Members present were Child, IJillson, Utley, and Christopher, Daputy Clerk Gretchen Schussler acted as Clerk, Reports of all Counc53 Committees were read and filed, Chairman Child, of the Ordinances and Legislation Codttee recommended that copies of 'tFood Ordinancett, as drafted by Attorney IEndhorst, be forwarded to foot handlers in the Vjllage, and that hearing on said proposed ordinance be held July 7. p%s, Charles Rossner, owner of two lots in Peacedale Acres, requested informtion as to what could be done to hprove, by platting or building small homes, or a camp, I She was directed to cofer With Nr. Smith about this property, Attorney Faegre, representing Eir. Schmitt of Golf Terrace, asked that the Council delay further consideration of the Golf Terrace straightening and continuation to NormandaleRoad until such time as further petition should be presented. He reiterated his client's position on this matter is neutral providing he secures access to his garage upon straightening of street. Hr. HcGlynn, who was also present on theGolfTerrace matter, stated that since the hearing of Hay 26, there has been considerable discussion by the property owners; and that he believes sane of them, as I-ks. B?r. Roy Bjorkman's letter complimenting Council on ltannual Statement to Taxpayers" was read and filed, with office directed to acknowledge same, Hr, Utley reported that the water rates case would come to trial on June 4. Hr, C, J. Halltnan reporbed the sppeding of the blue cabs along Oak Drive. was told that Police Department would continue to poice OakeDrive with reference to this matter. He Proposed re-assessment of Water Plain Improvement District No, 5, to include Broohline 2nd Addition, was duscussed; with Mr, Utley requesting the office to outline the matter to Mr. Windhorst and request legal opinion from him as to procedure for such assessment, Trustee Utley asked for legal opinion to be secured with regard to the Village's requiring the owners of old and obsolete plats to replay them in accordance with new specifications; and asked if the Planning Code can l%gally include provision that Plats, if not developed within a certain number of years, can be ordered changed by the Village. Engineer Smith inquired as to procedwe to be followed in securing the co- operation of Hinneapolis, llorningside, and Streetcar Campany, in the proposed France Avenue Pavine; project, He was told that this matter would be left to his own judgment, except that the Council did think it advisable to contact Morningside with reference to their paving the one block from their business 6/2/47' district, south to Edina!s north Village line. Engineer Smith reported that the George W. Sandquist Construction Company is anxious to have streets and alleys graded immediately, as per their petition dated May 19, as it is necessary for their crews to get into their property at once for construction work. IJillson offered the following Resolution: RESOLUTION SETTING STREET AND ALLEX IMPROTTEMENT HEARING -L l1JHERE;AS, the Village Council. desires on its own motion to improve the following streets and alleys: Mord Avenue, between W. 5lst Street and Inteelachen Blvd. The North-South Alley, in Block 4, Brookside Heights, from W. 5lst Street to the North lot lines of Lots 6 and 23, Block 4. The North-South Alley, in Block 3, Brookside Heights, from W. 5lst Street to the North lot lines of Lots 6 and 23* Block 3. according to the plat of record and on file at the office of the Register of Deeds for Hennepin County, by the grading thereof as authorized by 'Chapter 332, Laws 1903, now therefore, EB IT RESOLVEI), By the Village Council ofthe Village of Ediua that it fsldeemed necessary and expedient to grade said street and alleys; and that on the 23rd day of June, 194'7, at.8:OO P.M., this Council will meet at the Village Hall in said Village and will at said time and place hear the prties interested therein in reference to such improvement, and will decide whekher or nut to undertake such improve- ment, in whole or in part. BE IT FURTHER RESOLVED, That interested parties be notified that if such improvement is undertaken, the cost of said construction will be assessed against the abutting properties, in accordance with law, Motion for adoption of Resolution was seconded by Child, and on Rollcall there were four ayes, and no nays, as follows: Utley, aye; Hawthorne, aye; and the Resolution was adopted. There being no further business to come before the Council, the meeting was adjourned, by*motion Willson, seconded by Child and carried.
