Generally located north of Braemar Park, south and west of Valley View Road, and east of County Road 18. AND Z-75-5 Poppler Cardarelle Inc. (Iroquois Hills 6th Addition) Generally located north of Braemar Park, south and west of Valley View Road, and east of County Road 18. R-1 to R-2. Attached: location map. The proponents are requesting to subdivide and rezone this land into an out - lot and four double bungalow lots. The property itself is 100 percent flood plain and thus according to the Nine Mile Creek Watershed District regulations only 20 percent can be filled. According to the City requirements for a flood plain, land within a flood plain may not be filled without a flood plain permit. This property has absolutely no street access, although the proponent has shown a temporary drive immediately adjacent to Nine Mile Creek which would serve these eight units. This temporary drive would, of course, be located in the flood plain and, as the proponent has shown, would be on county property. Recommendation: The staff would recommend denial of the proposed subdivision and rezoning until such time as the property has access. The reason the property was originally identified as an outlot was because there is no access for it. In addition, the Southwest Edina Plan identifies this property as single family. However, at some future time when access is available it might be desirable to limit the building area and allow the proponent one or perhaps two double bungalow lots. Village plam.ning de"rtment Village of edina IF EDINA PLANNING COMMISSION STAFF REPORT May 28, 1975 S-75-11 Interlachen Hills 2nd Addition. Generally located south of the Interlachen Hills Apartments, east of County Road 18, and west of Malibu Drive. Attached: site plan and subdivision dedication report and map. The proponent is requesting to subdivide two non-contiguous parcels of land zoned in 1964. The easternmost parcel would be for six double bungalow lots and the westernmost parcel is being subdivided for the development of 40 apartment units. These proposed lots will front on Lincoln Drive and all automobile traffic from the development will be north to the 7th Street interchange. The staff has reviewed the preliminary building plans for each of these sites and has found that the proponent is requesting to subdivide within conformance of his building plans and city setback requirements. Recommendation: The staff would recommend approval of the proposed subdivision with the following contingencies: 1. that the parcels to be subdivided be split into two plats and given two separate titles such as Interlachen Hills 2nd Addition and Interlachen Hills 3rd Addition; and 2. That a 5% land dedication be contributed to the City. The developers should be required to prepare a deed for 13,600 square feet, located at the southern extreme of this property, adjacent to Nine Mile Creek (see attached subdivision dedication report and map). Generally located north of Vernon Avenue and east of Heather Lane. Attached: subdivision dedication report and area map. The proponents are requesting to subdivide an existing large lot into two single family lots. The lot sizes in the neighborhood vary from 11,000 to 30,000 square feet, with the average being about 16,000 square feet. The resulting lots, if this subdivision is approved, would be a 15,000 square foot lot and a 28,629 square foot lot. The Engineering Department has reported that all services are available for the property. Recommendation: The staff would recommend approval contingent on a 5 percent cash parkland dedication (per the attached subdivision dedication report). EDINA PLANNING COMMISSION STAFF REPORT May 28, 1975 S-75-9 Nagengast Addition. Generally located south of the Crosstown Highway and north of Doran Drive. Attached: survey showing proposed vacation, and subdivision dedication report. The proponents are requesting a three lot subdivision with lot sizes from 11,800 square feet to 13,600 square feet. The surrounding lots vary from 12,450 to 17,000 square feet, with two very large lots backing up to Nine Mile Creek in the one acre size range. Two outlots are also being created which will presumably be connected to an existing lot, which would benefit from the land addition. A part of Valley View Road is now being considered for vacation. If this is accomplished, that land should be platted in whith proposed lot 3 so the house could be located in a more desirable location and lot 1 could be enlarged.. Recommendation: Staff would recommend the proposal be tabled pending the outcome of the requested street vacation. Generally located north of the Londonderry townhouse development, east of Lincoln Drive and Nine Mile Creek. Attached: area map, copy of proposed plat, and subdivision dedication report. The proponents are requesting a six lot single family subdivision west of Park - wood Knolls on the "Dovre extension" to Lincoln Drive. The staff has the lot sizes (12,500 square feet) on the south side of the proposed road to be slightly smaller than the adjacent Parkwood Knolls addition but similar in size to the "Edina Green" plat which was recently approved by the Planning Commission. The lot sizes on the north side of the proposed road are very large (29,000 to 33,000 square feet) but 80 percent of these lots are in the flood plain. Nine Mile Creek Watershed District has reviewed and approved this plat subject to limiting the fill to 20 percent of the flood plain area. Further, the success of Bredesen Park (Mud Lake) hinges on controlling the amount of fill upstream from the park. Recommendation: The staff therefore recommends that: 1. Because the floodplain needs absolute protection from being filled, the north 150 feet of this site should be dedicated. The north side lots would then be about the same size as the south side lots. 2. Inasmuch as the floodplain is of no economic value for development because of the watershed's restrictions, an additional parkland dedication of 5 percent cash should be contributed (per attached report). The proponents are requesting a seven lot single family subdivision. The lots average 10,000 square feet, which is about the neighborhood average. This plat was approved by the Planning Commission in 1973, but on review by Tom Erickson, he recommended that the lots on the 30 foot part of Oak Lane be eliminated (see attached opinion). The proposed plat also shows no turn -around for large vehicles, therefore, a temporary cul-de-sac should be required until Oak Lane is completed. Recommendation: The staff would recommend that: 1. Hyde, Village Manager Page - 2 - Village of Edina Section 11 of Ordinance No. 811 (the Zoning Ordinance) defines a lot as a unit "of a recorded plat . . . having frontage on a public street." Also street is defined in Section 11 as "A public thoroughfare 30 feet or more in width." In Sec. 302 of the Uniform Building Code (adopted by Village Ordinance No. 403) the Building Inspector is to issue a permit when he is satisfied that the work to be done conforms to the Building Code and "other pertinent laws and ordinances . . . ." However, it is unclear if the word "pertinent" refers only to building code type ordinances or includes other ordinances of the Village. Based upon the foregoing, it is not certain that the Village may deny a permit for a lot on a street 25 feet in width. The Zoning Ordinance is not specifically carried into the Platting Ordinance for the purpose of determin- ing the adequacy of the plat. However, the Village should, and undoubtedly does, consider both in approving a plat. Therefore, the approval of a plat with lots on a street with less frontage than is required can, arguably, be approval of that lesser width, since one of the aspects to be considered by the platting ordinance is the "adequacy of streets." The Building Department, I am informed, does not normally concern itself with street widths when issuing permits on platted lots; presuming that, having been approved as a platted lot, it is entitled to a permit. Therefore, because of uncertainty as to denying a building permit, and because the street width is now less than 30 feet, it is my recommendation that the two lots in Austin's Replat which front on the 25 foot public street not be approved as platted lots at this time. Also, I am concerned with the designation of those lots as outlots since the status of an outlot, at this time, legally and administratively, within the Village, is also in doubt. Therefore, I recommend that those two lots not be shown as lots or outlots on the proposed plat, but be combined into an adjoining lot. In the future, once the street is extended to these lots, and of a prope-r width, the additional lots can be platted. Such a platting procedure would be no more difficult than if the lots were in fact, at this time, made outlots. However, as stated, their status would be clearer, Village control over them would be greater and the procedures to make them buildable lots would be more definite. If the Council now wishes to give both preliminary and final approval to Austin's Replat, eliminating the two lots which abut the 25 foot public road, then such final approval should be subject to the delivery to the Village of the required subdivision developer's agreement, park land (or cash in lieu thereof), and agreement relating to payment of special assessments. Attached: copy of preliminary plat and subdivision dedication report. The proponents are requesting a 17 lot single family home subdivision, the average lot sizes in which are 16,570 square feet. The majority of the lots are about 14,000 square feet. A generalized plan of this subdivision was presented to the Planning Commission at the time of the original M. P. Johnson's . platting. Since that time one additional subdivision has been approved in conformance with that preliminary plan. This proposal is in conformance with the original plan for the area. The developers are proposing to dedicate one acre or about 11.5 percent of their property for park purposes. This property is joined on the south and west by existing parkland (see attached subdivision dedication report). Recommendation: The staff would recommend approval of the proposed subdivision for the following reasons: 1. The lot sizes are in conformance with the lot sizes in adjacent subdivisions. 2. The proposal is in conformance with the original plan submitted. This recommendation is contingent on the submittal of a developer's agreement satisfactory to the Engineering Department, prior to final plat approval.
