association's current policy. The Edina Park Board commended the E.H.A.
for their thorough and well thought-out policy.
The major impact of this policy is that it addresses both punishment
and rehabilitation for prohibited conduct. Plus, if a youth is found
in violation of the conduct rule, he or she becomes ineligible to par-
ticipate in all Edina youth athletic association sports programs that
he or she is registered in at that time.
Every Edina youth athletic association is encouraged to establish their
own alcohol, tobacco and drug policy that best applies to their partic-
ular sport. Please use these newly established Edina Park Board policy
guidlines as a minimum when establishing your own policy. We realize
that we must rely heavily on our volunteer coaches to help enforce these
policies and we strongly encourage all athletic associations to address
this matter at all of your coaches clinics.
If you have any questions or concerns about this policy, please call
me at 927-8861 ext. 231. We hope that this is the acceptable and work-
able policy that was requested earlier this year. Thank you for your
efforts in helping keep our young athletes healthy and drug free.

EDINA PARK BOARD POLICY STATEMENT REGARDING THE USE OF ALCOHOL, TOBACCO
AND DRUGS IN SPORTS
In efforts to eliminate the use of alcohol, tobacco, and drugs (when not
prescribed by a medical doctor) by young athletes in Edina's sports
programs, the Edina Park Board has established the following policy
guidelines.
Prohibited Conduct
Any Edina youth (under 19 years of age) sports participant shall not use or
consume, have in possession, buy, sell or give away any beverage containing
alcohol, tobacco• in any form, or marijuana or other substance defined by
applicable law as a drug (unless specifically prescribed by a medical doctor
for the player's own use) during games, practices, team trips, or any other
Edina youth sports function. Particiants who violate this rule shall be sus-
pended from participation in all Edina youth athletic association sponsored
activities for the time specified below:
a. First Violation
After confirmation of the first violation, the player shall lose eligi-
bility for the next two (2) consecuitve games or two (2) weeks of the
season, whichever is greater. If the incident is drug or alcohol related,
he/she must also visit with the Edina Chemical Health Counselor.
b. Second Violation
After confirmation of the second violation, the participant shall lose
eligibility for the next six (6) consecutive games or four (4) weeks
of the season, whichever is greater. He/she must also visit with the
Edina Chemical Heaith Counselor.
c. Third and Subsequent Violations ,
1. After confirmation of the third or subsequent violations, the
Participant shall lose eligibility in all Edina youth athletic association
programs for one full year.
2. If after the third violation, the individual becomes a participant
in a chemical dependency program or treatment program, the individual may
be certified for reinstatement in Edina youth sport activities after a
minimum period of six (6) weeks. Such certification must be issued by the
Director or a counselor of a chemical dependency center.
