COOPERATIVE AGREEMENT FOR COMMUNITY EDUCATION
AGREEMENT, made as of , 1974, between the
CITY OF EDINA, a Minnesota municipal corporation ("City") and INDEPENDENT
SCHOOL DISTRICT NO. 273, Hennepin County, Minnesota, a Minnesota municipal
corporation ("School District").
WHEREAS, the School District is organized for the purpose of providing
public school. education, including at its discretion public evening schools
and adult and continuing education programs and associated recreation programs
within its geographical boundaries; and
WHEREAS, the City is authorized to and does provide recreation and civic
programs for citizens within its geographical boundaries; and
WHEREAS, the School District and the City within their respective powers,
desire to cooperate in the operation of a Community Education Program, as
that term is defined herein below in Article la, within the total area en-
compassed by the boundaries of the City and of the School District.
NOW, THEREFORE, the City and the School District hereby agree with the
other as follows:
1. PURPOSE OF AGREEMENT
The School District and the City shall jointly and cooperatively,
pursuant to the broad authority contained in Section 471.15 through 471.19,
operate a Community Education Program.
a) The term Community Education Program is defined, for the purposes
hereof, to mean the following:
A program of academic improvement, enrichment, vocational improve-
ment, leisure and recreation services and social action utilizing
School District physical plants, City park and recreation facilities,
private resources, if and when available, for all. age, social and
economic groups residing within the geographic boundaries of the
"Community." The "Comununity" being the total. area encompassed by the
boundaries of the City and the School District.

b) The purpose of this agreement is to coordinate the programming
and physical plant facilities of both the School District and the City.
The Community Education Program and its director and the Park and
Recreation Department and its director will act as liaison between
the respective governing bodies to coordinate this agreement.
c) The responsibility for operation and maintenance of the
Community Education Program, except as otherwise set forth herein,
shall be the School District's. Recommendations shall be received by
the School Board concerning the program, budget, and operating of the
Community Education Program from the Comn:uni_ty Education Advisory
Council.
2. CONTRIBUTION OF PROGRAMS AND FACILITIES
a) The School District and City shall, after receiving the
recommendations of the Advisory Council, determine which of its lands,
buildings, equipment and programs (hereinafter sometimes called "Public
Resources") will be made available to the Community Education Program.
b) It is expressly understood and agreed that all educational
facilities, equipment, programs and staffs made available by the School
District shall be utilized in the Community Education Program under the
exclusive supervision and control of the School Board -- and conversely
for the City.
c) It is understood and agreed that the parties shall endeavor to
purchase the equipment and supplies for the Community Education Program
through the purchasing procedures of whichever party is able to secure
the lowest price for such equipment and supplies.
3. SUPERVISION OF PROGRAM
All activities of the administrative official in charge of the Commu-
nity Education Program (the "Director") will be under the direct supervision

of the School District's Superintendent of Schools. The Director shall

implement the goals of the Community Education Program to attain fuller
utilization of Public Resources and also private community resources in
attempting to solve community problems, to increase community use of educa-
tional facilities by neighborhood residents, and carry out the objectives
and goals of the program as recommended by the Advisory Council.
The School District shall provide office space, secretarial and
operational services to permit the Director to administer the Community
Education Program.
4. BUDGET
The School District shall allocate funds necessary to operate the
Community Education Program in its annual. budget. The receipts and dis-
bursements required for the operation of. the Community Education Program
will be accounted for by the School District in a separate School District
account (the Community Service Fund). The receipts of the Community Service
Fund shall consist of:
a) Appropriation from School District as provided in its adopted
budget.
b) Donations or grants from private or public: agencies for Commu-
nity Education Program purposes.
c) Earnings, fees, and charges resulting from the operation of the
Community Education Program.
Disbursements from the Community Education Service Fund shall be made
for the operation of the Community Education Program only, and shall be
made. pursuant to procedures required by law for the disbursement of funds.
5. TERIMINATTON
This Agreement shall remain in effect and sb.all govern jointly the
Community Educatiou Program of the City and of the School District. However,

either party has the right to terminate this Agreement at the end of any
fiscal year of the School District on notice in writing of its intention
to terminate said Agreement. This notice shall be submitted to the other
party at least two months prior to the date of proposed termination.
IN WITNESS WHEREOF the parties hereto have caused this Agreement to
be executed by their respective duly authorized officers pursuant to the
authority granted by the attached resolutions adopted by the City Council
of Edina and by the School Board of Independent School District No. 273.

STAFF REPORT
June 26, 1974
S-74-9 McCauley Heights 5th Addition. Generally located between McCauley
Trail and Arrowhead Lake, north of Margaret's Lane and south of
McCauley Circle.
Refer to: Attached site graphics by proponent and by staff.
The proponents are requesting a three lot subdivision with an outlot, generally
between McCauley Trail and Arrowhead Lake. The wide black border on attached
graphic "A" shows the exact location of those three lots. In meeting with the
Engineering Department it became clear that from an engineering, planning, and
public safety standpoint, the proposal is unacceptable. Graphic "A" shows
the future division of Outlot A, and in pink shows the proposed access to all
of the lots. The commission should note that the access is by private easement.
Graphic "B" is a drawing by the Planning staff showing the method by which
public access could be had into the area. The staff proposal may very well not
be the best proposal, in that it creates considerable environmental havoc.
It is, however, one workable solution.
Recommendation: That the proposed plat be denied in its present form for the
following reasons:
1. The deadend private access drives are both inconvenient and potentially
dangerous for fire and emergency vehicles.
2. Post office vehicles, garbage trucks, delivery vans, etc., will also find
it difficult to maneuver.
3. Safety service and general public would find difficulty in locating these
homes, resulting both in a frustrated driving public and disturbances to
adjoining residents who will be asked to identify the locations of these
future homes.
4. Acceptable maintenance standards with so few homes (unlike a townhouse develop-
ment) will be difficult and may very well result in public demand that the
municipality provide those public works services.
Should the Planning Commission choose to approve this subdivision, it should be
subject to a 5° cash parkland dedication.
