Einutes of the regular meeting of the Council held on Kay 12, 1941, and the recessed portion of the same meeting held on Esay 19, 1941, mere read. seconded by Irgerrs, and carriedo The Village Pay roll advances having been carefully noted and found correct, mere on motion Willson, they be duly allowed and ordered paid, seconded by Irgens and carried. The matter of granting license to Ashley Brooks, to operate taxi- cabs togather with operation of an all night gas service station including towing service at West 50%h Street and Halifax Avenue, was discussed at length by interested residents, marry of whom especially opposed the all night operation of a gas service station. After considerable discussion, Aktorney Shattuck, on behalf of Er Brooks, suggested a 11.15 P.E. for the present 01: until Sep-Eemher 1st. next, in order to ascertain how such a pro- gram might rzorlr out, After further discussion, it was later . moved by Irgerms, that all activity at the Brooks-Pure Oil station located at Vest 50th Street and Halifax Avenue, cease a% 11.15 Pa, seconded by Billson, and carried. Petition signed by practically all of the interested property owners, mas presented to the Council for the opening up of an alley or street at about Vest 49* Street, Vest of France Avenue, wherein all costs, including the acquisition of land for same, vzould be assessed against the benefited property. Recorder EToore thereupon moTed that the petition be received and referred to the Road & Bridge Comit*tee of the Counc$l for investigation aEd report to the Council, seconded by Irgens and carried, . E:C-1,2 or 3, Cut-back asphalt It ($009 It It TC-I, 2, 3, 4 or 5 Road Tar n $0105 11 Repu'T3Lic Creosoting Company, certified check $110,00 Road Tar, heated arxd applied 0 $.lo35 per gal, All above to be in distributor lots with quality to meet the Einnesota State Highway Specs and were referred to Road & Bridge Committee for reDort and recommendation. --RESOLUTION ADOPTING ASSESSMENT FOR WATER BdAIN CONSTRUCTION-- Recorder Xoore offered the following resolution and moved its adoption: WHEREAS, a proposed assessment for the cost of improvement of Wooddale Avenue from its intersection with Golf Terrace to its intersection with 'EJest 55th Street, by the construction and installation of water mains in, upon and along said street, has been duly filed with the Village Clerk and open to public inspec- ti&, and notice has been published in The Hennepin County Review on the 8th day of May, 1941, that this Gouncil will pass upon said proposed assessment at this present meeting, and this Council has met at the time and place speci- fied in said notice, and heard and passed upon all objections thereto; now, therefore, BE IT RESOLVED, by the Village Council of the Village of Edina, that said pro- posed assessment, which is hereby referred to and made a part hereof, is hereby adopted and an assessment is hereby levied against each of the lots, parts of lots, pieces and parcels of land describedtherein, in the sums therein respec- tively set forth, and each of said tracts of land is hereby found to be bene- fited in the amount ofthe assessment levied against it therein. Said assessment and interest shall The motion to adopt was seconded by Trustee Willson and the vote was upon the question of the adoption of the resolution, wherein there were five ayes and no nays, and so the resolution was adopted. . - President ofHCouncil - ATTEST : /A - Village Clerk - --RESOLUTION FOB WATER UAIN CONSTRUCTION-- Recorder Moore offered the following resolution and moved its adoption: WHEREAS, the Village Council of the Village of Edina met on the 26th day of May, 1941, at the time and place specified in a notice to all property owners whose property may be assessed for proposed cmstruction of Village water mains in and along Park Place, a street laid out within the Village of Edina, published in The Hennepin County Review on the 15th and 22nd days of May, 190, and has heard all persons appearing at said meeting and duly considered said proposed improvement; now, therefore, BE IT RESOLVED, by the Village Council of the Village of Edina, that it is here- by determined to be necessary to construct Village water mains in and along Park Place, a street laid out within said Village, commencing with its inte,r- section with West 55th Street, and extending southerly along said Park Plade to its intersection with West 56th Street; and BE IT FURTHER RESOLVED, that plans and specifications for such water main con- struction, heretofore prepared by B. H. Bradley, Village Engineer, and filed with the Village Clerk, are hereby accepted and approved as the plans and specifications for said improvement. - BE IT FURTHER RESOLVED, that the cost of said improvement is to be assessed against the property improved, as authorized by Chapter 425, Laws of 1921, as amended. Th'e mot,on to adopt was seconded by Trustee Irgens and the vo,e was upon the question of the adoption of the resolution, wherein there were five ayes and no nays, and so the resolution was adopted. - Preskdent of Council -- ATTEST: I - Village Clerk - \ --RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND DIRECTING ADVERTIS-T FOR BIDS FOR IVATER MAIN CONSTRUCTION-- Trustee Irgens offeredthe following resolution and movedits adoption: V-, the Village Council has heretofore determined to construct Village water mains in and along Wooddale Avenue, commencing at the intersection of Wooddale Avenue South and Rest 55th Street, and extending southerly along Wooddale Avenue to its intersection with West 56th Street; commencing at the intersection of Kellogg Avenue and West 54th Street, and extending southerly along Kellogg Avenue to its intersection with Rest 56th Street; commencing at the intersection of Oaklam Avenue andNest 54th Street, and extending southerly along Oaklawn Avenue to its intersection with Nest 56th Street; and comencing at the intersection of Brookview Avesue and Nest 55th Street, and extending southerly along Brookview Avenue to its intersection with Viest 56th Street; and in and along Park Place, a street laid out within said Village, commencing with its intersection with West 55th Street, and &ending southerly along said Park Place to its intersection with Nest 56th Street; and the Village Engineer, B, H. Bradley, has prepared plans and specifications thereof which have been filed with the Clerk of the Village of Edina; nov, therefore, BE IT RESOLVED, by the Village Council of the Village of Edina, that said plans and specifications are hereby accepted and approved as the plans and specifications of said improvement. The motion to adopt was seconded by Recorder Moore and the vote was upon the question of the adoption of the resolution, wherein there were five ayes and no nays, and so the resolution was adopted. - PresEdent of Council/ ATTEST: / \ - Village Clerk - --RESOLUTION CONFIRMING SUPPLEUIQJTAL ASSESSMENT IN SEWE3, DISTRICT NO, 5- Trustee Willson offered the following resolution and moved its adoption: BE IT RESOLVED, by the Village Council of the Village of Edina, Hemepin County, Minnesota, as follows: 1. has, with the assistance of Alex Creighton, calculated the proper amounts to be specially assessed as a supplemental assessment for the construction of sewers in Sewer District No. 5 of said Villake, against every assessable lot, piece or parcel of land within said District, in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements, in duplicate, showing the proper description of each and every lot, piece or parcel of land to be specially assessed as a supplemental assessment, and the amount calculated against the sane. The Engineer heretofore duly selected by the Council for such purpose, has, vdth the assistance of Alex Creighton, calculated the proper amounts to be specially assessed as a supplemental assessment for the construction of sewers in Sewer District No, 7 of said Village, against every assessable lot, piece or parcel of land within said District, in accordance with the provisions of lavr, and has prepared and filed with the Village Clerk tabulated statements, in duplicate, showing the proper description of each and every lot, piece or parcel of land to be specially assessed as a supplemental assessment, and the amount calculated against the same. 2. That such proposed supplemental assessment is affirmed, adopted and con- .- 6. That said supplemental assessment so affirmed, adopted and confirmed shall be certified to by the Village- Clerk and filed in his office and shall thereupon be and constitute the special supplemental assessment for the con- struction of severs in Sewer District No_. 7; that the amount assessed against each lot, piece or parcel of land shall bear interest, from the date hereof, until the same has been paid, at the rate of five per cent (5%) per annum, 7. That 'such supplemental assessment shall be payable in nine (9) equal annual installments, payable on the 1st day of June-in each year beginning in the year 194.2 and continuing until all of said installments have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. 8. The motion to adopt was seconded by Recorder Eloore and the vote was upon the question of the adoptLon ofthe resolution, wherein there were five ayes and no nays, and so the resolution was adopted. - Pkesident of councg- / ATTEST: --RESOLUTION FOR IMPROVEMENT OF WEST 48th STREET BY CONSTRUCTION AND INSTALLATION OF CURB AND GUTTER-- Trustee Willson offered the following resolution and moved its adoption: wHE;REAS, a petition in yvriting,. requesting improvement of West 48th Street, by construction and installation of curb and gutter upon and along the South line of said West 48th Street, between its intersection with France Avenue South and Townes Road, in said Village, has been duly filed with this Council, signed by owners of more than thirty-five per cent (35%) in frontage of the real property abutting on the portion of West 48th Street named in said petition as the location for said improvement, and I WHEREAS, the Village Council has met at the time and place specified in a notice to all property owners whose property is liable to be assessed for such improvement, published in The.Hennepin County Review on May 8th and l5th, 1941, and heard all persons interested and determined the necessity for the improvement petitioned for; now, therefore, BE IT RESOLVER, by the Village Council of the Village of Edina, that the petition above described is hereby determined to have been signed by the required percentage of owners of property affected thereby; and BE IT FURTHER FLESOLVED, that West 48th Street be improved between its inter- section with France Avenue South and Townes Road, by the construction of curb and gutter in and along the south line of said Street; and BE IT FURTKER RESOLVED, that the plans and specifications now on file with the Village Clerk, prepared by B. H, Bradley, Yillage Engineer, are hereby approved and adopted as the plans and specifications for said improvement; and BE IT FURTHER RESOLVED, that the Clerk is hereby directed to advertise for bids for materials necessary therefor, and that the labor shall be supplied by the Works Progress Administration of the United States of America. The motion to adopt was seconded by Trustee Irgens and the vote was upon the question of the adoption of the resolution, wherein there were five ayes and no nays, and so the resolution was adopted. ATTEST: I --RESOLUTION FOR HEARING ON OPENING OF PROPOSED ROAD- Trustee F’Jillson offered the following resolution and moved its adoption: WHIBEAS, the Village Council desires on as own motion to extend, open and grade a street upon and along the East and West quarter line of Section Eight (S), Torrnship One Hundred Skteen (U6), Range Qrenty-one (21) , from the Northwest corner of the xorthvrest Quarter of the Southeast .Quarter of said Section Eight (e), to the West line of said Section, as authorized by Chapter 382, Lavrs of 1903; now, therefore, BE IT RF;SOLVED, by the Village Council of the Village of Edina, that it deems it necessary and expedient to extend, open and grade a street upon and along the East and West quarter line of Section Eight (8) , Township One Hundred Sixteen (U6), Range Plenty-one (21), from the Northvest corner of the Northwest Quarter of the Southeast Quarter of said Section Eight (S), to the West line of said Section; and that on the 23rd day of June, l9u, at 8:OO olclock P. M., this Council will meet at Grange kill, corner of Eden Road and Highway No. 100, in said Village, and will, at said time and place, hear parties interested therein, with reference to such improvement, and vfll decide whether or not to undertzke such improvement in whole or in part.
