C. C. Volk of Di'ckinson and Gillespie submitted a tentstiue plat for subdividing the Grant C'ollier plat extending fro3 iizghvay 100 to the Hansen Boad, advising that minimum private dwellings would be at least %6,000.00, and that all street grading would be done by the developers. After discussion it :vas moved Tillson that the matter be referred to Tillage Engineer Brad4ey for his recommendatZons and report. Seconded by Kolten and carried. Hr. E. A. Brown appeared before the council to ask if Lot 43 of Auditorts Sub. No. 172 might be built upon, and was presented with a copy of the Village Zoning Ordinance giving the area zoned far Community Stare District, as we21 as prescribed uses. Recorder Eoore advised of results of Special Election held on J3nuary 31, 1939, wherein the matter of issuing Village of Edina General Obligation Bonds in an amount not to exceed .355,000.00 to defray the Village portian of a main interce2ting sever extending from approximately ;'Jest 54th' Street and East Village limits to Woaddale Avenue aad Tiest 50th Street was submitted to the vaters of the ViLIage. The proposition to issue the bonds was defeated, 340 voting "Xo" to 269 voting "Yes It as f 0 Il017s ; * total yes no Precinct No, 1 154 27 181 Precinct No. 2 94 68 162 Precinct No. 3 31 245 266 Total vote 609 I+- %'hereupon the matter of providing disposal of sanitary sewage was quite generally discussed by all members of the Counciland a number of residents including Xr. E. L. John and Village Attarney Strong. discussion President Sharpe advised he later wouId recess this meeting to another evening in order to provide more time to work out plans to carry out the project. This was satisfactory to all. . The Recorder presented a check from Er. 8. L-. IiKcPhail. in amount $302.29 in full payment far remaining sanitary sewer installments numbers 2 to 10 inclusive levied against Lot 4 White Oaks Addition and turned over ta Treasurer Dnggan for deposit in Sewer District No. 4. The matter of plowing snow from private driveways was discussed by the Council, it being Council's opinion that Village equipment should not enter upon or do work an private praper€y. The Chairman of Road and B'ridge Committee to give orders accordingly. JVhereupan it was moved by Holten that the Recorder advfse the Gas C'ompany fv that no further permits woald be issued unti1 the Company made a definite arrangement foz putting roads where mains were laid back into satisfactory condition, and that attention be given the matter of trenches settl.ingtr. Seconded by Willson and carried. Application by Ninneapolis G. E. Company far permission to set 9 poles .on account new street lights recently ordered installed by the Council at 52nd and Halifax, 48th and Valley 'ZTieVi Road, and 53rd and Hellagg was on motion Holten be granted, seconded by Eocpre and carried. It was moved by Xolten that Village Attalrney Strong be requested to write W. E.. Code advising that the Council had refused to accept the deed from Code and wife ta the Village of Edina of a portion of Lojt 1 in Section 32 Townghip 117, Range 21, and recorded in the office of the Register of Deeds of Hennepin County on August 12, 1938, in Book 1475 of Deeds page 72, for the reason that the deed was executed and recorded without the knowledge and consent of the Council and without any intimatian that.the deed would be accepted. Seconded by IYfoore and carried. Letter dated February I, 1-939 by Duoglass Rees regarding the matter of grade of West 54th Street east of Minnehaha Creek Bridge was read and on suggestion by President Sharpe was referred tal Village Engineer Bradley fos his estimate crf a suggested grade. AS 39726 tcr the Village 0.f Edina f0.r period Pebruary 11, 1939 to Bebruary 11, 1940, sho)wing a credit of 5.4% as compared with a credit of 6.9% under the expiring policy, together with decrease in manual rates under 1938, and with'estimated earned premium of $358.83, after discussion vias on motian Boore be accepted and premium ordered paid. Seconded by Tillson and carried. 'No further business to come begore the meeting at this time, President Sharpe declared the meeting recessed to, meet again at the same place on February 20, 1939 at 8 ol'clock €'.E. for discussion of Sanitary Sewer problems existing in the Village of Edina. . c Village Recorder Xinutes of the regular meeting of the Council of the Village of Edina, being the Zebruary 13, 1939, meeting, duly recessed to convene in Grange Hall 0.n February 20, 1939* at 8 o'clock Rl. The meeting was called to order by President Sharpe, the rall called and a11 members of the Co.unctl were present. The meeting, far the particular purpose of discussing sanitary seaage problems existing in the VZ1lage of Edirza, mas attended by a gaadly number of residents and property owners, the majority living in rural Edina. President Sharpe advised that the matter of issuing PiXIage of Edina general obligation bonds to finance the ViIlage portion of a large intercepting sanitary sewer had failed of passage at the special election called for that purpose on January 31, 1939, and the problem was to furnish sanitary sewage disposal tu over 500 homes at present connected to lateral severs and to provide adequate disposal af sanetary seivage for several proposed lateral sewer districts in the irnmedia€e future. Yillage Attorney Strong advised the Council it mas his opinion that under Section 1P81 Xason's Einnesota Statates 1927' the douncil by its own action could establish "Joint Sewer District No. 1" to take the sanitary sewage from present and fu%ure Lateral Sewer Districts and to assess all the costs including those construction and sewage treatment costs by the City of Einneapolis for that part billed aa the Village of Edina's portion of the Einnehaha Trunk Sevzer against all the property in "Joint Sewer Districfi mo. 1". It ivas the wish and opinion of the meeting that if and vhen all of such costs were born wholly and only by property lacated within "Joint Sewer District No, 1" that no further or additional cost for sanitary sewers of any kind in other \ areas or portions of the Village of Edina could be made /- against property located in "Joint Sewer District 330, 1.'). Village Engineer Bradley presented two large maps showi*.g in detail the proposed main intercepting sewer connecting pith the Hinnehaha Trunk Sewer of the City of Xinneapolis at about 'Jest 54th 5t. arrd Xerxes Ave. , the East Village limits of the Village of Edi'na, together with existing and propased Lateral Sewers in the area bounded by Xerxes Ave. from Yest 54th 3t. to Jiest 62nd St. thence west along Vest 63nd 3t. to the Belt Line Highway 80. 100, thence north along said Highway 100 to Yest 55th Street extended, thence west along said West 55th St. extended to the Hansen aoad, thence Korth along Hansen Road to North Village Limits, thence east along the northerly line of North Village Limits to Prance Avenue, thence South along Prance Avenue ta Vest 54th 3t. thence east along Vest 54th St. to point of begiBning, comprising a proposed area for ''Joint Sever District Ea. 1" of about 1,500 acres. Efir. R. L. John advised of an interest rate of 4$$ with sewer narrants paysble in annual installment'$ from one to ten years. After nuch discussion it was unanimously agreed that Village Attarney Strong pepare an Ordinance to establish Joint Sewer District No. Dne of the Village of Edina and other necessary resolutions for submission to the Council at its next regular meeting to be held on Sebruary 27, 1939, Whereupon President Sharpe declared the meeting adjourned at 10.45 €%.
