The meeting vas called to order by the President, the roll called and all members of the Councilvere present.
Uinutes of the regular meeting of the Council held on September
22, 1941, and recessed portions of the same meeting duly held on
SeptemBer 27, 1941 and October 6, 1941, nere read, On motion
Irgens, they be approved as read, seconded by Z'[illson and
carried.

by lac and by this resolution, they shall be sold and delivered
to J. I.:. Dain & Co. and Harold E, Tood 2 Co. of Einneapolis,

purchase price, and said purchaser shall not be obligated to
see to the application thereof,
5. The Village shall furnish the printed certificates and
the legal opinion of L‘essrs . Bletcher-Dorsey-Barker-Colman & Barber cithout cost to the purchaser,

xayable from money collected from special assessments in said Zatermain Improvement Eo. 2 District, but the full faith and

The notion to adopt mas seconded by Trustee Tyatt and the

vote was upon the question of the adoption of the resolution,
wherein there were five ayes and no nays, and so the resolution
was adepted.

Hr. Eickelson submitted a rough sketch for improvement of Lots
29, 30, 31, and 32, Block 3, Grand View Eeights, which appeared
adpeeable to the Council with definate plans to be furnished
lotee .
Pekitiom was received from L. H. Todd, for oiling ’(Jest 65th
3tre.et from ITormandale to Sherwood and Sherwaod from 65th to
66th Streets, on basis that he would pay the entire cast of
the oiling and to be completed before December 1, 1942, whereupon Chairman Villson moved the petition be accepted,
seconded by Irgens and carried.
Trustee ‘ifillson offered the following resolution and moved its
adoption :
tTKFIIEAS, proposed assessment for the cost of the improvement of
Bruce Avenue and Bruce Place, in and along both sides of Bruce
Avenue, from its intersection with Best 50th Street ta its
intersection vith Bruce Place; and in and along both sides of
said Bruce Place, from its intersection with Bruce Avenue to
its intersection with Arden Avenue, by the construction of
curb and gutter in and along both sides of said streets, has
been duly filed with the Village Clerk, and open to public
insyection, and Eotice has been published in the I-Ienneyin
County Rev’iev on September 25, 1941; that this Council will
pass upon said proposed assessment in this present meeting,
and this Council ha5;’met at the time and place specified in
said ’Batice, and heard and passed upon all objections thereto,

that this Council will pass upon said proposed assessment in
this present meeting, and this Council has met at the time and

said proposed assessment in this present meeting, and this
Council has met at the time and place specified in said Notice,
and heard and passed upon all objections thereto, now, therefore,

that said proposed assessment, which is hereby referred to and
made a part hereof, is hereby adopted, and assessment is hereby
levied against each of the lots, parts of lots, pieces and

BE IT RESOLVXD by the Village Council .of the Village of Edina,
Hennepin County, Xinnesota, as follons:
I, The engineer heretofore duly selected by this Council for such purposes, has, with the assfBtance of Alex Creighton, calculated the proper amounts to be specially assessed for the
construction of semers in Sener District No. 9 of said Village
against every assessable lot, piece or parcel of land sithin
said District, in accordance vith the provisions of law, and
has prepared and filed with the Village Clerk tabulated state-
ments, in duplicate, shoving the proper description of each and
every lot, piece or parcel of land to be specially assessed
and the mount calculated against the same,

2. Botice has been duly published, as reouired by law, that
this Council mould meet'in regular session at this time and
place to pass on the proposed assessment.
3. Said proposed assessment has, at all times since its filing, been open to inspection and copying by all persons
interested and the apportunity has been given to all interested persons to present their objections, if any, to such proposed
assessment, or to any item thereof, and no objections have
been filed.
4, This Council finds that each of the lots, pieces, or
parcels of land enumerated in said proposed assessment, vas,
and is, specially benefited by the construction of said sewer in Sever District Eo. 9, in the amount in said proposed assess-
ment set opposite the description of each such lot, piece or
parcel of land, respectively, and that said amount so set out

is hereby levied against each of the respective lots, pieces or
parcels of land therein described.
5. That such proposed assessment is affirmed., adapted and
confirned, and the sunis fixed and named in'said proposed assess-
ment are affirmed, adopted and confirmed as the proper special
assessment for each of said lots, pieces or parcels of land
respectively.
6. That said assessment so affirmed, adopted and confirmed
shall be certified to by the Village Clerk and filed in his
office and shall thereupon be and constitute the special assess-
ment for the construction of sewers in Sewer District Bo. 9;
that the amount assessed against each lot, piece or parcel of
land shall bear interest from the date hereof until same has
been paid, at the rate of five per cent (5%) per annum.

published in the Hennepin County Review on the 16th day of

Recarder Eoare offered the following resolution and moved its
adopt ion :
mKEREkS, the Village has determined to proceed with the
construction of a sanitary sewer in Sewer District fJo. 8, and
the contract therefor has been let; now, therefore, be it
RESOLVED, by the Village Council of the Village of Edina,
as folloms:
1. That the cost of constructing said sewer is hereby

determined to be the sum of .$126,679.30.
The cost of constructing the district sewer, if used
solely .as a lateral, would be 98,625.00 and said amount shall
be assessed against the abutting property in the manner provided
for assessing lateral sewers. The amount of cost, over and
above the cost of such lateral sewer, by reason of constructing
such sewer as a district sewer is @51,750.009 and said cost shall be assessed against all the land in the entire sewer
district. The cost of constructing all lateral sewers in said
district, used solely as such, is $66,304.30, and the same
shall be assessed against every piece or parcel of land
abutting thereon subject to assessment.

3. The cast of securing an outlet to the trunk line in'
Jaint Sever District Bo. 1. for the sewers in Sewer District No.
8 is $23,517.00, which shall be assessed against every lot,
piece or parcel of land within said Sewer District No. 89 not
included rrithin Joint Sewer District No. 1.
4. B. H. Bradley is hereby designated as Engineer selected
by the Council to forthwith calculate the proper amount.to be specifically assessed against every assessable lot, piece.or
parcel of land within said Sewer District, in accordance with
the provisions of law.
5. Vhen said Engineer shall have finished his calculations
of the proper amount' to be specifically assessed he shall
prepare and file with the Village Clerk tabulated statement, in duplicate, showing the proper descriptioX3f each and every
lot, piece or parcel of land to be specifically assessed, and the amount he has calculated against the same, which shall be
laid before the Village Council far approval at the next regugar
meetin@ to be held not less than ten (10) days thereafter, and the Clerk shall cause notice of the time and place of said meet-
ing to be published, as required by law.
The motion to adopt was seconded by Trustee T?illson, and the vote was upon the question of the adoption of the resolution,
wherein there were five ayes and no nays, and so the resolution
was adopted .
