of the Village of-Edina, held-in Grange Hall
on April 28th, 190, at 8:OO o'clock p. IL
The meeting was called to order by the President, the roll called and all
members of the Council rrere present except Trustee Wyatt.
Zinutes of the regular meeting of the Council held on April I&, 194l, and
the recessed portions of the same meeting duly held on April 21, l9U, and
April 24, 1941, were read. On motion Irgens they be approved as read,
seconded by TYillson and carried.
The Village and Road Crew payroll advances, together with bill of Village of
St. Louis Park for fire depa&ment service in amount of $90.00, and statement
of Lametti and Lametti for contract installation of water main ia and along
Vooddale Avenue from Golf Terrace to West 55th Street, to be assessed against
the benefited property, duly recommended for payment by Village Attorney grid
approved for payment by Village Ehgineer, in total amount $1581.44, per bid,
were on motion FJiuson duly allowed and ordered pdd, seconded by Irgens and
carried.
D. F. XcGuire offered surveyor's proposed plat of part of the Darcy farm, lo-
cated near the intersection of West 70th Street and Cahill Road, which was
referred to Road and Bridge Committee.
Messrs. Jackson and Prouse presented additional signers for water main exten-
sion on Wooddale, Kellogg, Oaklavm and Brookview Avenues.
Attorney Perry R. Hoore of Stinchfield, EdackaU, Crounse and Moore, and
Village Attorney Holten discussed at length the recent court decision by
Judge Montgomery and recommended that appeal be taken, whereupon Trustee
Willson moved that the attorneys for the Village be authorized and directed
to perfect an appeal to Supreme Court from decision of Judge uontgomery in
case of Country Club District Service Company vs. Village of Edina, seconded
byldoore and declared unanimously carried.
Bids as advertised were received on one Police Car, as follows:

which on motion Eloore, be referred to Police Committee for tabulation and
recommendation, seconded Irgens and carried.
The matter of enacting an ordinance regulating Oil Filling Stations came be-
fore the Council, with affected residents being both for and against all
night operation. After considerable discussion, Uoore moved the proposition
go over to the regular meeting of the Council. to be held on May %thy
seconded by Irgens and cwEed.
Oscar Gaarden advised the Council that an additional deep well, pump, house
and lot would cost about $10,000.00, and that, it would take 60 days or more
in which to have ready for use.
25th was read, advising that an adequate water supply was desirable. No
action was taken on the matter, it being brought out in the discussion that
if an emergency developed, that additional water might be procured from the
City of Uinneapolis, or that lawn sprinkling could be restricted during peak
load hours, if necessary.
It was moved by PJillson that the application of Weap0X.s Gas Light COmPW?
for permission to lay 600 feet of gas main in and along Uerilane Road, from
Lot 18 to Lot 20, be granted, seconded Irgens and carried.

Trustee Irgens offered the following resolution and moved its adoption:
The Village Council of the Village of Edina does ordain as follows:
Section 1. That Section IV of the Zoning Ordinance of the Village
of Mina, passed by the Village Council on May 25th, 1931, as amended, is
hereby amended by adding thereto the following section, to be known as Section
(b-3.) :
“The South 170 feet of the South Half of Lot 35, except
the East 13 feet thereof, Auditor’s Subdivision No, 172,
Hennepin County, Minnesota.U
Section 2, This Ordinance shall be in full force and effect from
and after its passage and publication, according to law.
The motion to adopt was seconded by Recorder Moore and the vote was upon the
question of the adoption of the resolution, wherein there were four ayes and
no nays, and so the resolution was adopted.

Trustee Irgens offered the following resolution and moved its adoption:
WHEREAS, pursuant to resolution adopted by the Council a contract
has been let for the furnishing of allmaterials, necessary tools and equip-
ment and the performance of all work and labor for the construction and in-
stallation of water mains in, upon and along Wooddale Avenue, from its inter-
section with Golf Terrace to its intersection with West 55th Street, and the
Clerk, with the assistance of the Village Engineer, has calculated the proper
amount to be specially assessed for such improvement against every lot, piece
or parcel of land abutting upon such improvement, as provided by law, which
proposed assessment is now on file with the Clerk and open to public inspection,
now, therefore,
BE IT RESOLVED, by the Village Council of the Village of Edina, that
the said work of improving said street is hereby accepted, and the Clerk is
directedto cause noticg, ubl’shed in h ennepin County Review that
this Council wil~$%$,at%d~‘ffdl~ %go e re o’~m’ ar meeting place of said council,
to pass upon said‘proposed assessment; that the total cost of said improvement
is determined to be $1785.20.
The motion to adopt was seconded by Recorder Moore and the vote was upon the
question of the adoption of the resolution, wherein there were four ayes and no
nays, and so the resolution was adopted.

P. E., with reference to proposed construction of curb and gutter in and
along the South line of West 48th Street, between -.its intersection with
France Avenue South and Tomes Road, in said Village, a distance of approxi-
mately 755 feet; and the Clerk is directed to publish notice of said hearing
in the official Village paper for two (2) weeks.

On being put to a vote, said motion was carried.
Motion by Trustee Irgens, seconded by Recorder Moore, that the Village
Council hear property owners on the 26th day of Hay, l9.!+lY at 8:OO o'clock
P. N., with reference to proposed construction of curb and gutter in and
along both sides of Bruce Avenue, from its intersection with West 50th Street
to its intersection ivith Bruce Place; and in and along both sides of said
Bruce Place, fromits intersection with Bruce Avenue to its intersection
r&th Arden Avenue, in said Village; and the Clerk is directed to publish
notice of said hearing in the official Village paper for two (2) weeks.

MENT BE WE IN SEWER DISTRICT NO. 5, AND DIRECTING
VILLAGE ENGINEEB TO CALCULATE MOUNT THEREOF -
Trustee Tiiillson offered the following resolution and moved its
adoption:
Tim, a sanitary sewer has been constructed in Sewer District
No. 5, in the Village of Edina; now, therefore, be it
RESOLVED, by the Village council of the Village of Edina as
f ollovis :
1. That the cost of constructing said sewer is hereby determined
That the cost of constructing the distridt sewer in said Dis-
trict is the sum of $2620.85; that said district sewer is not used as a
lateral sewer and the entire cost shall be assessed against all the land in
the Sewer District subject to assessment, according to special benefits.

3. The cost of constructing the lateral severs in said District
is $9569.15, and the same shall be assessed against every piece or parcel of
land abutting thereon subject to assessment.
4. That an assessment has already been levied against every piece
or parcel of land in said Sewer District in the sum of $9990.00, and an error
andmistake was made in such assessment in respect of the total cost of such
improvement, and the total assessment was less than the cost of constructing
said sewer, as hereinbefore determined.

5. That the Village Engineer be, and he hereby is, directed to
calculate the amouut to be specially assessed against each lot, piece or
parcel of land within said District, to correct such error and mistake; and
he is fwher directed to prepare and file with the Village Clerk a tabulated
statement, in duplicate, showing the proper description of each and every lot,
piece or parcel of land to be specially assessed, and the amount he has cal-
culated against the same, which shall be known as the "Proposed Supplemental
Assessment Rollt*, vrhich shall be laid before the Village council for approval
at the next regular meeting to be held not less than ten (10) days thereafter,
and the Clerk shall cause notice of the time and place of said meeting to be
published, as required by law.

ayes and no nays, and so the resolution was adopted.

ENG1NEE;R TO CALCULATE AMOUNT THEREOF --
Trustee Willson offered the following resolution and movedits
adoption:
lWER,EAS, .a sanitary sewer has been constructed in Sewer District
No. 7, in the Village of Edina; now, therefore, be it
RE3OLVED, by the Village Council of the Village of Edina as follows:
1. That the cost of constructing said sewer is hereby determined
to be $21,435.00.
2. That the cost of constructing the district sewer, if used solely
as a lateral, would be $4457.85, and said amount shall be assessed against
the abutting property in the manner provided for assessing lateral sewers.
The amount of cost over and above the cost of such lateral sewer, by reason
of constructing such sewer as a district sewer, is $7255.90, and said cost
shall be assessed against all the land in the entire Sewer District.

$9721.25, and the same shall be assessed against every piece or parcel of
land abutting thereon subject to assessment.

of land within said District, to correct such.error and mistake; and he is
