THE EDINA VILLAGE COUNCIL, HELD IIJ

VILLAGE HALL, I.fOIJDAY, AUGUST 26,
Members present were Willson, Utley and Hawthorne, with Utley presiding.
Ifinutes of the Special Heeting of July 15 and the Regular Xeeting of August
12, 1946, were approved as submitted, by motion Millson, seconded by
Hawthorne and carried.
Motion by !fillson approving Payrolls in amount of $3,073.18 was seconded
by Havkhorne and carried.

Fursuant to Wesolution Setting Assessment Hearingir, as passed by the Village
Council Jfly 22, and published in Hennepin county Beview on July 25, hearing
vas held on the matter of assessing Beard Avenue property from 56th to 58th
Street for gradins. 1-k. Peder Ilickelsen objected to the assessment, stating
that it vas his belief that the grading was not to be assessed. Letter from
Helen R. Jerome ms read, stating that about 1/2 the grading between 56th and
57th had been done by Bolander at her expense,
be tabled for consideration by entire council was seconded by ?fillson and
carried.
Fursuant to "Resolution Setting Assessment Hearing", as pzssed by the Village
Co&icil July 22, and published in Hennepin county Review on July 25, hearing

Pursuant to "Notice of Hearing", published in Hennepin county Review, Hopkins,
I-ijrinesota, July 22, 1946, as per affidavit or publication read by Clerk,
public hearing vas held on proposed construction of sewer mains in Sanitary
Sewer District Ro. 17. Deed from Arthur 0. Edwards, Jr. and Gail Jean Edwards,
for the East thirty feet of Oaklawn Avenue, from X.56th Strect to the South
line of Kellogg Place vas accepted by the Council, subject to checking by
the Village A\torney, per motion by Hawthorne, seconded by '&llson and carried.
There were no objections, oral or written.

Engineer Smith presented plans, specifications, ad estimzte of cost, in
mount of $3,811.40, for Sanitary Sewer construction in Sanitary Sever
District No. 17. &w-bhorne offered the following Resolution and moved

Philip W. Smith has drawn p&ns and specifications for sanitary sewer
in the following streets:
Kellogg Avenue, from 1~56th Street to Kellogg Place;
Kellogg Place, from Kellogg Avenue to oaklai+m Avenue;
Oaklawn Avenue, from Kellogg Place to tJ.56th Street; .
and has tabulated the results of his estimate of the cost thereof, all
of which has been reported to the Village council, now therefore,
BE IT RZSOLVED by the Village Council of the Village of Edina that
said plans and specifications be hereby accepted and be filed with the Clerk,
where they shall rem&~,on file open to inspection of all persons until
after a contract for the work shall be let.
B% IT FURTHER RESOLVED that the Clerk be directed to advertise for
bids for proposals for doing the work described in said plans and
specifications in The Hennepin county Review and the Construction Bulletin,
said publication to be at least once in each week for three successive
weeks, said bids to be opened September 23, 1946.

there were .three ayes and no nays as follows:

Extension of sewer mains on Kellogg Avenue, from Y.56th Street to
Kellogg Place; Kellogg Place, from Kellogg Avenue to Oaklam Avenue;
and Oaklawn Avenue from Kellogg place to W, 56th Street, was

in the above named streets be held September 9, 1946, at 8:OO P.P-I.,
and that the clerk be authorized to publish notice of said hearing in
Hennepin county Review August 29 and September 5, was seconded by
VJillson and carried.
Pursuant to Advertisement for Bids, published in Hennepin County Review
August 22, 1946, as per affidavit of publication read by Clerk, bids
were called on construction of curb and gutter on the following streets:

Petition signed by 100 per cent of the property owners on the North side
of 49 1/2 Street between France and Halifax Avenues, protesting 49-foot
set back for buildings on this property was presented by sfessrs, Kell,
Bjorkman, and Adams, wishes a
definite plan foF 49 1/2 Street, and that, since the property owners
object to the plan approved by the council and the Planning CodsSion,
the burden rests on the property owners to agree upon a plan among them-
selves and bring it to the council for their consideration.
Notion to defer hearing on 49 1/2 Street Improvements until such time as
a s$t-back plan is agreed on was made by Hawthorne, seconded by Villson
and carried,

of paving and construction of cub and sidewalk on W. 50th Street between
France and Halifax Avenues, amount $8,113.5O, recommending that this bid
be accepted,
sidewalk construction, and was told that cost of ~avement and curb would
be assumed by all property owners, but that the aidewalk assessment would
be in direct relabion to the amount of walk it would be necessaryto
construct at each property; and that if no sidewalk were constructed there
would be no sidewalk assessment,

Enutes of the Planning commission Neetings of July 30 and August 13, 1946,
were rezd,

Recommendations of the Commission to the council were tabled until
Engineer Smith stated that the petition fbr sanitary sewer on 3. 49th Strset,
from Frmce to &ple Road, as filed with the 'lerk, has been signed by 65%
of the owners of abutting propzrty, I4otion by Hawthorne that public hearing
be held en this petition September 9, and that the clerk be directed to
publish notice of hearing August 29, was seconded by lillson and carried.
1-lr, Bailey, Chief of Fire Depzrbment, reported that 4605 Bruce has been
cleared of glider noses, and that there is now no fire hazard,
