HomeMy WebLinkAbout2005-01 Adding new Subdivision 130.04- Filling Vacancies in Office ORDINANCE NO. 2005-1 AN ORDINANCE ADDING NEW SUBSECTION 130.04 OF THE CITY CODE - FILLING OF VACANCIES IN OFFICES THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS: Section 1. Purpose. Pursuant to Minnesota Statutes, Section 412.02, Subd. 2a, the Council must specify by ordinance under what circumstances it will hold a special election to fill a vacancy in a City elective office other than a special election held at the same time as the regular City election. Previous vacancies in City elective offices have been filled by Council appointment until an election has been held at the same time as the regular City election as provided by Minnesota law and the Council wishes to continue with this practice. Section 2. Subsection 130.04 of City Code. The following new Subsection 130.04 is added to the City Code: 130.04. Filling of Vacancies in Offices. Each vacancy in the office of the Mayor or any Council Member shall be filled by Council appointment until an election is held at the same time as a regular city election as provided in M.S. 412.02, subdivision 2a, and no special election to fill a vacancy will be held at other than the same time as the regular City election.
