City of Edina. S-77-1 Generally located at the northwest corner of Dewey Hill Road and Cahill Road. Refer to: Attached lot size graphic and proposed plat (two for the Chairman, so he can show his friends) Attached is a subdivision proposed by the City of Edina for a piece of property recently acquired for park purposes. The City does intend, however, to use the property on the west side of Amundson Road for single family homes and storm sewer ponds. The sizes of the three single family lots are consistent or greater than the lot sizes in the neighborhood. The use of Outlot A would be for storm sewer holding ponds, and the use of Outlot B would be for park and some ponding at the extreme southern end. Generally located south and west of Valley View Road. Refer to: Attached site plan and Environmental Quality Commission staff report. The proponent is requesting to have Outlot 1 of Iroquois Hills 4th Addition declared a buildable lot. This outlot is a remnant from the other Iroquois Hills additions, some of which were originally lowlands and were filled. Because this property is low, it also requires a flood plain permit (see attached staff report to the Environmental Quality Commission). In addition, this property will be considerably below the access road from • County Road 18 -to Valley View Road, should that access road ever be built. Recommendation: The staff would recommend denial at this time because there is no access to the site inasmuch as the required easement for Outlot 2 of this addition was never submitted for filing. • Should the property acquire the proper access in the future, it would still be the staff's recommendation that this property continue to be considered unbuildable, for the following reasons: 1. A flood plain permit could not be achieved because of the amount of fill already used for previous Iroquois Hills subdivisions. 2. The property is almost immediately adjacent to Nine Mile Creek and could not preserve a reasonable setback from that waterway. 3. Access to the property, even assuming proper easements were acquired, will be difficult if not impossible and will require greater amounts of fill. In connection with this recommendation, the Planning, Commission should also be aware that there is another outlot in the same ownership, again remaining from prior Iroquois Hills developments. Refer to: Attached graphic Iroquois Hills 4th Addition was platted in 1966 by the proponent into nine single family lots and one outlot. The proponent also platted Iroquois Hills 5th Addition, located directly westerly of the 4th -Addition, in 1970. Nearly all of both additions were located within the flood plain of the Braemar branch of Nine Mile Creek. During the course of the development of the single family lots in the 4th and 5th Additions, a substantial portion of the flood plain was filled for construction purposes. Staff has met with staff of the Nine Mile Creek Water- shed District and has determined that more than 20 percent of the flood plain existing on the two parcels prior to subdivision in 1966 has been filled. The proponent is presently requesting that Outlot 1 of the 4th Addition be de- clared as a buildable lot. The attached graphic shows the location of the proposed dwelling to be constructed on the outlot. Access would be obtained from Valley View Road to the east. However, no easement has been recorded across the most southerly lot on Valley View Road for such access. Also, as shown on the attached graphic, the proposed access road to site nearly abuts Nine Mile Creek. RECOMMENDATION Staff recommends denial of the request in that: 1. The proposal is not in conformance with Nine Mile Creek Watershed District's policies and regulations in that more than 20 percent of the flood plain on the property has already been filled for construction purposes. 2. A flood plain permit would not be issued for the proposed dwelling due to the excessive encroachment. 3. The proposed access road provides an inadequate buffer between the road and the creek and apparently no road realignment is possible which would pro- vide a buffer area. Sponsel. Lot 10, Rolling Green. Generally located at 10 Merilane. Refer to: Attached graphic showing proposed division. The proponent is requesting to divide a double frontage lot so that the portion with the existing house faces Merilane and a new single family lot is created facing Paddock Road (see attached graphic). There have been approximately ten lot divisions in Rolling Green which have resulted in additional lots being created. This proposal would, however, result in the smallest lot and would be the only division in the original neighborhood (that generally south of the Robert Short parcel). The proponent has, however, met all of the requirements of the zoning and subdivision ordinances. This proposed division is complicated by the fact that deed restrictions limit this site to one buildable lot. This case is presently pending before district court. Recommendation: The staff would recommend that this matter be held over until such time as the district court makes its decision so that the property is not in the confusing position of having been divided by the City but not allowed to be divided by the courts. While the city generally considers deed restrictions to be a separate matter from our review of the appropriateness of the division, the staff feels that a short wait would be well worth the avoidance of the problem described. First, most of us purchased homes in the neighborhood because of the general character of the neighborhood principally related to the spacing of the homes, and, second, it was my understanding that this general chaxacter was to have been preserved through the original platting of the land. Certainly subdivision of very large lots, which preserve this general character, would have no deleterious effect on the neighborhood; however, unless some standards and guidelines are established, this and future changes could work against the general character of both the immediate neighborhood and the immediate community. It's my further understanding that the consensus of the immediate neighborhood is against subdivision, and to make changes without consideration to the wishes of these people would hardly be fair.
