HomeMy WebLinkAbout19410804_REGULARHinutes of the recessed portion of the Remar July 2&h, 19&ly meeting of the Council of the Village of Edina, duly held in Grange Hall on August 4, 190, at 8t00 o'clock p. M. The meeting was called to order by the President, the roll called and all members of the Council were present. Discussion uas had vith reference to installation of sanitary sewers in Sewer District No. 9,wherein Village lbgineer Bradley presented estimate of costs for district and lateral sewers in Golf Terrace, Lakevim Drive and TJoodhill Road, which were studied by the Council and Hessrs. Hansen and Parks. Engineer Bradley advised that the State Board of Health had approved his plans for sanitary severs in Sewer District No. 9 and the present plans would permit installation of other lateral seirers in Golf Terrace Heights and contiguous areas, when expedient and necessary. Village Ihgineer Bradley also presented estiinate of costs for watermain exbensions in Lakevier7 Drive from Golf Terrace to Unity Avenue, which, after discussion and study'by the Council, Hessrs. C. H. Hansen and B. M. Parks, and others, it was unanimously agreed to proceed vrith the installation of sanitary sewers and vraterxnain extensions in Golf Terrace Heights Addition on basis of assessing the costs thereof directlF upon the benefited property. --RESOLUTION FIXING COST AND DIFECTING SALE OF CERTIFICATES OF INDEBTDNESS FOR NATEZUAIN .I IZIPROVEUENT NO. 1 -- Trustee Irgens offeredthe following resolution and moved its adoption: BE IT RESOLVED, by the Village Council of the Village of Edina, as ' f 0llOr.rS : 1. The total estimated cost of Watermain Improvement No. 1 of the Village of Edina is hereby found and determined to be the sum of $2&,000;00, dnd it is hereby determined that the entire cost of said im- proxrenent shall be assessed against the property benefitedthereby. 2. There is hereby created a special fund to be knom as Uater- main Improvement No. 1 Fund, into rrhich shall be paid all moneys received from the assessment for said improvement and fromthe sale of Certificates of Indebtedness as hereinafter provided, and out of which fund shall be paid the cost of said improvement and principal of and interest on said Certificates a;b: Indebtedness. 3. In anticipation of the levy and collection of assessments and in order to defray the expenses incurred and to be incurred in the making of said improvement, it is hereby determined to issue and sell $2&,000.@0 Ylatemain Improvement No. 1 Certificates of Indebtedness, to be dated August lst, lqu, to bear interest at the rate specified by the successful bidder, payable semi-annually, and to mature serially on August lst, in the amount of $2000.00, each odd numbered year 1943 to 1951, both inclusive, and in the amount of #3000.Q@ each even numbered year 1944 to 1950 both inclusive, and 92000.00 in the year 1952, it being determined that the first levy cannot be paid before the year 1942, and that the above is as near equal an mount as conveniently may be. / 4. The Village Clerk is hereby authorized and directed to cause a notice of the sale of said Certificates of Indebtedness to be given by publication in the official newspaper of the Village, for two (2) successive rreeks, of a notice in substantially the folloning form: --NOTICE OF SALE OF CERTIFICATES OF INDEBTEDXESS- NOTICE IS HEREBY GIVEN, that the Village council of the Village of Edina, Minnesota, ~Jill meet at Grange Hall, corner of Eden Road and Highway No. 100, in sdd Village, on the 25th day of August, 19lrl, at 8200 o'clock P, M., for the purpose of receiving and considering bids for the purchase of $24,000.00 Watermain Improvement No. 1 Certificates of Indebtedness of said Village. August lst, 19U, to be in denominations of $2000.00 or $3OOO.OO each, and to mature serially on August lst, in the amount of ~2000,,00 each odd numbered year 1943 to 1951, both inclusive, and in the amount of $3OOO.OO each even numbered year 1944. to 1950, both inclusive, and $12000.00 in the year 1952. Said Certificates are to be dated These Certificates are issued for the purpose of financing the cost of a Watermain Improvement in the Village, and are payable primarily from the assess- ments to be levied for said improvement, but the full faith and credit of the Village will be pledged for their payment. Both principal and interest rdll be payable at any suitable bank or trust company, and the Village will furnish the printed certificates and approving legal opinion of Messrs. Fletcher, Dorsey, Barker, Colman & Barber, both without cost to the purchaser,, Deliveryrrill be made on or before September l5thy 190. The Village Council reserves the right to reject any and all bids, or to adjourn the meeting to a later date for the purpose of considering and accepting said bids,, Dated this 4th day of hgus't, 1941. H. Bradley and filed$ the office of the Village Recorder on August lst, 19,!+l, are hereby apbroved and accepted, i The Council shall meet on Monday, the 2nd day of September, l9@, at eight o’clock P. M., for the purpose of opening, receiving and consider- ing bids for the construction of said sewer in Sewer District No. 9 of sqid Village, in accordance with plans and specifications as approved. Notice to bidders shall be made by publication for three (3) successive weeks ;in the official newspaper of the Village and in the Improvement Bulletin, printed in Minneapolis, Minnesota, which notice shall be in sub- stantially the f olloving f om: PROPOSAL FOR BIDS FOR FURNISHING LABOR AND EdATEIALS FOR SANITARY SEclTER DISTRICT NO, 9 Sealed proposals will be received by the Village of Edina, Minnesota, at Grange Hall, at the corner of Eden Hoad and Highway No. 100, in said Village, until 8r00 o’clock P, M., on September ad, 1941, and 1~ii.11 be opened at said time for consideration by the Village Council, for the fur- nishing of labor, material and equipment for the installakion complete and ready for service of a sanitary sexer in Sewer District No. 9, in said Village, as follows: 4770 lineal feet of 12” vitrified clay pipe sani%ary sewer 8 feet to 30 feet deep, ~ 3115 lineal feet of 9‘’ vitrified clay pipe sanitary sewer 8 feet to 12 feet deep, 31 man-holes, a11 in accordance with plans and specifications therefor on file with the Village Clerk, at 4605 looddale Avenue, in said Village, which plans and specifications rnay be seen at the office of said Clerk and at the office of,B. H, Bradley, Village Engineer, 217 South 6th Street, Minneapolis, Minnesota. Extra copies may be procured on application by depositing #l$.OO, one-half to be refunded when plans and specifications are returned . in’ good condition, All bids must be unconditional and on the basis of cash payment for mater- ial and labor, A certified check, payable to the order of the Treasurer of the Village, cash, or Bidder’s Bond with surety to be approved by the Council, for at least 15% of the amount bid,.*must accompany all bids. In case the successful bidder fails or refuses to enter into a written con- tract for the performance of the work and the furnishing of materials, and to give a bond as required by law, within twenty (20) days after notice of the award of the contract, the check or deposit will be forfeited to the Village as liquidated damages, Checks or cash of unsuccessful bidders will be returned after the contract has been awarded, The Village Council reserves the right to reject any and all bids or parts of bids, or to adjourn the meeting to a later date for the purpose of further consideration and accepting said bids. B-/f&a/ ._c” - Presfdent of Vi1 - Village Clerk - Trustee Irgens offeredthe following resolution and moved its adoption: --REsOLUTIOI'J DETERHINING NECESSITY FOR EXTENSION OF I7ATEZikUINS IN GOLF T-GE HEIGHTS- TtJHEREAs, pursuant to duly.published notice, a hearing was had at the duly convened meeting on July 28th, l94.l, of this Council, for consideration of the proposed extension of Village rratermains in and along the streets hereinafter described; and WEEBEAS, the only person appearing at the meeting on the aforementioned date, in connection therewith, vas Mr. Carl EI. Hansen, who represented that he and Ben tl. Parks owned all of the property to be affected. by said extension; that upon his objection to the proceeding with said extension on the part of the Village, said hearing vas continued to the 25th day of August, 194.l; and -_ "S, said Carl EI. Hansen and Ben N. Parks have appeared at this meeting and idthdram their objections and urged the Village to proceed uith said improvement; now, theref ore, BE IT RESOLVED, by the '(Tillage Council of the Village of Edina that it is hereby determined to be necessary to construct Village watermains 5x1 and along the streets and avenues of Golf Terrace Heights Addition, Hennepin County, Elinnesota, commencing at the intersection of Golf Terrace and Cherry Lane, thence Southerly along Golf Terrace to its intersection with Lakeview Drive; thence Southerly along Lkeview Drive to its intersection with unity Avenue; and thence Southerly along Unity Avenue to Knd Road; and BE IT FURTHER RESOLVED, That B. H. Bradley, Village Engineer, is hereby appointed Eugineer to prepare plans and specifications for such watermain construction; and BE IT FWtTHER FESOLVED, that in contemplation of said improvement, said Bradley having heretofore prepared plans and specifications thereof , nhich have this day been filed vith the Clerk of the Village of Edina, rrhich plans and specifications are hereby accepted and approved as the plans and specifications of said improvement; and BE IT FURTHER RBSOLVED, that the Clerk is hereby directed to advertise for bids for said improvement, on the basis of cash payment for such work, statingthat the bids will be opened and considered by the Council at its regular meeting on the 25th day of August, l94.l; that no bids will be con- sidered unless seded and filed with the Clerk and accompanied by cash deposit or certified check, payable to the Clerk, for an amount equal to 15% of such bid; and .
