L"UTES OF' THE: SPECIAL MEETING OF THE
EDINA VILLAGE COUNCIL RELD IN VILLAGE
HALL AT 8 P.M. OCTOBER 11, 1944 4.
All members of the council were present.
Oscar Gaarden, president of Country Club District Service Co., and
presented a statement acknowledging that hearing on rates of the
company was adjourned from October 6, 1944, to the present date at
request of the company and w5thout predjudice to the cause of the
copcil.
Gaarden presented a report on earnings of the company for 1943 and
the same was discussed.

Utley offered the following resolution and moved its adoption:

Motion to adopt the foregoing resolution was seconded by Willson .and
on rollcall there were five ayes and no nays, as follows: Utley, aye;
Willson, aye; Wyatt, aye; Hawthorne, aye; Todd, e resolutlon
was adopted.

Utley offered the following resolution and moved its adoption:
RESOLUTION
WHEREAS, Sewer District No. 8, heretofore established in
the Village of Edina, includes real estate owned by the Minneapolis &
St. Paul Suburban Railroad Company, in the Village of Edina, and used
by said Company for the maintenance of its railway line, and
WHEREAS, assessments have heretofore been levied against said Railway Company property to pay the cost of the construction of sewers
in said district, and
V/HEFtEAS, a part of said assessment consisted of assessments for construction of a later sewer in said district, and
VlHEREAS, the Village Council of the Village of Edina has,
simultaneously, herewith cancelled the assessments for lateral sewers
against said railway property;
NOW, THEREFORE, BE IT RESOLVED, that the Village Council of the Village of Edina hereby finds and determines that the said Railway
Company property would not be benefitted by any lateral sewers
constructed within the boundaries of said Sewer District No,
BE IT FURTHER Rl3SOLVED, that it is hereby declared to be the policy of the Village of Edina that such Railway Company property be not
included in any lateral sewer district in the future by reason of such
lack of benefits unless such inclusion is requested by the said Railway
Company.

Notion to adopt the foregoing resolution was seconded by Wyatt and on rollcall there were five ayes and no nays, as follows: Utley, aye;
Willson, aye; Wyatt, aye; Hawthorne, resolution was adopted,
Motion that the chairman of the utilities committee and the village
attorney be directed to prepare and cause to be sent to all affected
council in regard to Sewer EQistrict No, 8 was made by Hawthome,
seconded by Wyatt and carried.
Members of the councfl discussed informally the matter of construction of a wall along Minnehaha creek by A, R. Blackbourne and the village
attorney made a report concerning legal aspects of the matter,
-property ovmers a letter giving notice of the actions taken by the
Motion to request the Minnesota Public Examiner to audit records of the village,for 1944 as soon as possible after Jan. 1, 1945, and to
set up a double-entry record system for the village was made by Wyatt,
seconded by Hawthorne and carried,
Motion to adjourn was made by Hawthorne, seconded by Wyatt and carried.
