meeting of the Council of the
Village of Edina, duly held in Grange Hall on August
25, 1941, at 8:OO o'clock p.m.
The meeting was called to order by the President, the roll called, all menbers of the Council being
pres errt ,
Pay roll advances for Village Road and Bridge
crew and Police officers having been carefully
noted and found correct , vere on motion Irgens they be duly allowed and ordered paid, seconded
by Billson and carried.
Xessrs. Scoen and Engberg gresented a proposed plot
for subdividing a 6 acre track at 56th Street and Wooddale. After discussion it was moved by Zoore
to refer the matter to Village Engineer and
Road and Bridge Camittee for study and recommendation
to the Council, seconded by Vyatt and carried.
Percy B, EcGonan, appeared before the Council to. request that he be granted permission to open
up a new gravel pit at Vest 70th Street and
Prance Avenue. After discussion it vas explained iia
Mr, Mcgowan that the area had been zoned for residential purposed far the past 10 years
and application accordingly returned ,
Dauglas Rees, presented data far suggested
methad to drain storm mater of proposed
Halifax Avenue extension lying South of
Vest 54th Street which after discussion mas referred ta Village Engineer and Road and Bridge CommitLee for study and recammend-
ation to the Council.
Application received from Uinneapolis Gas Light Company for permission to install
246 feet of 4" gas main in and along Eeadow Raad North from Vest 47th Street,
wherein Eaore moved the application Be granted, seconded by Vlyatt and carried,

CERTIFICATES OF INDEBTEDNESS FOR WATERWJN

Trustee Irgens offered the following resolution and moved its adoption:
\IHE3,EAS, pursuant to resolution of this Council adopted August 4th,
l9l+l, two (2) weeks' published notice has been given that this Council
would receive and consider bids at this present meeting for the purchase
of @4,OOO.OO Watermain Improvement No. 1, Certificates of Indebtedness
hereinafter described, and this Council met at the time and place
specified in said notice and has received the bids of the following:

BE IT RESOLVED by the Village Council of the Village of Edina, Hennepin
County, Minnesota, as f ollotvs :
1. That the said bid of J. M. Dain & Co. and Wells-Dickey Co.
is hereby accepted, and the President and Clerk of the Village are hereby
authorized and directed to execute, and deliver Certificates of Indebted-
ness of the Village of Edina in the aggregate sum of $24,000.00, to be
dated August 1, 1941, to bear interest at the rate of l&$ per annum,
payable semi-annually, and to mature serially on August lst, in the amount
of $2,000.00 each odd-numbered year, 1943 to 1951, both inclusive, and
in the amount of $3,000.00 each even-numbered year, 194.4 to 1950, both

of Edina, Hennepin County, bnesota, certifies that it is
indebted and for value received promises to pay to the bearer
hereof from 'juatermain Improvement No. 1 Fund of said Village
the sum of ONE THOUSAND DOLLARS on the 1st day of August,

interest thereon from the date hereof until paid at the rate
of one and one-half (lk) per cent per annum, pzyable August 1,
1942, and thereafter semi-annually on the 1st day of February
and the 1st day of August in each year, interest to maturity
being payable in accordance with and upon presentation and
surrender of the attached interest coupons as they severally
become due, both principal and interest being payable at the

This certificate of indebtedness is one of
a series of certificates in the aggregate principal
amount of :j24,GOOJ all of like date and tenor except
as to maturity, and is issued by the Village of Edina
pursuant to and in full conformity nith the constitu-
tion and lami of the State of Uinnesota thereunto
enabling, including Chapter 425, Law of 1921, for
the purpose of defraying the expense incurred and to
be incurred in laying watermains, hydrants, and con-
nections in Elatemain Improvement District 140. 1 and
in anticipation of the collection of special assess-
ments to be duly levied against the benefited property
in said District for the construction of said vratems3ns
and is payable out of a fund designated as Fiatermain
Improvement No. 1 Fund, into which Fund all proceeds of
said assessment are requiredto be paid but the full
faith and credit of the Village of Xdina are pledged
for its payment.
It is hereby certified and recited that all
acts, conditions, and things required by the constitu- tion and laws of the State of dinnesota, to be done, .
to happen, and to be performed precedent to and in the
issuance of this certificate of indebtedness, have been
done, have happened and have been performed in regular
and due fom, time and manner as required by la:;. and
that this certificate of indebtedness, together with all
other indebtedness of said Village outstanding on the
date named herein, and on the date of the actual. issuance
and delivery hereof, does not exceed any statutory or-
constitutional limitation of indebtedness.

Hennepin County, Uinnesota, by its Villhge Council has
caused this certificste of indebtedness to be signed
by the President of the Village Council and countersigned
by the Village Clerk ad sealed vrith the seal of said
Villap, and the interest coupons hereto attached to be
executed and axbhenticated by the fixsimile sisatures
of said officers, and has caused this certificate of
indebtedness to be dated as of August 1, 1941.

3. Said certificates shall be printed under the direction of
the Village Clerk, and the President of the Village Council and Village
Clerk are hereby authorized and directed to execute said certificates
and to affix the Village Seal, and the interest coupons to be attached
thereto shall be executed and authenticated by the printed, engraved
or lithographed facsimile signatures of said officers.
4. When said certifi’cates have been fully executed as required
by law and by this resolution, they.shal1 be sold and delivered to J. EE.
Dah & Co. and Wells-Dickey Co. of Minneapolis, Minnesota, at par and
accrued interest upon receipt of such purchase price, and said purchaser
shall not be obligated to see to the application thereof.
5. The Village shall furnish the printed certificates and
the legal opinion of Messrs. Fletcher-Dorsey-Barker-Cohan & Barber
without cost to the purchaser.
6.- Said certificates and the interest thereon shall be payable
from money collected from special assessments in said Watermain Improve-
ment No. 1 District, but the full faith and credit of the Village is
hereby pledged to their payment, and the Clerk and Treasurer are author-
ized and directed to cause said certificates and the interest thereon to
be paid out of any moneys of the Village so derived from said special
assessments or other source.
The motion to adopt was seconded by Trustee Wyatt and the vote was upon
the question of adoption of the resolution, wherein there were five ayes
and no nays, and so the resolution was adopted.

Trustee Willson offered the following resolution and moved its adoption:
WHEREAS, the Village Council of the Village of Edina by resolution adopted
a special assessment for watermain construction in Watermain Improvement
No. 1 district on the 11th day of August, 1941, in the sum of $22,211.10,
ad,
GMEREAS, said Council theretofore, and on the 24th day of May, 1941, by
resolution, adopted a special assessment in part of said district, in the
sum of $1,735.00, and the total of said assessments, embracing all of
said district, is the sum of $23,946.10, and,
WHEREAS, said Council, by resolution, adopted on the 4th day of August, l91!&, directed the sale Qf $B24,000.00 Watermain Improvement No. 1 Certifi-
cates of Indebtedness, in anticipation of collection of special assessments
in said district, in the sum of $23,946.10; that the total of said certifi-
cates is $53.90 more than the aggregate of said special assessments,
NON, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Edina, that there shall be transferred to said Watermain Improvement No. 1

Fund, from the General Fund, the sum of $53.90, and the President and
the Clerk are hereby authorized and directed to dravr a warrant upon
the Village Treasurer against the said General Fund in the amount of
$53.90, 17hich warrant shall be payable to Watermain Improvement No. 1
Wd.
The motion to adopt was seconded by Trustee Wyatt, and the vote vas
upon the question of the adoption of the resolution, wherein there
were five ayes and no nays, and so the resolution was adopted.

- RESOLUTION FOR STREET IEIPROVEKENT -
Trustee Willson offered the following resolution and moved its adoption:
Yi€lEXtMS, pursuant to resolution adopted by the Village Council of Edina
on the 26th day of Hay, 190, and published in the Hennepin County Rev&ew
on the 29th day of May, l94.l, the Vilfage Council has met at the time
and place specified therein, which hearing was duly continued to this
meeting; and has heard all persons interested, with reference to proposed
improvement of a street to be extended, opened and graded, upon and dong
the East and West quarter line of Section Eight (8), Township One Hun-
dred Sixteen (U6), Range Twenty-one (21), from the Northwest corner of
the Northwest Quarter of the Southeast Quarter of said Section Eight (8),
to the West line of said Section.
NOW, THEEZFORE, BE IT RESOLVED by the Village Council of the Village of
Edina, that the said improvement described in said resolution shall.be
undertaken, the entire expense thereof to be paid in the first instance
out of the General Revenue Fund.
BE IT FURTHER RESOLVED, that said improvement be made by contraot to be
let to the lowest responsible bidder, and the Clerk is directed to pre-
pare and publish advertisement for bids thereon, to be opened September
8th, 190, which bids shall be based upon plans and specifications now
on file with the Clerk, andyJhich are hereby approved by this Council.
The motion to adopt vas seconded by Trustee Irgens, and the vote was
upon the question of the resolution, wherein there were five ayes and no
nays, and so the resolution was adopted.

-- ;R;ESOLUTION ACCEPTING BID WATERMAIN IS6PROVEUENT --
Recorder Moore offered the following resolution and moved its adoption.
IHEFEAS, pursuant to advertisement for bids published in the Hennepin
County Review, on August 7th, 19Ll., for furnishing of labor and
materials for watermain construction in,and along the streets and
avenues in Golf Terrace Heights Addition, Hennepin County, Minnesota,
commencing at the intersection of Golf Terrace and Cherry Lane, thence
Southerly along Golf Terrace to its intersection with Lakeview Drive;
thence Southerly along Lakeview Drive to its intersection with Unity
Avenue; thence Southerly along Unity Avenue to Wind Road.
The following bids have been duly received and opened:

THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Edina,
that Barnett &'c Record Company is hereby determined to be the bid of the
lowest responsible bidder, and the President and Clerk are hereby author-
ized and directed to enter into a contract with said Barnett and Record
Company, in the name of the Village, for improvement and installation of
said watermains in the streets hereinabove named, according to the plans
anZd specifications therefor, which have heretofore been approved by
this Council and filed in the office of the Clerk, at the 'price specified
in said bid, and which said contract shall be approved as to form by the -- Village Attorney.
BE IT FURTHER F?ESOLVED, that the Clerk is hereby authorized and directed
to return forthwith to all bidders the deposits made with their bids,
except that the deposit of the successful bidder and the next lowest
bidder shall be retained until the contract has been signed.
The motion to adopt was seconded by Trustee Willson, and the vote was upon
the question of the adoption of the resolution, wherein there were five
ayes and no nays, and so the resolution was adopted.

- MOTION SETTING HEARING ON PROPOSED WATERMAIN EXTENSION --
Motion by Trustee Irgens seconded by Recorder Moore that the Village Council
hear property ovmers on the 8th day of September, 190, at 8:OO o'clock P. M.,
with reference to the proposed extension of the Village watermains in and
along Unity Avenue, commencing at its intersection with Wind Road, and extend-
ing southerly along sa5.d Unity Avenue to its intersection with Southview;
and that the Clerk be directed to publish notice of said hearing in the
official VZLlage paper for at least two (2) weeks, the last of which publica-
tion shall be not less than three (3) days before said hearing.
On being put to a vote, said motion was carried.

BE IT RESOLVED by the Village Council of the Village of Edina, Hennepin
County, Minnesota, as follows:

The motion to.adopt was seconded by Recorder Moore, and the vote
was upon the question of the adoption of the resolution, wherein there
were five ayes and no nays, and so the resolution was adopted.
